03-12-1985 PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in a regular session on Tuesday, March 12, 1985 in the Municipal Complex Council Chambers, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COPIMISSION OTHERS PRESENT JOHN LINEBARGER, CHAIRMAN BOB ZUNKER TOM YARLING, VICE-CHAIRMAN JEFF ZUNKER DARWIN PEEK, SECRETARY MERWIN WILLMAN BOB ANDREWS JAMES HARDEN KEN GREENWALD, COUNCILMAN MEMBERS ABSENT CITY STAFF RAY STANHOPE EARL HARTZOG, PLANNING COORDINATOR #1 CALL TO ORDER Chairman Linebarger called the meeting to order at 7:00 P.M. #2 APPROVAL OF MINUTES A. Regular Session February 26, 1985 Merwin Willman made a motion to approve the minutes. Darwin Peek seconded the motion and the vote was unanimous in favor. B. Joint Public Hearing and Special Session March 5, 1985 It was noted that in Item #2 of the Special Session the motion should be amended to read: "Merwin Willman made a motion to recommend approval of the proposed zoning and that a copy of the proposed zoning map be part_of the ordinance showing the area to be zoned to include the number of acres in each zoning district." Merwin Willman made a motion to accept the minutes as amended. :Bob Andrews seconded the motion and the vote was unanimous in favor, #3 CONSIDER AND MAKE RECOMMENDATION: Exception to pending ordinance to place a 25' x 30' glavanized structure within the FM 3009 Special Overlay District (1212 Antler). Earl Hartzog advised the Commission that according to our legal expert, because of the pending ordinance on the Special Overlay District for FM 3009, compliance can be required. Mr. Zunker presented pictures and a set of construction plans including a site location. It was noted his property is to a depth of 253 feet from the'Fh1 3009 right-of-way. The planned building would be 213 feet from the right-of-way. The structure would be a well constructed carport with three sides - there would be no doors. After a brief discussion, Thomas Yarling made a motion to recommend P7r. Zunker's request be denied. Merwin Willman seconded the motion and the vote was unanimous in favor. Chairman Linebarger advised Plr. Zunker of the Commission's decision and that he could request a special appeal from the City Board of Adjustment. His appeal would need to be submitted in writing. The FPS; 3009 Special Overlay District would be scheduled for a public hearing around April 16, 1985. It was also noted that the City has a pending ordinance, and granting exception before the ordinance is passed would defeat the purpose of the ordinance. #4 CONSIDER AND MAKE RECOP9PlENDATION: FF1 3009 Special Overlay District After a brief discussion about some of the items within the Special Overlay District and some minor changes being made, Darwin Peek made a motion to recommend this item be scheduled for a public hearing. Bob Andrews seconded the motion and the vote was unanimous in favor. The public hearing for the item will probably be scheduled on April 16, 1985, and if time permits, the City Planager will Piave a public meeting at least a week before. #5 CONSIDER AND P~AKE RECOP~MENDATION: Subdivision Ordinance Earl Hartzog advised the Commission that the requirement for construction was just about finished, and .hopefully, the Staff review would 6'e completed in time for the next meeting. The ordinance needs to be changed on vacate and replate because the- Commission is required to have a public hearing on these in the E.T.I. also. #6 CONSIDER AND MAKE RECOMMENDATTON~ Sign grdinance Merwin Willman advised the status of this project and planned to F~ave.at ready by April 23, 1985. He had just received a cagy p~ th.e l~us~t~rn Sign Ordinance and had not had sufficient time to study itm There was discussion on bandit signs along FM 3009 which are presently unauthorized in-the ordinance. There were a number of other unauthorized signs discussed, including those in the railroad right~ofAway~a~nd the other side of FM 78. The exisiting ordinance needs to be enforced before tDe proposed changes are made to the ordinance; There i~s a height restriction of 35 feet which is not being enforced; Ray Stanhope arrived at the meeting at 9:06 P.M. #7 GENERAL DISCUSSION Planning and Zoning Feedback List Item #6 - "Mobile Home - 422 River Road" should-be deleted from the list - the Board of Adjustment disapproved the request. Add Storage garage - 1212 Antler Temporary building - 500 block Main Updated copy of Planning and Zoning Rules of Procedure.. Pending plats/development Updated Planning and Zoning Feedback list attached to minutes. Zoning Ordinance - establish GB-l, GB-2 GB-3 - elimination of NS and OP would be on the agenda for the next meeting. Councilman Greenwald advised the Commission on the outcome of the Joint Schertz-Cibolo Council and Planning and Zoning Commission Committee meeting. It was noted another mobile home was placed along IN 35 North of Northcliffe which is not in compliance with the ordinance. #8 ADJOURNMENT Chairman Linebarger adjourned the meeting at 9:23 P.M.
