" CONSIDER AND TAKE .APPROPRIATE ACTION: Final.Plat Approval Mims Subdivision (PC.#193-93) Greg Mims was at the meeting to represent this request. Chairman Andrews asked for Staff input. Steve Simonson reminded the Commission they now have the proof of purchase by Greg Mims in their packages and then advised he had spoken with Ed Ford, City Engineer, and Mr. Ford had suggested that since Old Nacogdoches will be widened some day, they obtain an additional 10' right-of-way in that little corner. Greg Mims indicated he has no .problem in dedicating that additional right-of-way. Steve. Simonson further stated he had spoken with BQb Leininger of Fisher Engineering about needing the owner's name and address on`the plat" and the identification, on the plat; of i adjacent ,landowners. by Volume and Page of Record. Chairman Andrews .asked for Staff input, Steve Simonson displayed a drawing showing the area they are requesting to be rezoned. Mr. Simonson .then `.explained how the area is. currently zoned. Starting at the corner .of FM 300.9 and Borgfeld Road,. if you follow Borgfeld Road,-there.-are large blocks on both sides of the current drainage ditch. zoned: R-4 (apartmentlmult~.-.family., .,dwelling) There is also..: a small: corner zoned ~ NS (neighborhood services). Down Dietz Road'; across from Dobie Middle School is an R-5 (garden home) area separated. by the gas easement which runs through the middle of the City. Next. to that, fronting Thistle Creek, there is an R-2 (single-family dwelling) area with another R-5 (garden home) area in between the-R-2 (single-family dwelling). Then at the corner of Dietz Road and Thistle Creek, coming up the drainage channel, there is an R-2 (single-family. dwelling) area. They are requesting that all of these areas be rezoned to R-6 (single-family dwelling). The Mischer Company is involved and they are the .parent :company of.Dov.er Homes.. They will also'be requesting two variances. Jim Box spoke at this- time saying he is pleased to be associated with the City of Schertz. The:-Mischer Corporation- has been in construction for almost. 40 years. They are not investors, they are developers and builders. -2- P ~ . . Mr. Box indicated they will be building homes in Dove Meadows similar to those they are building in Woodland Oaks. They will be requesting a variance to allow 5' side yard setbacks and a variance to allow ZO' front yard setbacks... There was then a bref'diseus.sion on easements with Jim Box. saying they normally split the easements between. lots ,with the ''fence line- down ~tMe middle of the.easement: ~ ` Chairman Andrews advised. that. in one of the City's. subdivisions the. easements .are not split,. they are. all on one lot. Jim Box... stated that is not a. problem if that's. what the City wants them to do. Mervin Willman. suggested the Commission discuss it before coming to a decision. David Richmond asked if a 2.0' setback.i_s a standard front yard - setback and was' told• it i~s riot,.. the standard is~ 25' - ' Mr: Richmond then asked what the front yard. setback .is i.n Woodland. .Oaks and Chairman Andrews. replied he would have. to check into,it. Merwin Willman made a motion to recommend approval to City Council of the request from Kerry R. Gilbert and Associates, on behalf of Wheatstone Development, to rezone 86.6 acres from R-2, R-4, R-5 and NS to R-6. It was also requested that a public hearing be scheduled. Ordinance, developers have to set aside so much .land for park facilities:- (in .this case. 4 acres) or donate. money in lieu of land.. The'two parks wial. not connect: Wheatstone. will. also take advantage of the:.drainage:ditch with.