Whereupon, among other business the following was transacted at said meeting: A written or- dinance calling an election for the purpose of determining whether a tract or parcel of land containing 230.550 acres shall be annexed by the City of Schertz, Texas, was intro- duced for the consideration of the Council and read. in full. ZI That the polling place of said election shall be at , and the entire land r territory as described in the foregoing proposition shall be and constitute one election precinct for the hold- ing of said election; and is hereby appointed Presiding Judge of said election, and a= is hereby appointed Alternate Presiding Judge of said election. III That said Alternate Presiding Judge above named, shall, in the absence of the Presiding Judge, perform the duties of the Presiding Judge of said election; and the Pre- siding Judge shall appoint for such election as many quali- fied voters of the election precinct to serve as clerks in said election as may be reasonably necessary to properly conduct said election, the appointment of such clerks to include the Alternate Presiding Judge if he be present for the holding of such election. IV That absentee voting in said election shall be con- ducted at the City Hall of said City in Schertz, and the Gity Secretary is hereby charged with the duty of conducting ab- sentee voting in said election, as required by law. V That the polls for said election on the date of said election shall be open from 7:00 o'clock A.M. to 7:00 o'clock P.M. VS That the ballots to be used in said election shall be prepared in conformity with Y~A.T.C.S. Election Code, as amended, and in such manner that the electors may cast their ballots either "FOR" or "AGAINST" the following ballot prop- osition. Proposition The annexation of the land or territory described in the proposition to the City of Schertz, Texas. VII That at said election all qualified electors who reside within the land or territory, as described in the proposition, shall be permitted to vote. VIII That a copy of this ordinance, designated as a notice, signed by the Mayor and attested by the City Sec- retary and certified by the City Secretary, shall serve as proper notice of said election. IX That the City Secretary is hereby authorized and directed to post notice of said election at three (3) pub- lic places in said territory, all such notices shall be posted not less than ten (10) days prior to the date set for said election. X That the City Secretary is further authorized and directed to cause said notice of election to be published one (1) time in a newspaper published and of general circu- lation in said territory and in the City of Schertz, Texas, the date of said publication being not less than ten (10) days prior to the date set for said election. Except as otherwise provided herein, the manner of holding said elec- tion shall be governed by the applicable laws governing gen- eral elections. As of this date, we have not received the name of a person to be the liaison to work with the District's Board of Directors to facilitate a smooth transition. The 31 December 2001 date is rapidly approaching and our last regular meeting for the year is 18. December 2001. Due to the holidays, after 18 December 2001 it will be very difficult to get a quorum for any meetings, or decisions. 2. Please provide us with a response in writing to the following required acti$ns: a. An address to effect a change of address for our vendors, and other corespondents. We should have issued this change in November 2001 to correspond to your annexation date. b. When and who will receipt for and pick u~ our records? We plan to terminate the expense of records storage with Cibolo Mini-storage to correspond with the effective date of Annexation, 31 December 2001. c. Will the city of Schertz assume all liabilities/assets before or after 31 December 2001? d. When will the current tax structure stop and the tax rate for the City of Schertz start? e. Insurance is paid through March 2002. The names on the policy should be changed, or the policy canceled. Should we cancel the policy, effective 31 Dec 2001, or will you assume the , insurance and provide us with a name and address change? f. We have four contracts with the following people and agencies. Will you need any of their services after 31 December 2001? - Charles Allen, CPA Provides the monthly fmancial statements. - Jim Robertson, CPA...Performs the Annual Audit. - Northcliffe Volunteer Fire Dept...provides vegetation control for drainage ditches and water plant. - Edna M. Turner...Provides administrative, management and fmancial services. i 3. Per state law we require a legal document to dissolve the District's Board of Directors and Staff. We also require legal papers of the annexation. When shall we expect to get these - documents? 4. The Board will need at least five working. days to enable closing and transferring bank accounts and, to notify the holder of the disposition of our Bond. 5. As we have expressed several times, we are anxious to do what we can to facilitate this annexation by the city of Schertz. We recognize the benefits to the District and to the City of Schertz. However, for this to occur on the date you plan, it is imperative that we address these issues without further delay.
