02-27-1990 - PLANNING AND ZONING MINIITES = The Schertz Planning and Zoning Commission convened in a regular - session on Tuesday, February 27, 1990 at 7:00 P.M. in the Municipal Complex Conference Room, 1400 Schertz Parkway. Those present were as follows: PLANNING & ZONING-COMMISSION OTHERS PRESENT - JOE POTEMPA, VICE-CHAIRMAN KENNY VAUGHAN, KEITH VAN DINE, SECRETARY DIAMOND SHAMROCK MERWIN WILLMAN PAT GAUNT BOB ANDREWS DOT HARBORTH GEORGE VICK TOMMY ZIPP JIM SHRIVER MIKE DOMGARD KEN GREENWALD, COUNCILPERSON CRAIG HOLLMIG MEMBERS ABSENT CITY STAFF TY BRISGILL, CHAIRMAN STEVE SIMONSON, ASST. CITY MANAGER NORMA ALTHOUSE, RECORDING SECRETARY #1 CALL TO ORDER In the absence of Chairman Ty Brisgill, Vice-Chairman Joe Potempa called the meeting to order at 7:00 P.M. #2 APPROVAL OF MINIITES: Regular Session February 13, 1990 Bob Andrews made a motion to approve the minutes for the regular session February 13, 1990. Keith Van Dine seconded the motion and the vote was as follows: AYES: K. Van Dine, M. Willman, B. Andrews, G. Vick, J. Shriver NAYS: None ABSTENTIONS: J. Potempa Motion carried. #3 CITIZENS' INPIIT OTHER THAN AGENDA ITEMS There was none. #4 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Plat Approval - Oak Manor Estates, Unit One tPC #163-90) Tommy Zipp, Pat Gaunt, Mike Domgard, Dot Harborth and Craig Hollmig were at the meeting to represent this request. Vice-Chairman Potempa asked for Staff input. Steve Simonson commented there is no real problem with the plat. Mr. Simonson did say there are several things the City Engineer has recommended be included on the plat: {1) Show proposed sanitary sewer easement from outfall main near Jack Hays Blvd./Green Valley Rd. to Lots 1 and 2. {2) Indicate water line easement to service Lot 2. (3) Identify adjoining property owners by Deed, Volume & Page as recorded in the Guadalupe County Deed Records. {4) Certificate by Platting Engineer needs to be placed on plat. Mr. Simonson informed the Commission the 50' easement is not projected as a road at this time, just a driveway. There's a possibility it could connect, in the future, with the 50' stub- out of Golden Oak. It will be retained by Dr. and Mrs. Harborth, it is not part of the two lots on the plat. Tommy Zipp advised the intent is for a future road when the time comes, but at the present time they are not dividing any of the rest of the land. Mr. Zipp continued on saying Pat Gaunt and Mike Domgard have been looking for a place to build their homes and the homes they wish to build (approx. 5,000 square feet) command acreage sites. Merwin Willman mentioned he doesn't see how this could connect with the stub-out at Golden Oak. Tommy Zipp remarked it will wind around nicely to Golden Oak and said to keep in mind there's a lot of property between this driveway and the Golden Oak stub-out. Steve Simonson painted out the property on the map and showed how it will wind around to Golden Oak. Jim Shriver asked if the 50' easement will be a dirt road and Tommy Zipp replied no, it will be paved. Bob Andrews then asked if it's a single family residence that is proposed to be built on each tract and Tommy Zipp replied yes, that's correct. Merwin Willman brought up what he said was a minor detail - the name of the Subdivision. Mr. Willman said in the past they have tried to discourage anything with the word "Oak" in it because of there being so many streets with "Oak" as part of their name. Mr. Willman indicated it's confusing to the police, fire and ambulance people when the names are so similar. Tommy Zipp explained that one of the parties involved wanted "Oak" in the name and the other party wanted "Estates" and that's how Oak Manor Estates came to be. -2- Craig Hollmig asked Steve Simonson about the location of the sewer lines and Mr. Simonson suggested he call John Bierschwale, [Water/Wastewater Superintendent, to obtain that information. Mike Domgard told the-Commission they had conversed several times with John-Bierschwale and had pretty much decided to let the City put the utility lines where they want and he and-Pat Gaunt will pay the bill. In regard to the Benchmark used on the plat, Bob Andrews asked