BILL HEATH 1101 FAWN RUFUS BARNES, 1113 A~'TLER TOM JACKSON, 904 FAWN #1 CALL TO ORDER Chairman Andrews called the meeting to order at 7:00 P.M. #2 APPROVAL OL' MINUTES: Regular Session July 26, 1988 Mary Marsh commented that on Page 8, the first paragraph u:~der Item #E where it says "therefore make a notation to that effect in the City Plan" does not go far enough and suggested saying "we should make a note in the City Plan that based on our estimates, (since the population now stands at 12,500) we project this, that and the other . Mary Marsh seconded the motion and the vote was as follows: AYES: B. Andrews, M. Willman, M. Marsh, J. Potempa NAYS: None ABSTENTIONS: K. Van Dine Motion carried. Ty Brisgill arrived at the meeting at 7:04 P.M. , after the vote on Item *2 had been taken. #'3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS Mark Vaughan of Vaughan Homes spoke to the Commission at this time about the rear yard setbacks in Greenshire Oaks saying they lsad been having a problem in determining what the minimum rear setbacks should be in a PUD. Mr. Vaughan said they have recently filed plans for a new house to be built that would require a rear yard setbacl~ 15' from the property Iine on one corner. Mr. Vaughan went on to say the minimum rear yard setback for R-1 zoning is 20' and they= would like to request a minimum 10' setback ~n 53 lets in Greenshire Oaks. Steve Simonson informed the Commission that in the PUD areas of bcth Greenshire Oal:s and Savannah Square all the plot plans are, for whatever reason, set with fifteen foot (15`) minimum rear =ard setbacks even though the ordinance says a 20` minimum rear yard setback for R-l, R-2, etc. Mr. Simonson said the minutes ~:ad been researched and it was found that nothing had been discussed cn rear yard setbacks. Mr. Simonson said for this reason he had asked Mark Vaughan to come in and speak with the Commission. Steve Simcnson alsc mentioned the fact that the City is getting mere ar~d more requests fcr circular driveways in this area. Mark Vaughan indicated he did not feel a 10` to 15' rear yard setback would be an encroachment on the neighboring hcmes. Mr. Vaughan said as part of tJzeir deed restrictions the 10` rear yard setbacks would be cn interior lets and the 15` rear yard setbacl~s would be on those that back up to a street, but he would like to request a 10' rear yard setback fcr the whole remainder of the Greenshire Oaks Subdivision. Mr. Vaughan also mentioned allowing a second curb cut for circular driveways and asked the Commission for their thoughts and consideration on both the rear yard setbacks and the second curb cut. ,Steve Simonson remarked to the Commission -they might possibly consider adding this item to the public hearing agenda tthe public hearing is scheduled for August 16th}. Mr._Vaughan commented the house on Lot 26 is already built, and that actually it has about a 35' rear yard setback. Referring to the house for which they have the plans.,. Mark Vaughan stated -they can scoot the house forward, but they will have to cut down some trees. Mr. Vaughan went on to say you usually have a 16' easement in the back, and that together with a 10' rear yard setback would give you 26' which is about as close as you could get to any of the lots. Mark Vaughan said the section in the ordinance on PUD's is not clear as far as setbacks are concerned. Steve Simonson commented that the setbacks in a PUD are usually whatever has been approved on the Master Plan. Merwin Willman referred to the Zoning Ordinance, Article XVIII, Section 1.1, 3, Page 24 which reads: "The height, minimum lot sizes, parking, signs, building setbacl~ lines and other requirements will apply to all districts identified and approved on Master Plans for a Planned Unit Development. When any area has two or more districts identified for that area of the PUD, the most restrictive district requirements will apply". Chairman Andrews told Mark Vaughan the Commission will definitely think about his two requests and place them on the agenda of August 23, 1988. f 5! At this time Ted Duigon of 1112 Antler Drive brought up the problem of drainage in Deerhaven. Mr. Duigon said back when Mr. Beclc sold the land south of Antler Drive, he was concerned about the drainage. Mr. Duigon explained he had been to look at the collection basin and found it to be inefficient, the elevation of entry and the elevation cf exit of the water is the same - after a 30 minute rain his backyard is inundated with water. Mr. Duigon .said the City needs to get out the testimony as to what. was said would be done when the collection basin was put in and do something about seeing that the problem is corrected. Chairman Andrews informed Mr. Duigon the testimony will be looked at and discussed with Steve Simcnsor. and from there they will advise Mr. Duigon on the status of the situation. ~4 CONSIDER AND TAKE APPROPRIATE ACTION: L'inal Plat Approval - Stone Creek R.V. Park rlcyd McKee was at the meeting to represent this request. Ty Brisgill asked Steve Simonson what Zone A is and Mr. Simonson. replied- that Zone A is a flood zor.