02-13-1990 PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission convened in a regular
session on Tuesday, February 13, 1990 at 7:00 P.M. in the
Municipal Complex Conference Room, 1400 Schertz Parkway. Those
present were as follows:

#1 CALL TO ORDER
Chairman Brisgill called the meeting to order at 7:00 P.M.
#2 APPROVAL OF MINIITES: Public Hearing and Regular Session
January 23, 1990
Chairman Brisgill asked that on Page 10, Paragraph 3 (Item (b)
under George Vick) the word "tractor" be inserted after Transtar.
Merwin Willman made a motion to approve the minutes, as amended,
for the Public Hearing and Regular Session January 23, 1990. Bob
Andrews seconded the motion and the vote was unanimous in favor.
Motion carried.
#3 CITIZENS' INPQT OTHER THAN AGENDA ITEMS
There was none.
#4 CONSIDER AND MAKE RECOMMENDATION: Discussion on Update of '
Progress/Input to Comprehensive Plan
Steve Simonson informed the Commission he should have all the
input back from the various departments by the end of February
and thinks it will provide the Commission with a lot of valuable
information they need for the City Plan.
Chairman Brisgill inquired if this information would be ready to
present to the Commission by the March 13th meeting and Mr.
Simonson said possibly.
Bob Andrews commented that based on Steve Simonson's information,
it has been Mound that a lot of the old data is incorrect. Will
there be anything available from the Census Bureau? Mr. Simonson
replied no not yet. `
Steve Simonson related the Randolph Metrocom Chamber of Commerce
has put out a new map and also he is trying to find a demographic
source for income levels, ethnic percentages, etc.
Keith Van Dine remarked on. a form he had received to f ill out
about his employees and asked if -Steve Simonson would like a copy
of it, but it won't have ethnic percentages.
Bob Andrews asked what. the purpose is of all this information in
a City Plan. Steve Simonson replied it doesn't have to be in the
City Plan and then pointed out the five types of City Plans
recognized by most planners (these had been mentioned in his memo
to the Commission). They are: (1) Comprehensive Plans, (2)
Systems Plans, (3> Area Plans, (4> Plans for Subsystems and (5)
Site Plans.
Merwin Willman commented the purpose of salary ranges and ethnic
percentages is just for background information.
Steve Simonson told the Commission to ask themselves if the City
Plan is a document to attract business.
Bob Andrews said from what he is seein
provides brochures, pamphlets and packets withtinformationhneeded
to attract business. A City Plan covers things like where the
city is, where it is going and how it plans to get there.
Steve Simonson remarked that companies looking to locate in the
area want specific information.
Jim Shriver mentioned that Merwin Willman has a whole bag full of
City Plans from other cities.
Chairman Brisgill once again asked if the input would be ready to
give to the Commission sometime in March and Steve Simonson
replied he would like to take a look at it first after he gets it
to give him some idea of how long it will take him to prepare it
for submission to the Commission.

Jim Shriver
(a> Talked to a lady who operates a flea market at Bussey's and
she says many of the people who have booths there do not have
sales tax permits. (Steve Simonson said he will bring it to the
City's attention.)

Keith Van Dine noted it will be hard to enforce upon those who
are there. only on the weekends.
Chairman Brisgill wondered if there isn`t some kind. of handout
.available for these people to let them know the law.
Bob Andrews commented some of the people have .booths just for a
large garage sale.
Jim Shriver said he is in favor of getting as much revenue into
the City as possible.
(b) Doesn't wish to receive a copy of the agenda by mail.
(c) Regarding the Capital Improvements Plan, he doesn't
understand the material being presented by Rimrock Consulting.
When the time comes, does the Committee just rubber stamp the
proposal?
Merwin Willman asked if there's anyone else who doesn't
understand the material.
Chairman Brisgill said he understands the concept. We're
establishing fees for hook-up to water and sewer. It is not the
Committee's responsibility for projected figures - that's why
consultants have been hired.
Merwin Willman told the Commission he feels they should let City
Council know they're half way through the process and don't
understand it.
Bob Andrews said he realizes SB336 set up procedures which must
be documented, but in his opinion, a lot of the material
presented by the consultants is superfluous.
Steve Simonson explained they are looking at a ten year time
frame trying to project demands for the future, trying to
determine how much it will cost and also trying to establish a
plan for getting the money back in a way which is fair across the
board.
Jim Shriver asked if the Advisory Committee votes at the end and
Steve Simonson replied no, they make a recommendation to City
Council.
It was noted the public hearings have been scheduled for March
14th and May 1st.
Steve Simonson reminded the Commission they are not in this
process by themselves. There is also Ford Engineering and John
Bierschwale, and Mr. Bierschwale has direct input and is
protecting the City's interest.

