AN ORDINANCE
SETTING A TIME, DATE AND PLACE FOR A PUBLIC
HEARING ON .THE PROPOSED ANNEXATION OF ONE
CERTAIN TRACT OF LAND CONTAINING 31.42 ACRES
OUT OF COMAL COUNTY BY THE CITY OF SCHERTZ,
TEXAS, AND AUTHORIZING AND DIRECTING THE
CITY SECRETARY TO PUBLISH NOTICE OF SUCH
PUBLIC HEARING
WHEREAS, the following described tract of land adjoining the
corporate limits of the City of Schertz, Texas, and does not exceed
one (1) mile in width; and,
WHEREAS, the City Council of the City of Schertz, Texas, is of
the opinion that such territory is suitable and desirable for municipal
purposes and that it is in the best interest of the City of Schertz,
Texas, and the citizens and inhabitants thereof that said tract of land
be annexed to and made a part of said City; and,
WHEREAS, the City of Schertz, Texas intends to annex said land by
ordinance and in compliance with the MUNICIPAL ANNEXATION ACT (Chapter
160 ACTS of the 58th Legislature, Regular Session, 1963, as amended),
codified as Article 970a, Texas Revised Civil Statutes, at a scheduled
public hearing as hereinafter provided in order to furnish an opportunity
for all interested citizens to be heard on such proposed annexation;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
I
That the City Council will hold a public hearing on the
day of 1977 at 7:00 o'clock P.M. in the Municipal
Building o the City of Schertz, Texas, in order to furnish all inter-
ested persons a right to appear and be .heard on the proposed annexation
of the following described tract of land, to-wit:
Being all that certain tract, piece and parcel of land in Comal
County, Texas, and containing 31.42 acres of land situated in the
George M. Dolson Survey No. 96, Comal County, Texas. Said 31.42 acre
tract out of a 61.58 acr..e tract described in a conveyance
from Edward N. Moore to H. B. Barnett recorded in Vol. 101, page 29
of the Deed Records of Comal County, Texas, less and except that
portion of the 61.58 acre tract now occupied by Farm to Market Road
No. 3009. Said 31.42 acre tract being more fully described by metes
and bounds as follows:
From the intersection of the northeast ROW line of FM 3009 and
the north line of the John Saladin Survey #'404 N60° 40 E 890.3 feet
to the point of beginning;
THENCE N 22° 08' E 12.4 feet; thence N 29° 32W 734.8 feet to
the northwest end of 'an easement hereinafter described;
THENCE continuing with the fenced west boundary of said tract
N 65° 50' E 18.0 feet to the north corner of said easement;
THENCE N 600 25' E 761.8 feet; thence N 60° 24 E 155.0 feet to
a re-entrant corner; thence N 280 26' w 188.8 feet to the northwest
corner of said tract;
THENCE with the fenced north boundary of said tract N 780 08' E
625.4 feet; thence S 530 22' E 834.6 feet to a fence corner marking
the east corner of the Geroge M. Dolson Survey;
THENCE along the north survey line of the John Saladin Survey
#404 S 60° 40' W approximately 1870.0 feet to the southeast corner
of an easement; thence S 600 40' W 28.0 feet to the point of beginning.

The City Secretary is hereby authorized and directed to cause
notice of such public hearing to be published one time in a newspaper
having a general circulation in the City of Schertz, Texas, and in the
territory proposed to be annexed not more than twenty (20) days nor
less than ten (10) days prior to the date of such public hearing.

Council of the City of Schertz, Texas, convened at a regular meeting at the
regular meeting place in the Municipal Building in the City of Schertz,
Texas, pursuant to due call and notice to all of the members of said City
Council, which meeting was at all times open to the public, and at which
meeting the following members were present, to-wit:

There being a quorum present, the meeting was called to order by the
Mayor, and, among other proceedings had were the following:
The Mayor introduced the hereinafter set forth ordinance, which has
been read and considered at the last-regular meeting of the City Council on
the 19th day of April, 1977. It was determined that the City Secretary
had caused a short synopsis of said proposed ordinance to be published in the
official City newspaper after its consideration at the last regular meeting
of the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further considered by the
Council.
Thereupon it was moved by Councilman
and seconded by Councilman
that said ordinance be finally passed and adopted. The Mayor put the motion
to a vote of the members of the City Council and the ordinance was finally
passed and adopted by the following vote:
