73-A-5 & 73-A-7 -Lone Oak and FM 78 AN ORDINANCE /yv. ' SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF TWO CERTAIN TRACTS OF LAND CONTAINING 1.062 ACRES; AND 5.555 ACRES, RESPECTIVELY, BY THE CITY OF SCHERTZ, TEXAS, AND AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING. WHEREAS, two certain tracts of land containing 1.062 acres and 5.665 acres, respectively, which tracts of land are. hereinafter fully described by metes and bounds,-adjoin the corporate limits of the City of Schertz, Texas, and do not exceed one-half (1/2)c";mile in width; and ~ WHEREAS, the owners of said land which is vacant and without residents have submitted a petition in writing to the ' governing body of the City of Schertz, Texas, requesting the annexation of such land; and WHEREAS, the City Council of the City of Schertz, Texas, is of the opinion that such territory is suitable for municipal purposes and that it is in the best interest of the City of Schertz, Texas, and the citizens and inhabitants thereof that said tracts of land be annexed .to and made a part of said City; and WHEREAS, the City of Schertz, Texas intends to in-. stitute proceedings to annex said territory and, in compliance with the provisions of the municipal annexation act (Chapter 150, Acts of the 58th Legislature, Regular Session,. 1953, as amended; compiled as Article 970a, Texas Devised Civil Statutes) has scheduled a public hearing at :O O o'clock M., on the day of ~ , 1973 in the ~Iunic3.pa1 Build3.ng of -the City of Schertz, Texas, in order to provide an opportunity. for all interested persons to be heard; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I That on the ~ day of 1973 at ~ giv~.ng all ~.n~teres~tea persons the right to appear and be heard on the proposed annexation of two certain tracts of land containing 1.052 acres and 5.605 acres, respectively, which tracts of land are described as follows, to-wit : A 1.052 acre tract out of a tract recorded in Volume 71, Page ~F79 of the Deed Records of Guadalupe County, Texas, and being part of the unplatted portion of Lone Oak Subdivision, Schertz, Texas, as recorded in Plat Record, Volume 3, Page 3, BEGINNING at the Northwest corner of Lone Oak Subdivision and tract recorded in Volume 71, Page X79 of the Deed Records of Guadalupe County, Texas, said point-being on the south line of F.M. 78; THENCE: in an easterly direction along the south line of F.M 78 and along a curve, having a radius of 375.80 ft., a distance of 180.34 ft. to an iron pin set on the west line of Cloverleaf Drive; THENCE: S lg°, 53' E, along the west line of Cloverleaf Drive, a distance of 300.75 ft. to an iron pin set on the north line of 15.00 ft. alley; ' THENCE: S 68° ~3' W, along the north line of said alley, a distance of 127.81 ft, to an iron pin set on the - i. west line of Lone Oak Subdivision; ~ THENCE: N 2g° 53' W, along the west line of Lone Oak Subdi- vision, a distance of 302.15 ft. to the point of beginning and containing 1.052 acres of land. A 5.565 acre tract out of a tract recorded in Volume 71, Page 479 of the Deed Records of Guadalupe County, Texas, and being part of the unplatted portion of Lone Oak Subdivision, ' Schertz, Texas, as recorded in Plat Record Volume 3, Page 3, BEGINNING at an iron pin set on the south line of F.M. 78, said point located on the east line of Cloverleaf Drive, and north line of said Lone Oak Subdivision; THENCE: in an easterly direction along the south line of F.M. 78 and along a curve., having a radius of 375.80 ft., a distance of 735.45 ft. to an iron pin set for a corner of said subdivision; THENCE: S 30° 15' E, along the boundary of Lone Oak Subdivi- sion, a distance of 275.85 ft. to a corner; THENCE: N 59° ~F5' E, along the boundary of Lone Oak Subdivi- sion, a distance of 183.06 ft. to a corner of said Subdivision; THENCE: 5 30° 15' E, along the eastern boundary of Lone Oak Subdivision, a distance of 138.x+9 ft. .to wn iron pin set for a corner of this tract; lri~lvc:~: in a westerly direction, along a curve, having a radius of 3~+5~.8o ft. and along the north line of a 15.00 ft. alley, a distance of 1000.55 ft. to an iron pin set on the east line of Cloverleaf Drive; THENCE: N 19° 53' W, along the east line of Cloverleaf Drive, a distance of 300.02 ft. to the point of beginning and containing 5.555 acrds of land. II i The City Secretary is hereby authorized and directed to cause notice of such public hearing to be published once in a newspaper having general circulation in the City of Schertz, I Texas, and in the territory proposed to be annexed not more than twenty (20) days nor less then ten (10) days prior to the date i of such public hearing. PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEX- ' ATION OF TWO CERTAIN TRACTS OF LAND CONTAINING 1.062 ACRES AND 5.665 ACRES, RESPECTIVELY, AND REDEFINING THE BOUNDARY LIMITS OF SAID CITY. WHEREAS, the hereinafter described territory adjoining the corporate limits of the City of Schertz, Texas, and does not exceed one-half (1/2) mile in width; and WHEREAS, the owners of said land which is vacant and ' without residents have submitted a petition in writing to the governing body of the City of Schertz, Texas, requesting the annexation of such land; and WHEREAS, the City Council has held a public hearing ~ in order that all persons could be heard on the question of i such proposed annexation; and WHEREAS, by the passage of this ordinance, annexation of said territory will have been brought to completion within ninety (90) days of the institution of annexation proceedings; ! and ~ ~ I WHEREAS, the City Council of the City of Schertz, Texas, is of the opinion that such territory is suitable for municipal purposes and that it is in the best interest of the City of Schertz, Texas, and the citizens and inhabitants thereof that said terri- tory be annexed to and made a part of such City; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I That the following described territory lying adjacent to and adjoining the City of Schertz, Texas, to-wit: a is hereby added and annexed to the City of Schertz, Texas, and said territory as described shall hereafter be included within the boundary limits of said City and the various points conti- guous to the area described are hereby altered and amended so as to include said land and territory within the corporate limits of the City of Schertz, Texas. ' II That the territory so described and the areas so annexed shall be part of the City of Schertz, Texas, and all i taxable property situated therein shall hereafter bear its pro rata part of the taxes levied by the City of Schertz, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Schertz, Texas.
