PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission convened in regular
session on Tuesday, January 25, 1994 at 7:00 p.m. in the
Municipal Complex Conference Room, 1400 Schertz Parkway,
'Schertz, Texas. Those present were as follows:

#1 CALL TO ORDER
Chairman Andrews called the meeting to order at 7:00 P.M.
#2 APPROVAL OF MINUTES: Public Hearing and Regular Session
January 11, 1994
Merwin Willman made a motion to approve the minutes, as
written, for the Public Hearing and Regular Session January 11,
1994. George Vick seconded the motion and the vote was
unanimous in favor. Motion carried.
#3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS
There was none.
#4 CONSIDER AND MAKE RECOMMENDATION: Request from Earl
Mayfield for. a Specific Use Permit Allowing
Him to Place a Home in an Area Zoned M-1,
Light Manufacturing
Earl Mayfield was at the meeting to represent this request.
Chairman Andrews advised this is the Kitty Hawk Ultralight
Flying Field at FM 3009 and IH-35 and Mr. Mayfield would like
to place a house there for security reasons.
Earl Mayfield corrected Mr. Andrews saying it is located off
FM 2252 behind Garden Ridge Pottery. Mr. Mayfield indicated
he wants to build a house there, approximately 200 feet south
of the barns,- and understands he has to get a Specific Use
Permit to do that.
Chairman Andrews .asked ..Steve Simonson if there's any .Staff
input. Mr. Simonson.rela'ted the Staff has looked.` over the
request. and as he explained in his notes to the Commission,
this is an isolated area with some vandalism problems. Where
Mr. Mayfield is planning to build will not effect flight
operations in the area, so the Staff recommends approval.
George Vick asked Mr. Mayfield if this will be his residence
and was told it will be.
Chairman Andrews then questioned how close it is to tie into
water and if there's any sewer at all. Mr. Mayfield replied
he has~a water well, but there's no sewer.
Chairman Andrews asked Earl~Mayfield about the possibility of a
septic system and Mr. Mayfield indicated that's what he
plans to use.
Mr. Mayfield then inquired of Steve Simonson when sewer will
be available in the area and Mr. Simonson replied it will be a
while yet. They have done some engineering studies of the
whole area and are doing cost estimates now on how to phase
that sewer in.
Mr. Simonson assured the Commission that Earl Mayfield has
plenty of area, .according to State requirements, for a septic
system.
Tony Moreno wondered if 'we require a replat to show a
single-family residence and Steve Simonson answered no because
Mr. Mayfield is not subdividing his property. All he's doing
is putting a residence on an existing piece of land.
Mr. Moreno commented, thus the requirement for the Specific
Use Permit.
Steve- Simonson stated it's called for in the Zoning Ordinance
under the M-1 Schedule of Uses and went on to say this could,
technically, be called a caretaker's cottage.
Merwin Willman pointed out that in Appendix A of :the Zoning
Ordinance you will find i:t's listed as an accessory building
under residential M-1 and requires a Specific Use Permit.
Chairman Andrews then remarked-that when-the property is sold,
.the new owner will have to renew the Specific Use Permit.
Steve. Simonson indicated that's incorrect because this is not a
non-conforming use. Mr. .Simonson did state .they couldn't,
..however, expand by building other single-family .residences.

