REGULAR MEETING
March 16, 2010
A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on
March 16, 2010 at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Building #4, Schertz, Texas. The following members present to-wit:

Councilmember Jim Fowler Councilmember John Trayhan

CALL TO ORDER REGULAR MEETING
Mayor Baldwin called the meeting to order at 6:35 p.m.
INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE
UNITED STATES AND STATE OF TEXAS.
Councilmember Fowler gave the invocation followed by the Pledges of Allegiance to the
Flags of the United States and State of Texas.
HEARING OF RESIDENTS
No one spoke.
Discussion and/or Action Items
1. Minutes -Consideration and/or action regarding the approval of the minutes of the
Regular Meeting of March 09, 2010.
Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by
Councilmember Fowler to approve the minutes of the Regular Meeting of March 9,
2010. Vote was unanimous. Motion Carried.
2. Ordinance No. 10-M-04 -Consideration and/or action approving an ordinance
establishing the time and place of City Council meetings; providing an effective date;
and repealing all ordinances or parts of ordinances in conflict with this ordinance. (M.
Spain) Final Reading
Mayor Baldwin recognized City Attorney Michael Spain who introduced this item
stating that there have been no changes since first reading. Mr. Spain stated that
action requested of Council establishes the time and place of City Council meetings
to reflect current practice and recommends approval.

Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Mayor
Pro-Tem Scagliola to approve final reading of Ordinance No. 10-M-04. Vote was
unanimous. Motion Carried.
3. Ordinance No. 10-S-OS - ZC-2010-001 Ashton Senior Village -Zone from NS
to R-4 -Consideration and/or action on a request to rezone approximately 10.637
acres of land from Neighborhood Services District (NS) to Apartment/Multi-
Family District (R-4)_. The property is more specifically described as a portion of
the Genobera Malpaz Survey No. 67; Abstract No. 221, generally located 458
feet east of the intersection of Borgfeld Road and FM 3009 (Roy Richard Dr.)

Mayor Baldwin recognized Development Services Director Michelle Sanchez who
introduced this item stating that there have been no changes since first reading. Ms.
Sanchez stated that action requested by Council rezones approximately 10.637 acres
of land from Neighborhood Services District (NS) to Apartment/Multi-Family
District (R-4). Ms. Sanchez reminded Council that the Planning and Zoning
Commission voted at their February 24, 2010 meeting to approve the rezoning for
only a senior multi-family development. It was also stipulated that after two (2) years
if funding cannot be secured and the senior housing development is not constructed
the zoning would revert back to its original Neighborhood Services District (NS).
Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by
Mayor Pro-Tem Scagliola to approve Ordinance No. 10-S-OS final reading. Vote was
unanimous. Motion Carried.
4. Resolution No. 10-R-11 - Consideration and/or action authorizing an
Intergovernmental Cooperative Agreement with Bexar County to upgrade water
system lines along Hillbrook Drive and tie into Schertz municipal water system. (D.
Harris)
Mayor Baldwin recognized Assistant City Manager David Harris who introduced
this item stating that action requested of Council allows the City to enter into an
Intergovernmental Cooperative Agreement with Bexar County for the CDBG
funding of a waterline serving the Hillbrook subdivision. Mr. Harris stated the cost
of the project is $200,000, which is funded by Bexar County CDBG. Staff
recommends approval. Mr. Harris answered questions from Council.
Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by
Councilmember Fowler to approve Resolution No. 10-R-11. Vote was unanimous.
Motion Carried.
5. Resolution No. 10-R-12 -Consideration and/or action approving a resolution
amending exhibit A to the Non-Consensual Towing Agreement with Roadrunner
Towing approving a minimal rate increase. (S. Starr)

Mayor Baldwin recognized Police Chief Steve Starr who introduced this item
stating that action requested of Council increases rates with Roadrunner Towing for
light-duty vehicles from $85 to $125 and police rates for towing light-duty vehicles
from $65 to $85 when requested by the City. The City receives $10 per light-duty
vehicle towed according to the agreement with Roadrunner Towing. Roadrunner
Towing has requested this increase. Chief Starr stated that no other fees will be
affected and recommends approval.
Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Mayor
Pro-Tem Scagliola to approve Resolution No. 10-R-12. Vote was unanimous.
Motion Carried.
Mayor Baldwin adjourned into executive session at 6:50 p.m.
EXECUTIVE SESSION
Called under Section 551.071 Texas Government Code Litigation, pending litigation;
Section 551.072 Texas Government Code - Deliberation regarding the purchase,
exchange, sale, lease, or value of real property and Section 551.087 Deliberation
regarding Economic Development Negotiations.
Mayor Baldwin reconvened into regular session at 7:45 p.m.

Mayor Baldwin recognized Mayor Pro-Tem Scagliola who stated he attended ti
the Schertz Chamber luncheon, which Assistant Economic Development
Director Jeff Jewell was the guest speaker. Mayor Pro-Tem Scagliola stated
Mr. Jewell gave an excellent program.
Mayor Pro-Tem Scagliola mentioned the upcoming Doggie Dash May 22, 2010
and that all proceeds will go toward the Schertz Humane Society.
Mayor Baldwin recognized Councilmember Fowler who stated that he recently
walked the ditch behind Marilyn Drive and concurs with the City Engineer that
the area needs to dry out before any equipment could get in there to resolve the
drainage issues.
10. Announcements by City Manager

Mayor Baldwin recognized Assistant City Manager David Harris who reminded Council
of the March 23, 2010 Joint Worksession with Council and the Planning and Zoning
Commission to discuss the City's Strategic Goals. Mr. Harris mentioned that it will be
held at the Schertz Civic Center from 4:00 p.m. to 6:00 p.m., and after the Worksession,
the Council will go over to the Council Chambers for their regular meeting.
Mayor Baldwin recognized City Attorney Michael Spain who stated that the Planning
and Zoning Commission met and will be forwarding the UDC revisions to the City
Council at the March 23, 2010 City Council meeting for approval. He stated that they
would be providing a compilation of the changes and that if the Council is happy with the
changes, then they would bring back an Ordinance at the following meeting.
Mayor Baldwin recognized City Engineer Larry Dublin who provided the following
updates:
• Met with Mr. John Lougher, 2505 Cabana Drive who lives in the Mobil Villa
Estates and that Lowe's has covered all his expenses and thanked the City for all
their assistance.
• Chelsea Road is open
• Sign at Wiederstein and Schertz Parkway has been removed once again.
• The YMCA had a pre open house and tour this past weekend and that over 3000
attended the opening. He stated that YMCA signed up 300 people that weekend.
• Met with the Mesa Oaks Developer and the two home builders and they have an
agreement and plan as well as a timeline for resolving the issues and that they are
moving forward.

Mayor Baldwin recognized Councilmember Fowler who provided information to Mr.
Dublin regarding a pothole around the manhole on Columbia Drive. Mr. Dublin
stated that he would have someone go out this week to address the problem.
