09-09-2009 PLANNING AND ZONING MINUTES September 9, 2009 The Schertz Planning and Zoning Commission convened on September 9,2009 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. CALL TO ORDER/ROLL CALL Mr. Richmond called the meeting to order at 6:31 P.M. 2. HEARING OF RESIDENTS No citizen comments. 3. MINUTES A. Regular Meeting - August 12,2009. Mr. Greenwald moved to approve the minutes. Mr. Sommers seconded the motion. Abstaining: Mr. Edwards. Voting Aye: Ms. Tutschke, Mr. Sommers, Mr. Greenwald, Mr. Wallace and Mr. Richmond. Motion carried. 4. PUBLIC HEARINGS: A. PC 2009-014 3009 Horizon Hold a public hearing, consider and act upon a request for approval of a replat of Lot I, Block 2, of the 3009 Horizon Subdivision establishing Lots 4,5,6, Block 2,3009 Horizon Subdivision consisting of 6.67+ acres of land located near the intersection of FM 3009 and Triton. This property is currently zoned General Business - 2 (GB-2). Public hearing opened at 6:36 pm. Ms. Sanchez reviewed staff comments. Mr. Richmond recognized the following: . Mr. Brockman stated that he was curious about the signage for the additional lots. Public hearing closed at 6:37 pm. After discussion on multi-tenant signage, and access to Triton Drive, Mr. Edwards moved to approve this Minutes Planning and Zoning Commission September 9, 2009 Page I of3 item. Mr. Wallace seconded the motion. Vote unanimous. Motion carried. 5. ITEMS FOR INDIVIDUAL CONSIDERATION: A. PC 2009-015 Kramer Farm Unit 3A-Preliminary Plat Consider and act upon a request for approval of a preliminary plat of Kramer Farm Subdivision Unit 3A. The l7.739:t-acre tract contains 94 residential lots and is located at intersection of Kramer Parkway and Schertz Parkway. The property is zoned Garden Home District (GH). Ms. Sanchez reviewed staff comments and advised the Commission that the applicant was present. Mr. Richmond recognized the following: . Don McCrary, Don McCrary and Associates, stated that there were very few changes and was available for question. After discussion on the location of two story homes, Mr. Greenwald moved to approve this item with the condition that no two story homes abut a one story home located in the adjacent to Parkland Village or Val Verde Subdivision. Mr. Sommers seconded the motion. Vote unanimous. Motion carried. [Note by Recording Secretary - The condition placed on this plat by the Commission was verified by the City Attorney and it was confirmed that the Commission cannot place a development design restriction on a plat with the intention of imposing the design of homes beyond what is required by the UDC.] B. PC2009-016 Kramer Farm Unit 3B-Preliminary Plat Consider and act upon a request for approval of a preliminary plat of Kramer Farm Subdivision Unit 3B. The 2.076:t-acre tract containing 11 residential lots and is located at intersection of Kramer Parkway and Schertz Parkway. The property is zoned Garden Home District (GH). Ms. Sanchez reviewed staff comments and advised the Commission that the applicant was present. Mr. Sommers moved to approve this item. Mr. Wallace seconded the motion. Vote unanimous. Motion carried. 6. ITEMS FOR DISCUSSION ONLY: A. Discussion regarding Tree Mitigation. (D. Richmond) Mr. Richmond started by expressing his concerns with the recently adopted section on tree mitigation. The following items were discussed in regards to the UDC - Tree Mitigation Section: . Sec. 21.9.9 D Tree Mitigation - The changes dilute the ordinance and violates the understanding by the people who contributed to the fund. (Richmond and Wallace) . Tree Mitigation was part of the Planning and Zoning Commission duties, now Parks is involved. (Richmond) . Additional fee for removal of trees without a tree removal permit. (Sommers) . Discussion in regards to Sec. 21.9.9 E - Tree protection standards and who enforces the section. (Greenwald) . Sec. 21.9.9 I Criteria for Tree Removal Permit - the word "may" needs to be changed to "shall" (Greenwald) . City Councils part in the review process for the fees. (Richmond) . Review of City projects by Planning and the Commission. (Richmond) . Alternate uses for the fund such as; trees along Dietz Creek. Discussion regarding Residential District Spreadsheet. (D. Richmond) Mr. Richmond discussed the spread sheet supplied by GIS and suggestions for clarification. . Residential - Zoning . Acreage of Zoning district . Parcel count . percentages 7. REQUESTS AND ANNOUNCEMENTS A. Requests by Commissioners to place items on a future Planning and Zoning Agenda. Discussion regarding AP A Conference. B. Requests by Commissioners to Staff for information. No requests to staff. C. Announcements by Commissioners and Council . October 2 & 3 - Schertz Fest . Party in the Park - Jazz and a movie . Police Department is addressing the tractor trailer parking on Windy Meadows. 8.