`' jogging paths, etc. and you will .see walkways.at the end of each cul-de-sac. They are also looking at some kind of : conveyance from one side of the ditch. to the .other.: The Staff feels this plan shows good utilization of the drainage: ditch and as ,a result, :.the: ditch :will ,be enhanced.;:. Mr. Simonson went on to say there is ample ingress/egress and if -you look.. at the inset~on the Master P.lan,_ it shows a greenbelt and landscaped area. This i the area where the City will talk to the,deyelopers about their entrance sign and some kind of buffer for .that .sorrier.... Th.e City .has agreed to put up: some kind of s.ignage to slow down traffic. -Keith Van Dine questioned if .the ditch has water. in it and kids get in it and something happens, ,will, the City, be: xespons3.ble,. _ Will :there' be :a `fence around the ditch? Steve: Simonson replied it is the City's drainage ditch, but there will be no fence. Mr. Simonson stressed that education about these drainage ditches is the best defense `to 'prevent accidents from happening. Steve Simonson then commented on the narrowness of Dietz Road and informed the Commission they will be getting an additional 10' right-of-way along Dietz Road so Cibolo and the County can do something with the road.. Keith Van Dine inquired if there is no differentiation between private and public park land donations as far as the ordinance requirements and-Steve Simonson replied there is not. George Vick asked_f the subdivision will have a pool 'arid' Jim- Box answered they will have a-pool and picnic facilities. -4- Chairman Andrews then asked Jim Box if Dove Meadows will have a mandatory homeowners association and was told they will. . (c) Hooking up Lookout Road with the.Tri=Courity Business Park .has. been .scratched, because: of. the. type. of: traffic it. ::would: generate through the business park. Chairman Andrews noted .that a smaller copy of-the .map. needs to be included in the Comprehensive Plan.. Steve .Simonson indicated` that. .will be done and that they also :need to mount the Master Map.. David. Richmond made a motion to ..approve the Master Street Plan Map. Keith Van Dine seconded the motion and the vote was unanimous in favor.` 'Motion carried. #8 CONSIDER AND MAKE :RECOMMENDATION: Review and Discussion of Side Yard Setbacks in Areas Zoned R-2 Chairman Andrews remarked he had `asked that this item be placed. on the agenda because of the number of requests we have had for variances to side-yard setbacks. Mr. Andrews wondered if the City is too lenient in granting variances or if the Zoning Ordinance is too strict and needs to be rewritten on this particular subject. Merwin Willman expressed the desire to know what variances were given to Woodland Oaks and to Savannah.Square. David Richmond explained that the City is losing aesthetics ...:when they allow. homes t.o be•built closer and closer to. the street. and closer and eloser'to -each other. He, personally; would- like to more. space between homes and homes with further setbacks. k' 4 a F• Mr. Richmond then stated he does not agree with giving; a blanket ...permission to the whole City on reduced setback requirements.. Willman then asked i.f the City .should stal allow carports in an R-2 area, Mr. Wi1l.man went on to say that when AviationHeights was upgraded during Urban Renewal they :dis.covexed .the ,Gars . were too. big for ~~th~ existing garages; ° so carports,were.approved:.. , Davd:Richmond.observed if there's no need for it, then why not eliminate the permitting of .carports in R-2 areas. There was discussion on .this .with Steve Simonson pointing out there area lot of carports out there now and if the permission for carports is stopped, there will be a' lot of variance requests.. , .From a Sta:f f . point. of :..view, ~cargarts are : na:.problem , and there have been no citizen complaints.. Greenwald related to-the Commission that his . wife had visited the HEB:i.n Uniw.ersal.City and experienced ..a ,problem. tnlh.en .she went back to the store, they gave -her a complaint form to fill gout _(he did it. for her) a,nd so they . mentioned it -would be nice to.see a store-in .Schertz. Mr. Greenwald: .said , his`. wife..did receive .a reply-from- HEB saying ..they°were.planning to build a store in Schertz. (b) Noted; in regard to the walkways in Dove Meadows, there's a `little touch of property .between the cul-de=sac and the property line. Who owns it? Steve Simonson replied their property will go- up to our right=of-way and the homeowners association is responsible for maintaining the walkways. (c} Related Councilman Joe Potempa is very interested in the street lights. that were. removed by .CPS in the Schirmerville area.