~. Merwin Willman commented. the final plat -looks good, but just to clear the reccrd, we probably should require a variance on the 22' interior Lanes. Mary Marsh asked if the Commission can go ahead and approve a variance that Mr. McKee has not officially requested and Chairman Andrews said he thought the Commission should have something from I'loyd McKee requesting the variance. Mary Marsh made a motion to approve the final plat for Stone Creek R.V. Park contingent upon Floyd McKee submitting a request for a variance on the 22' interior lanes. Merwin Willman seccnded the motion and the vote was unanimous in favor. Motion carried. #5 CONSIDER AND MAKE RECOMMENDATION: Chuck Sharpe - Request for Addition to Schertz Master Plan Chuck Sharpe was at the meeting and gave a brief presentation on this request. Mr. Sharpe said he is proposing that they connect Antler Drive and Fawn Drive at the upper end and he drew a diagram showing the prcposed connection. The diagram showed the connection in the form of a circular turn-around. Chuck Sharpe said one thing that keeps coming up is safety and he feels this proposed connection would provide the following benefits: { 1. School buses could travel the entire subdivision without the danger cf having to back up or turn arcund in somecne's driveway. 2. Fire trucks, garbage trucks and mail delivery vans would not be forced to turn around as tht.y must at the present time. Moving vans could also serve the entire subdivision without the hazards of backing up or down narrow streets. 4. This connection would allow development of a few additional homes which would complira^nt those presently ira existence. 5. Additional traffic from the Schertz Parkway would be prevented from entering the subdivision and ccntributir~g to speeding problems ar~d further breakdown of suburban streets. Mary Marsh questioned why he was making a round connection and not one straight across. Chuck Sharpe replied to accommodate mcre houses and provide a better radius for turning around. Merwin Willman indicated he thinks it's a good idea, but building .more houses would be promoting added traffic, and he feels the streets in Deerhaven cannot .withstand mcre traffic. -4- Chuck Sharpe pointed out that if they were connected to Schertz Parkway there would be considerably more traffic and they are, willing to take a little more traffic right now in lieu of a lot more traffic .in the future. Merwin Willman referred to the R-1 zoning cf the land immediately- adjacent to .Deerhaven saying it had been zoned R-1 fcr the purpose of having a compatible zoning next to Deerhaven and also to try and have the R-1 development built in such a way as to where those streets could not be extended on out because of the condition of the roads in Deerhaven. Harry Richburg commented they don't want to go out further than the R-1, what they want is to stop traffic from going all the way thrcugh. Chairman Andrews said, in other words, you are looking for a stub-out. Tom Jackson of 904 Fawn Drive spoke up and said the adjacent land belongs to Bexar Savings and he had spoken with a gentleman from Bexar Savings who said it would be in the best interest to connect to Schertz Parkway because they could sell more houses. Mr. Jackson said he, personally, would net like to see that happen. Merwin Willman remarked that he had heard a lot in the last ten years from Deerhaven residents about wanting to beep Deerhaven the way it is and pcinted out, that in his opinicn, the City couldn`t pcssibly consider this connection of Fawn and Antler unless the streets were upgraded to withstand increased traffic. Ted Duicon commented if it came to a cllcice l;etween keeping Deerhaven the way it is or connecting to the Schertz Parkway, he world choose Deerhaven the way it is. Kenneth Floyd of 905 Antler expressed concern about future development behind Deerhaven, asking if there was any way scrleone could connect Deerhaven to Schertz Parkway prior tc anything being develu~ped. Mr. Floyd was assured b~= Chairman Andrews that could not occur - anything of that nature would have to come befcre Pia.rr~ing and Zoning first. fcr apprcval. There was farther discussicn cn the development of the land adjacent- tc Deerhaven, on what could be put in the Master Plan to try and prevent Deerhaven from being ccnnected to Schertz Parkway, and how to best serve both the