Chairman Brisgill commented he. doesn't think the Committee needs
to know all the ins .and outs - that why the consultants have been
hired.
Bob Andrews noted that Rimrock Consulting is supposed to provide
the City with a computer disk at the end of this process so they
can see how it was done and can use it for future reference.
Merwin Willman asked Chairman Brisgill if he doesn't like to know
how someone comes. up with something before he makes a
recommendation on it. Mr: Brisgill replied it depends on what it
is.
Jim Shriver remarked that three months ago he had asked for a
copy of SB336 because he wants to see what the Advisory Committee
is supposed to do. (Steve Simonson said he will inform Tony
Bagwell of Mr. Shriver's request.)
Bob Andrews related the City has to document it's reasons for
charging a certain hook-up fee or capital recovery fee.
Chairman Brisgill asked Merwin Willman how the problem of
accepting the figures arrived at by Rimrock Consulting is any
different than accepting the ruling on an ordinance from the
legal department. Mr. Willman said it's a different situation.
. Chairman Brisgill then asked Merwin Willman what he wants Rimrock
Consulting to do and Mr. Willman replied to explain things
better.
Keith Van Dine indicated to Mr. Willman that if he doesn't
understand the concept, he can always vote against the
recommendation.
Chairman Brisgill suggested everyone write down specific
questions they want to ask Tony Bagwell on the 27th of February,
which is the next scheduled meeting with him.
There was more discussion on this same subject with Steve
Simonson suggesting that maybe he ask Ed Ford to give the
Committee a cover sheet for all the information distributed each
time and break it down into simpler terms.
The Commission felt this was a good idea and Bob Andrews thought
maybe it would be good to have Ed Ford outline other choices if
there are any.
Chairman Brisgill told the Commission to let Tony Bagwell know at
the next meeting they want things in simpler terms.
Steve Simonson said he will explain things to Ed Ford.
Keith Van Dine suggested making the cover letters retroactive.

Merwin Willman:
(a) It was brought up at the conference and he thinks it would be
nice for the Commission members to have a business card. tSteve
Simonson said to let him know and he will order them.)
Chairman Brisgill asked that discussion of this item be placed on
the next agenda.
fb) Regarding the proposed name change of Binz-Englemann Road to
Boenig Drive, recommended a synopsis of the history of the Boenig
family be written up and suggested it be done by Keith Van Dine.
(Mr. Van Dine said he would take care of it.)
(c) Received the manual "Dealing With Change In the Connecticut
River Valley" and it is filled with lots of very good
information. If the law on impact fees was written as well, then
maybe we could understand it. Mr. Willman said he was thinking
the Commission could use some of the information available in
this manual to update the Overlay Districts.
Mr. Willman said the manual shows eight different scenarios of
businesses along the Connecticut River (conventional development,
creative development, etc.).
Mr. Willman had written a letter (which he distributed) regarding
the revision of the Jack Hays Blvd. and Schertz Parkway Overlay
Districts and had included attachments which gave a brief
indication of what's covered in detail in the manual.
Mr. Willman wanted to know if the Commission thinks further study
and rewrite of the Overlay Districts is warranted and if so, does "
the Commission recommend his letter be forwarded to City Council
for their approval of such a study and rewrite.
Chairman Brisgill requested that this item be placed on the next
agenda.
(d) Noticed the APA is starting a new department (planning and
law) and individuals can join. Wondered if maybe Planning and
Zoning as a whole could join.
(e) In the Sign Ordinance, January 1, 1995 was listed as the date
for compliance. Has anything been done about getting the revised
Sign Ordinance out to all the businesses? (Steve Simonson
commented the mailing of a copy of the Sign Ordinance to all the
businesses could be budgeted in for the next fiscal year.)
Bob Andrews•
(a) Remarked that the Development Status Chart which he has to
look at every meeting is outdated. (Steve Simonson corrected Mr.
Andrews by saying the chart is current - Tri-County Units 2, 3,
and 4 haven't passed warranty inspections.)

Chairman Brisgill:
(a) Asked about the public hearing for the road name change and
was informed the property owners had not been sent letters yet.
(b) What about a. replacement for the ETJ representative on the
Advisory Board Committee? (Steve Simonson said it is up to City
Council.)
(c) Won`t be here for the meeting on February 27th.
Steve Simonson:
(1) Informed the Commission there`s a possibility of them having
a plat from Diamond Shamrock at the next meeting.
(2) Said there's someone interested in buying 10 acres of Kermit
Harborth's property. They will have to bring in the proper size
water and sewer lines to the property and provide a stub-out.
Mr. Simonson said he has informed them of what they need to do.
Right now they're just planning on building two private homes,
but he has a hunch it will eventually be an area for exclusive
homes.
Merwin Willman asked Mr. Simonson if he had heard anything
further from Edgar Von Scheele on his plans for building garden
homes. Mr. Simonson said he had not.
Keith Van Dine•
(a) Told the Commission someone is putting up a big billboard
across from Shady Acres. Do they have a permit? (Steve Simonson
said he will check on it.)

Chairman Brisgill adjourned the meeting at 8:15 P.M.
The next regularly scheduled meeting is February 27, 1990.
