81A10-Annexation of 103.65 acres ORDINANCE . N0. AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 103.65 ACRES OF LAND MORE OR LESS, OUT OF THE COUNTIES OF COMAL AND GUADALUPE WHEREAS, the hereinafter described tract of land adjoins the corporate limits of the City of Schertz, Texas, and does not exceed one (1) mile in width; and WHEREAS, a public hearing on the question of whether said land should be annexed to and become a part of the City of Schertz, Texas, was duly called and notice thereof given and said public hearing has been had, all in accordance wit~ahl~w~;ar~dd WHEREAS, by the passage of this ordinance annexation of said territory will have been brought to completion within ninety (90) days of the institution of annexation proceedings; and WHEREAS, the City Council of the City of Schertz, Texas, is of the opinion and finds that such territory is suitable for municipal purposes and that it is in the best interest of the City of Schertz, Texas, and the citizens and inhabitants thereof that said territory be annexed to and made a part of said City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I That the following described territory containing 103.65 acres ~ of land lying adjacent to and adjoining the City of Schertz, Texas, be, and the same is hereby added and annexed to the City of Schertz, Texas and said territory shall hereinafter be included within the boundary limits of said city and the various points contiguous to the area described are hereby altered and amended so as to include said land and territory within the coprorate limits of the City of Schertz, Texas; said land being more parti- cularly described by metes and bounds as follows: uciLU Nviaa~, a?c.a.aay ~.aac 1a1~.ctaCl:l.1V11 V1 L11C 11ViL11 i1cj11L-Vl-WdY 11i1C of I.H. 35 and the west property line of the Richard Kraft 2.85 acre tract. • THENCE North 33°56' West, 760 feet more or less to a point in the west line of the Richard Kraft 29.67 acre tract for the west corner of the herein described tract. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Councilmember Earl W. Sawyer and seconded by Councilmember Jeff Duffield that said ordinance be finally passed and adopted. However, prior to making such an adjustment, federal law requires that the State of Texas provide a certification that each city over 5,000 population has complied with all Texas law in making these boundary changes. In order to facilitate this process at the state level, Governor William P. Clements has delegated the responsibility for such certification to the Texas Department of Community Affairs.