interests of the City and the residents of Deerhaven. Chairman Andrews told those present the only one possible guarantee there is that Deerhaven won`t connect tc the Schertz Parkway is for the residents of Deerhaven to to buy the property and develop it themselves. Merwin Willman commented he agrees if this is, in fact, the consensus of the majority of the residents in Deerhaven. Chairman Andrews asked Chuck Sharpe if he is working with the Homeowners' Association and was informed he is not. Steve Simonson remarked he thought this was brought up at a meeting the residents of Deerhaven had with Councilman. Hal Baldwin. Chairman Andrews informed the Commission this item could be tabled until Chuck Sharpe takes a poll of alI the Deerhaven residents. Rufus Barnes of 1113 Antler stated that the City of Schertz had taken in Deerhaven, without warning., to increase their tax base, and then sometime later gone ahead and developed Savannah Square against the wishes of mangy= Deerhaven residents. Mr. Barnes said in his opinion the wishes of the Deerhaven residents have, over t3.~e years, been ignored by the City cf Schertz. A lady resident of Deerhaven spoke up at this point and said that rlany cf the residents of Greenfield Village and Oak Forest had also been opposed to the development of Savannah Square. ^~ary Marsh made a motion to approve the request from Chuck Sharpe to include in the Schertz Master Plan, for reasons of safeti=, a street of some kind to connect Antler and Fawn at the upper end. Merwin. E^~illman and Ty Brisgill both emphasized that it doesn`t solve anything now - they can't gc along with the motion on the grounds cf safety, and they both expressed a desire to see a better representation of Deerhaven residents and their wishes. - The motion died for lack of a second. Tom Jackson commented the residents could get up a petition. Chairman Andrews said the item could be tabled until a petition is brought to the Commission. Chuck Sharpe asked if this is going to be a precedent, because it is definitely setting a precedent. Mary Marsh asked how many homes are in .Deerhaven and Harry Richburg said he thought somewhere between 70 and ~0. Chairman Andrews noted that the Commission needs to consider if this request is in the best interest of the City ~f Schertz and if it would be best to include it i_ n the Master Plan or not to include- it. -6- _ Mary Marsh commented that approving Chuck Sharpe~'s recommendation on this would be voting. for the betterment of the City of Schertz. At the suggestion.of Chairman Andrews, Item #4 was tabled to give the Commission more time to research it, to think further about whether or not they wish to approve this request, and to have available some kind of documentation to use in determining the wishes of the majority of the residents of the Deerhaven Subdivision. At this time there .was a short break. CONSIDER AND TAKE APPROPRIATE ACTIONS Discussion on Possible Conversion of Schertz Modular Park from a Mobile Horse Park tc a Mobile Home Subdivision Don Decker was at the meeting to represent the Schertz Modular Park. Chairman Andrews asked if there ~ti*as any Staf:F input and St°ve Simonson replied t}-.ere was not. Dcn Decker infc_-med the Commission they had not bought the property yet, they don`t want tc ::until they know if the Commission will go along with what they a~°e sug;esting. Don Decker said the property is the Schertz ":odzzlar Park which is ~I behind Riedel's Trailer Park. It presently has 193 mobile home lets will; private streets, but the lets are :zct lcn:_,encugh for today's mobile homes. They wou ld s.ike to replat it and have either a PIID cr Ilor~ecwner's A.scciation ~.~ith privale?.y owned streets. Their plans include 147 lots at a minimum cf are °4' width and an 84' depth, front yard setbac}rs of 24', sideyard setbacks. of and rear yard setbacJrs cf 20'. Mr. Decker said they would like tc leave the 3' sidewa.ll~s there and noted they will provide off-street parl~ing cf two spaces por let. Dcn Docker commented Johnny Sierschwalc, Water/Wastewater Superintendent, warts a dedicated alley, but they can only give an easement, an alley would wipe cut the electrical easement. Mr. Decker e~plaired that cn each let shore is a sewer main and a water main, and between each street them are two sewer lines and two water lines, and in the middle is the telephone and the electric. Don Decker also mentioned that some of the lets are laid out for R.V.'s, and all the R.V. lets are in the flcodplain. He went an to say the City of Schertz requires certain provisions in a flcodplain such as the installation cf a flood warning system, and they have no objections to those required provisions. They would like to sell R.V. lots '(for example, tc