if it`s the same oak tree that gave the City trouble with Savannah Square. Steve Simonson replied he had spoken with Ed Ford, City Engineer, about that and Mr. Ford assured him there is no problem with the Benchmark. Bob Andrews also questioned the verbage on the plat about a "designated future street" and asked if the City will obligate anyone to that statement. Steve Simonson answered that the City will not do that because it is an easement, someone else's property. Jim Shriver asked when the homes are projected to be built and Pat Gaunt answered they plan to get started by the end of March. Bob Andrews made a motion to approve the preliminary plat for Oak Manor Estates, Unit One (PC #163-90) contingent upon the four items recommended by the City Engineer being added to the plat. Those four items are as follows: (1) Show proposed sanitary sewer easement from outfall main near Jack Hays Blvd./Green Valley Rd. to Lots 1 and 2. (2) Indicate water line easement to service Lot 2. (3) Identify adjoining property owners by Deed, Volume & Page as recorded in the Guadalupe County Deed Records. (4) Certificate by Platting Engineer needs to be placed on plat. Merwin Willman seconded the motion and the vote was unanimous in favor. Motion carried. After the vote, Steve Simonson informed Craig Hollmig he will send him a letter outlining the recommendations from the City Engineer and officially notifying him of approval by the Commission of the plat contingent upon those recommendations being included on the plat. -3- - _ #4b. CONSIDER AND MAKE RECOMMENDATION: Preliminary Plat Approval - Diamond Shamrock (PC #162-9D) Kenny Vaughan was at the meeting to repres=ent this request. - Vice-Chairman Potempa asked for Staff input. _ Steve Simonson informed the Commission Diamond Shamrock has paid the platting fees (so have Dr. and Mrs. Harborth for the previous - _ plat), the problem with the sewer line has been solved, they have the approved highway permits and the City Engineer recommends approval of the plat. Bob Andrews pointed out the flood plain statement needs to be on the plat. Steve Simonson noted that the Jack Hays Blvd. building setback is shown. Bob Andrews asked if it shows on the plat where the signs will be and was informed that doesn't have to be on the plat. George Vick made a motion to approve the Preliminary Plat for Diamond Shamrock at IH-35 and Jack Hays Blvd. tPC #162-90) contingent upon the flood plain statement being included on the plat. Keith Van Dine seconded the motion and the vote was unanimous in favor. Motion carried. #5 CONSIDER AND TAKE APPROPRIATE ACTION: Business Cards for Planning and Zoning Commissi-on Members Bob Andrews made a motion to recommend Steve Simonson order business cards for the Planning and Zoning Commission members. George Vick seconded the motion and the vote was unanimous in favor. Motion carried. Steve Simonson requested they show him what kind of business card they wanted and he will order them. Merwin Willman had a sample with him and the Commission agreed it was the one they wanted. #6 CONSIDER AND MAKE RECOMMENDATION: Possible Need for Revision of Jack Hays Blvd. and Schertz Parkway Overlay Districts Merwin Willman commented he had written up this letter and wanted the Commission's recommendation on forwarding it to City Council, but because of the mandate from City Council to review the Overlay Districts, the Commission needn't worry about forwarding this letter. George Vick asked some questions about the attachments to Merwin Willman's letter and Mr. Willman explained to him these were just _ -4- samples of different types of developments such as clustered development, creative development, standard development, etc. Bob Andrews made a recommendation the study and review of- the Overlay Districts not be on the agenda until after the SB336 Advisory Committee is finished with it's work. Steve Simonson reminded the Commission they are coming to the _ public hearing phase of the impact fees and things should move quickly after that. Mr. Simonson's suggestion was to place the study and review of the Overlay Districts on the agenda of the last meeting in March. Bob