Merwin Willman stated that City Council. will have to have a
public hearing and added that a Specific Use Permit is good for
six (6) months.
.Chairman Andrews asked Earl Mayfield when he plans to start
construction and Mr. Mayfield: replied probably within six
months. Mr. Andrews then instructed Earl Mayfield if the
.Specific Use Permit is approved, he would have six months from
the date. of approval to start construction.
George Vick made a motion to recommend to City Council, per
Article XXIV, Section 1.1 of the Zoning Ordinance, approval of
Earl Mayfield's request for a Specific Use Permit and to ask
that it be scheduled for a public: hearing.
Tony Moreno seconded the motion and the vote was unanimous in
favor. Motion carried.
After the vote, Earl Mayfield asked if the time can be amended
to one year and was told by Chairman Andrews, that if he hadn't
started construction within six months, then he would need to
ask for an extension to the Specific Use Permit at the end of
the six months.
#5 GENERAL DISCUSSION
David Richmond:
Admitted he would be interested to learn what Steve Simonson
knows about the Laredo group that bought the rest of
Greenshire.
Mr. Simonson acknowledged he hadn't heard any specifics. They
are dealing with MBC Engineers in San Antonio who, after a
meeting with him last year, are aware of how the Commission
wants Greenshire to be developed.
.Keith Van Dine:
(a) Apologized for being a couple minutes late.
(b) Related that after the last meeting when he was speaking
with a policeman who discovered he lived on Pfeil Road, the
policeman asked him when they're going to fix that road.'
Steve Simonson informed Mr. Van Dine the engineers have been
told to crank that one up as soon as possible. The City's been
held up on a project that was going to be a top priority in
Mobile Villa under a grant. Mr. Simonson estimated there
should be a survey crew out on Pfeil Road sometime in late
February or early March.

.Mentioned, as a point of curiosity, something he heard about
TXDoT and grants they give smaller cities for road work.
Steve Simonson commented the federal government pays 80$ of
road construction costs. and the State is responsible for the
other 20~. Now there's a proposal that cities be responsible
for 20~ up front and the State will pay them back when the job
is completed.
Referring to FM 3009, Mr. Simonson said the City had to move:.
all the water lines and sewer lines and acquire all the
right-of-way before construction even started and it cost
between $250,000 and $300,000. If they would have had to put
20~ of the construction fee up front, the roadwork would never
have started.
Mr. Moreno observed that the requirement for 20~ up front .will
certainly hinder a lot of communities.
Steve Simonson, explaining he may have misled the Commission
somewhat, said the State is still saying that on State roads
and Farm to Market roads they will pay the 20~ up front. It's
on what they call "off-system" roads (Lower Seguin, Schertz
Parkway) that they require the cities to pay 20~ up front.
Mr. Moreno asked if this new regulation is binding right now
and Steve Simonson replied yes. it is.
Going back to FM 3009, Councilman Greenwald explained what
happened with TXDoT. When it was learned some water and sewer
lines had to be moved, the City arranged to do the work in
house.' That was agreeable with TXDoT. Then, for some reason,
they set a time limit to have the work done, so the City had to
contract some of the work in order to meet the deadline. Less
than a week after the City let the bids and awarded the
contracts for some of the work, they were informed by TXDoT
construction couldn't start for another six months.
Pia Jarman•
(a) Mentioned that since the Commission reviewed the checklists
at the last meeting, she thought vandalism should have been
'listed as one. of the reasons for requesting a Specific Use
Permit on Earl Mayfield's application. Steve Simonson agreed.
(b) Noted that when the Commission discussed the fact Planning
and Zoning should have articles iri the Newsletter, she .wondered
if it was fair to have Steve Simonson do it. Mrs. Jarman-
volunteered to write some of the articles, but indicated only
if she gets input from the other Commissioners.

Told the Commission he should have a proposal on private
streets for their comments .and review a~ the next meeting.
Georcte Vick
Spoke of an article in the Express-News on January 14th about a
third urban corridor being designated on Fredericksburg Road.
San Antonio applied a sign ordinance to a 1.2 mile stretch of
-that road. The article also stated that San Antonio City
Council approved paying an annual dues of $50,000 to the
Greater San Antonio Corridor Council.

Reminded the Commission that Spring Clean-Up this year will be
from February 27th through March 13th. There will be an
article in the Newsletter.
Chairman Andrews:
Asked if the City has heard anything on Woodland Oaks Unit 5.
Is it dead? Steve Simonson replied it's not dead, the bond
will be coming in when they get a little farther along. The
engineering for the drainage has been approved, but nothing is
moving on it at this time. Mr. Simonson added that it appears
Cal-Texx is still looking to build in the area.

Chairman Andrews adjourned the meeting 'at 7:30 p.m.
The next regularly scheduled meeting is February 11, 1994.