people who come to Texas for 6 months out of the year? and those lots .would be maintained by the Homeowners' Association. Don Decker stated that Steve Simonson wants them to put in a 30' unimproved street providing a way out the back of the parts, and they will provide-that street. Joe Potempa asked where the entrance will be and D%n Decker replied it will be where it is today. Merwin Willman commented that a Mobile Home Subdivision should comply with the Subdivision Ordinance, and it's kind of hard to change a Mobile Home Park to a Mcbile Hame Subdivisicn because the streets are alz°eady there. Mary Marsh told Don Decker the Ccmmission needs to know what he already has, what ho wants, and what variances will be needed. Chairman Andrews wcndered if there is a way the park can be used and also meet the requirLments cf the Subdivision Ordinance. Mary Marsh remarked the Commissicn needs mcre information as to what Mr. Decker requires and what he can do to conform to the ordinance. Steve Simcnson pointed out that the Mcbile Home District also comes into play. Steve Simcnscn said they arc there frcm a pre-existing sign that broke that they= started tc repair, but nothing`s ever happened to it. Ty Brisgill asked if Woodland Oaks Drive in Greenshire Oaks Subdivision is under the City's jurisdiction and was informed it is. Mr. Brisgill said where they patched the rcad down by the bridge going tcward the model home, it is starting to crack. Money can be saved if they are in by August 31st. Chairman Andrews .recommended giving a count at the meeting on August 23rd of those who are planning on attc-ending. (b) The public hearing for MediPure is scheduled far August 16th. Mary Marsh said she is concerned about the L.:ublic being properly informed. Steve Simonson commented that Howard Jennings and Bob Nelson of MediPure had given a formal presertaticn to the Herald Life newspaper. Mervin Willman noted that the articles in the Herald Life newspaper on „TUly 28th and August 4th were both very good. (c) Passed out a letter he had composed asking the owners of Parlicaay Square, Lnit 1 to consider the completion cf Savannah Drive tc Schertz Parkway. Ty Brisgill asked who owns Parkway Square and was informed it is owned by Bexar Savings. Mr. Willman said I^.e is dust trying to get something started. If the letter is signed by tl:e Commission then it will be forwarded to City Council f:,r their consideration. (d) Asked Steve Simonson if he has written confirmation yet of the settling of the Parker Case and Mr. Simonscn replied he does not. (e) Asked what happens to construction plans that are submitted to the City. Steve Simonson said for individual homes, they are kept fcr a period of time and then thrown away; fcr subdivisions, . they have a.s-built pi.a.ns for struts, sewer and water and they are kept on file. (f ) Asked if anyone had questions on the new zoning map. Steve Simonscn pointed cut a little section of apprcxi.mately 1,OQ0` on L'M 151E that had not been annexed - it was an oversight. Mervin thTillman coririented that while doing research for the zoning map, it was discovered that some of the ordinances had not been cut even tl~,oagh a public hearing was held. Steve Simonson informed the Commission that the City attorney says we have to publish each ordinan~.e, we can do it all at cane time, but it has to be handled like we've not had a previous public hearing. ,Toe Pctempa asked Steve Simcnscr, if he knew anything about Salvage Enterprises changing hands and Mr. Simonson replied he had not heard anything. Keith Van Dine brought up tre following: (a) Asked if the 4' poles with yellow reflectors., at his gate where the read is eroded, is the way the City`s going.t.o correct that problem. Steve Simonscn said he would check into it, - _o_ (b) Someone is putting iri a mobile home on Pfeil Road up on a hillside - do they have permits. Steve Simonson said he will have the City Inspector check into it. (c) Asked if they're getting ready to put water in the_ Schirmerville area and Steve Simonson said yes, they should be seeing some steel on the tank pretty scen and the City crews will be putting in the water line. Chairman Andrews reported that he had called a Mr. Casper frcm the railroad about all the dirt under the FM 78 bridge and c~;as told they should have someone out to r~mcve it in approximately 2-3 weeks. Steve Simonson noted that I{im Potempa has finished the map cn the soils (she did an excellent job) and he will get it digitized and intc the Master Plan. Merwin Willman inquired as to the prcgress on the water tank in the Live Oak Road area and was told he should be seeing steel cn the tank ar~y day now. 8 AL'J©URILTMI;NT Chairman Andre-ws aujourned tho meeting 4t 8:44 P.M.
