12-08-09 MINUTES REGULAR MEETING December 8, 2009 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on December 8, 2009 at 6:30 p.m:, in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to-wit: Mayor Hal Baldwin Mayor Pro-Tem Jim Fowler Councilmember David Scagliola Councilmember John Trayhan Staff Present: City Manager Don Taylor Assistant City Manager John Bierschwale Assistant City Manager David Harris City Attorney Michael Spain City Secretary Brenda Dennis Councilmember Carpenter absent CALL TO ORDER REGULAR MEETING Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Mayor Pro-Tem Fowler gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. Mayor Baldwin recognized Commissioner Jim Wolverton who was in the audience this evening. Oath of Office A. Mayor Pro-Tem -Consideration and/or action regarding the appointment of the Mayor Pro-Tem, term expired December 1, 2009. Mayor Baldwin to administer oath (David Scagliola) Mayor Baldwin administered the Oath of Office to newly appointed Mayor Pro-Tem Scagliola. Mayor Pro-Tem Scagliola acknowledged his wife Maria who was in the audience this evening. HEARING OF RESIDENTS • Mr. Steve Layton, 12231 Lost Meadows Drive spoke regarding issues in Crescent Bend Nature Park, which include off road traffic and littering. Discussion and/or Action Items 12-08-09 Minutes 1. Minutes -Consideration and/or action regarding the approval of the minutes of the Regular Meeting of December 1, 2009. Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Councilmember Trayhan to approve the minutes of the regular meeting of December 1, 2009. Vote was unanimous. Motion CaNried. 2. Annexation - Conduct a public hearing by the City Council of the City of Schertz, Texas Relating to the Annexation of approximately 186.55± acres known as Crescent Bend Park, located North of Schaefer Road and East of the Lost Meadows Subdivision. (D. Harris/M. Sanchez) Mayor Baldwin recognized Development Services Director Michelle Sanchez who introduced this item stating that the property to be annexed is approximately 186 acres, and the operation of the annexed area, which is Crescent Bend Park, will be governed by an Interlocal Agreement with Bexar County. The City agreed with Bexar County that it will annex Crescent Bend Park, and on October 27, 2009, the City Council began the annexation process. The City Council must conduct two public hearings on the annexation: the first public hearing was held on December 1, and this is the second required public hearing. Ms Sanchez mentioned in recent research two additional lots were found and that these lots would be brought forward under a separate annexation item at a future date at the recommendation of the City Attorney. Mayor Baldwin opened the public hearing and recognized the following citizens who spoke: • Steve Layton, 12231 Lost Meadows Drive As no one else spoke, Mayor Baldwin closed the public hearing. 3. Annexation - Conduct a Public Hearing by the City Council of the City of Schertz, Texas relating to the Annexation of the Cibolo Creek Municipal Authority properties of approximately 310.04± acres located West of and adjacent to Crescent Bend Park and West Lost Meadows Subdivision and North of Schaefer Road. (D. Harris/M. Sanchez) Mayor Baldwin recognized Development Services Director Michelle Sanchez who introduced this item stating that the property to be annexed is approximately 310 acres belonging to CCMA. COMA has requested this annexation. On October 27, 2009, the City Council began the annexation process. The City Council must conduct two public hearings on the annexation: the first public hearing was held on December 1, and this is the second required public hearing. Mayor Baldwin recognized newly elected Mayor Pro-Tem Scagliola who stated he attended the following: • Ribbon cutting in Selma at GreenLink Tech.com Wednesday, December 2, 2009 and the Festival of Angels event Friday, December 4, 2009. Mayor Baldwin recognized Councilmember Trayhan who stated he attended the following: • Festival of Angels event Friday, December 4, 2009 and thanked everyone involved for the success of the event.