Andrews' motion died for lack of a second. In regard to the study, Mr. Simonson mentioned an idea he has had about signs and said maybe the Commission should negotiate with businesses when they want sign variances. For example, if a business wants additional height on their sign, then ask them in return to submit landscaping plans or a site plan so the Commission can see how they propose for their business to enhance the City. Merwin Willman commented people have talked about site plans for years, but he has never used one. Mr. Willman said he does think, however, it is something the Commission could use. Steve Simonson remarked that whether a site plan requirement is in the Ordinance or not, you can ask the developer to submit one. It was agreed to place the study and review of the Overlay Districts on the agenda of the last meeting in March. Vice- Chairman Potempa requested this be done. #7 GENERAL DISCQSSION Keith Van Dine• (a) Asked Steve Simonson if he checked on the billboard going up near Shady Acres and Mr. Simonson said yes he had, his answer was in his notes to the Commission. Jim Shriver• (a) Thanks for the copy of SB336. (b) Remarked there's a section in SB336 which states there should be an ETJ representative on the Advisory Board. (c) City Council approved a sign for. Payless at Jack Hays Blvd. and Borgfeld Rd. different than what was presented to the Commission. _ -5- - Merwin Willman noted it would be nice if the Commission could get a copy of what was approved. _ - Steve Simonson explained Payless was given approval for a pole sign with a 13'7" variance. - Bob Andrews -questioned if Payless had asked for something different from City Council than what they has asked for from the Planning anc~ Zoning Commission. Jim Shriver -said Council didn't like the Commission's recommendation and asked Payless to come back with a new proposal. Merwin Willman emphasized that if the Commission looks at anymore signs on Jack Hays Blvd., they better look at them very carefully. Councilperson Ken Greenwald indicated that what it boiled down to in the end was they wanted some things similar to what Tiger Tote has. George Vick: (1) Remarked on the new curb cut at Randolph and Aviation and asked Steve Simonson if someone can just indiscriminately put in a second curb cut. Steve Simonson replied a second curb cut has to be approved by the City Manager and this one has been approved. (2) Asked if nothing can be done about 18 wheelers parking in windy Meadow. There are now pot holes forming as a result of this parking. Steve Simonson replied he isn't sure what can be done. Mr. Simonson relayed to the Commission how people say to him "yo~z want me to move into your City, but I can't park my rig - this is my job, I drive a rig." George Vick pointed out there are facilities available which can be rented that are set up for the purpose of storing these vehicles. Steve Simonson said he will mention the problem again to the powers that be. Merwin Willman: (a) The Commission receives three publications each month, one of which is the "Zoning Bulletin". Is it of any real use to us? Do we need to continue receiving it? -5- _ - - Both Bob Andrews and Jim Shriver said they find this publication very interesting reading. The consensus of the Commission was to continue receiving the "Zoning Bulletin". (b) Is anyone going to the Community Profile Research session being offered by Texas Lutheran College? Jim Shriver replied he plans to attend. When asked if he plans to attend, Mr. Willman replied he is thinking about it. _ Councilperson Ken Greenwald: (a) March 10th at 10:00 A.M. will be the dedication of the new library addition. (b) Also March 10th, at 1:00 P.M. will be the closing ceremonies for the B.V.Y.A. basketball season and there will be a basketball game at 2:00 P.M. between the Board of Directors and the Coaches and Managers. A $1.00 donation out of each ticket sold will go to Alyssa Smith. Before the close of the meeting George Vick mentioned the conference on Tax Abatement which was held and said he thought it was very interesting. # $ ADJOIIRNNTENT Vice-Chairman Potempa adjourned the meeting at 7:55 P.M.
