11-19-1985 The Schertz Planning and Zoning Commission and City Council conducted a Joint Public Hearing on Tuesday, November 19, 1985 in the Municipal Complex Council Chambers, 1400 Live Oak Road. Members present were as follows: M1 PLANNING AND ZONING COMMISSION CITY COUNCIL THOMAS YARLING, CHAIRMAN EARL SAWYER, h1AYOR BOB ANDREWS, VICE-CHAIRMAN CHUCK SHARPE _ JAMES HARDEN, SECRETARY ADOLPH AGUILAR MERWIN WILLMAN KEN GREENWALD DAVID ALLEN HAL BALDWIN RAY STANHOPE MEMBERS ABSENT TY BRISGILL DONALD WILSON CITY STAFF STEVE SIMONSON, PLANNING COORDINATOR NORMA ALTHOUSE, RECORDING SECRETARY JUNE KRAUSE, CITY SECRETARY _ JIMMY GILMORE, CITY MANAGER #1 CALL TO ORDER Mayor Sawyer called the meeting to order at 7:00 P.M. and turned the meeting over to the Planning and Zoning Chairman Thomas Yarling. #2 PUBLIC HEARING: Zoning Change #74 To receive input from the public on a rezoning request by Live Oak Joint Venture No. 1 for a 14.65 acre tract of land from Single Family Dwelling District (R-1) to Neighborhood Service District. Said land fronts on the north side of East Live Oak Road, approximately 497.1 feet east of Maske Road .and approximately 2,882.3 feet west of Jack Hays Boulevard ~FM 3009). The petitioner contemplates development which provides for a buffer effect be- tween itself and adjoining residential areas. Proposed use of said land, if rezoned to Neighborhood Service District, will include garden offices and a pos- sible day care center. The minutes of this public hearing are a duplication of the City Council minutes. #3 GENERAL DISCUSSION There was none. _ #4 ADJOURNMENT OF PUBLIC HEARING Chairman Yarling turned the meeting back over to Mayor Sawyer who adjourned the Public Hearing at 7:48 P.M. The Planning and Zoning Commission reconvened in a special session, after the Joint Public Hearing, in the Municipal Complex Conference Room. #5 CALL TO ORDER Chairman Yarling called the meeting to order at 7:59 P.M. #6 CONSIDER AND MAKE RECOMMENDATION: Zoning Change #74 There was some discussion on the input from the citizens at the public hearing. James Harden asked if we give them the zoning, and after one year they don't develop, can we revert back to the old zoning. Bob Andrews remarked that he felt like we are spot zoning. Chairman Yarling commented that we don't know how far in the future the extension. of Schertz Parkway is planned. David Allen asked if. it is good for the City. Mr. Allen commented there are (with the extension of Schertz Parkway) already two major arteries and he feels we are going to end up with residential pockets surrounded on each side by busi- ness districts. Merwin Willman commented on the future usage of Schertz Parkway by the residents of Woodland Oaks and Savannah Square. Chairman Yarling asked how much population was projected for those two areas. Merwin Willman replied he thought approximately 500-for Woodland Oaks and 300 for Savannah Square. Bob Andrews remarked that with those two areas and the proposed Morton Southwest Subdivision, the amount of homes in Schertz is expected to double in the next five years. Chairman Yarling asked if it's in the best interest of the City to rezone at the present time. Bob Andrews commented we may see this request again in two years. James Harden said let's see what happens first in the next two years. Steve Simonson remarked that the only two positive things scheduled to develop so far along FM 3009 .a re ice houses.- Bob Andrews pointed out there will also be a day care center developing even though it does not front FM 3009. ~ . Bob Andrews asked if there was any input from the Staff. Steve Simonson replied there was none. r There was a brief discussion on the future extension of Schertz Parkway such as . possible drainage problems that may be encountered and the percentage of committ- ments from developers toward the extension. Bob Andrews made a motion to recommend disapproval of Zoning Change #74 because • it does not conform to the City Master Plan. David Allen seconded the motion end the vote was unanimous in favor. #7 CONSIDER AND MAKE RECOMMENDATION: Zoning Ordinance The members reviewed the changes suggested by them and typed up since the last meeting for Article I through Article V, Section 3.9. They then reviewed and made their suggestions for-changes to Article VI through Article IX, Sec=tion 6.10. Merwin Willman reminded the Commission of the suggestions by Earl Hartzog for an R-6, R-7; R-8, PUD, Business Park District and AICUZ Overlay. Chairman Yarling commented it would be a good idea to have those suggestions included in the package and covered at the next meeting on November 26, 1985. Ken Greenwald remarked that the AICUZ must be consided in all zoning. #8 GENERAL DISCUSSION Chairman Yarling told Steve Simonson how much his presentation at the public hearing was appreciated. Mr. Simonson commented on the new letters that have been incorporated to send out for public hearings and said we should be getting better response as a result. Ken Greenwald stated that the plan presented by San Antonio at the Council meeting for Schertz to annex the Schermerville area was not acceptable. Mr. Greenwald said it was not the same plan presented originally. Merwin Willman suggested the Commission consider the zoning of the area annexed along FM 1518 and set up a public hearing. Ken Greenwald commented the Commission should get some kind of idea of what's already in the area. Merwin Willman said he had noticed a little house next to the Church on FM 1518 and wondered if they. had gotten. a building permit. Steve Simonson replied that that particular property was not owned by the Church - it was a new business and yes they had gotten a permit. Chairman Yarling commented it would be nice for the Commission to have a computer - printout of the permits issued. Bob Andrews said he had noticed a couple of double wides in Leon Parker's Mobile Home Park and commented they were surely in the floodplain. Merwin Willman remarked that Mr. Parker is •going to be selling mobile homes. Steve Simonson said they were temporary displays and the City was aware of it. Bob Andrews commented there should be some kind of renewal procedure for Home Occupation Permits. Reference was made to Signoria Tucker who was issued one and now no longer resides in Schertz. Chairman Yarling said if she no longer lives there, the permit .should expire. Merwin Willman remarked he thought there was a health inspection required once a year. Ken Greenwald informed the Commission-that Ty Brisgill and Don Wilson are going to be asked to sit in on the writing of the Overlay Ordinance for Schertz Parkway. There is a public hearing scheduled for December 3, 1985. .The next regularly scheduled meeting is November 26, 1985. #9 ADJOURNMENT Chairman Yarling adjourned the meeting at 10:00 P.M.
