04-13-10MINUTES REGULAR MEETING April 13, 2010 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on April 13, 2010 at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to-wit: Mayor Hal Baldwin Councilmember Jim Fowler Councilmember Michael Carpenter Mayor Pro-Tem David Scagliola Councilmember John Trayhan Staff Present: City Manager Don Taylor Assistant City Manager John Bierschwale Deputy City Secretary Mary Ybarra CALL TO ORDER REGULAR MEETING Assistant City Manager David Harris City Attorney Michael Spain Mayor Baldwin called the meeting to order at 6:33 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Councilmember Fowler gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. PRESENTATIONS • Presentation/Discussion Schertz Sweetheart Court -Fiesta Medal Presentation (E. Matlock) Mayor Baldwin recognized Erin Matlock EDC Specialist who introduced the Schertz Sweetheart Court (Miss Liberty, Sarah Corder, Miss Friendly City, Julianne Royce and Miss Tri-County, Erin Harvey) who presented Council with a Fiesta Medal officially opening Fiesta. The medal was actually designed by Miss Tri-County and Miss Schertz. The Sweetheart Court is participating in the Castle Hills Parade this Saturday and invited everyone to join them. Mayor Baldwin recognized Boy Scout Troop 462 who was in the audience. HEARING OF RESIDENTS Mayor Baldwin recognized Robert Brockman, 1000 Elbel who spoke on the following: • Schertz Tales article regarding tree trimming, grass cutting, and triangle visibility at certain corners. • Pickrell Park wrought iron fencing encroaching into traffic visibility. 04-13-2010 Minutes • Kramer House maintenance.... there is no dumpster on the premises. Who maintains the facility? • There are three dead trees at the new Library; does the City have warranty on replacements, and if they do, City should take advantage of the warranty. • City owned lot between playscape and Dollar General is in need of mowing. Discussion and/or Action Items 1. Minutes -Consideration and/or action regarding the approval of the minutes of the Regular Meeting of April 6, 2010. Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Mayor Pro-Tem Scagliola to approve the minutes of the Regular Meeting of April 6, 2010. Vote was unanimous. Motion Carried. 2. Ordinance No. 10-5-06 -Consideration and/or action approving an ordinance regarding the revised UDC. Final reading (M. Sanchez/M. Spain) Mayor Baldwin recognized Development Services Director Michelle Sanchez who introduced this item stating that final revisions have been made as well as, a few clarifications to tables in Section 21, by City Engineers. There were no other changes to report. Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by Mayor Pro-Tem Scagliola to approve Ordinance No. 10-5-06. Final reading. Vote was unanimous. Motion Carried. 3. Annexation - Conduct a second Public Hearing relating to the annexation of approximately 4.676± acres known as Lots 1 and 2, Block 3, Lost Meadows Subdivision, Unit 2, county block SOSSc, Bexar County, Texas, located at 12046 and 12066 Lost Meadows Road. (M. Spain/M. Sanchez) Mayor Baldwin recognized Development Services Director Michelle Sanchez who introduced this item stating that since the first public hearing of Apri16, 2010 there were no changes to report. Mayor Baldwin opened the public hearing for public comment. As no one spoke, Mayor Baldwin closed the public hearing at 6:43 p.m. Action on first reading of annexation ordinance will take place at Council meeting of May 11, 2010. BOARDS/COMMISSIONS 4. Appointments/ Reappointments to Boards and Commissions/Committees - Consideration and/or action regarding appointments/reappointments to Boards and Commission/Committees. 04-13-2010 Minutes Page - 2 - • Appointment of: Justin Murray as regular member, Christian Glombik as alternate 1, and Timothy "Jake" Jacobs as alternate 2, to the Planning and Zoning Commission. Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by Mayor Pro-Tem Scagliola to appoint Justin Murray as a regular member, Christian Glombik as alternate 1, and Timothy "Jake" Jacobs as alternate 2, to the Planning and Zoning Commission. Vote was unanimous. Motion Carried. Mayor Baldwin adjourned into executive session at 6:50 p.m. EXECUTIVE SESSION Called under Section 551.071 Texas Government Code Litigation, pending litigation; Section 551.072 Texas Government Code - Deliberation regarding the purchase, exchange, sale, lease, or value of real property and Section 551.074 -Deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of the City Manager. Mayor Baldwin reconvened into regular session at 7:28 p.m. RECONVENE TO REGULAR SESSION 5. Take any action deemed necessary as a result of the Executive Session. Mayor Baldwin stated that the only action necessary on Council's behalf after evaluating the City Manager is to announce that Council is extremely pleased with City Manager Don Taylor's performance and have asked him to remain with the City for another year, and Mr. Taylor has accepted. Requests and Announcements 6. Requests by Mayor and Councilmembers that items be placed on a future City Council agenda. Mayor Baldwin recognized Councilmember Fowler who asked that staff research traffic on Morning Drive. Has received calls from concerned citizens regarding traffic going to fast and the possibility of a petition from citizens is forthcoming. He asked that the City Engineer look into the completion date of Morning Drive, and that possibly this issue should go to TSAC for review. He asked for action to take place and findings reported possibly at the next meeting. 7. Requests by Mayor and Councilmembers to City Manager and Staff for information. No requests given. 8. Announcements by Mayor and Councilmembers 04-13-2010 Minutes Page - 3 - • City and community events attended and to be attended • City Council Committee and Liaison Assignments (see assignments below) • Continuing education events attended and to be attended • Recognition of actions by City employees • Recognition of actions by community volunteers • Upcoming City Council agenda items Mayor Baldwin recognized Mayor Pro-Tem Scagliola who spoke on the following: • Thanked the Savannah HOA for hosting meet the candidate night. • TML Region 8 dinner is this Thursday as well as the Genesis Painting for Schertz Area Artz Council opening. • Saturday, Guadalupe County Gardner's (Annex Building on Elbel) will be working at their garden plot, raising beds and placing irrigation. Mayor Baldwin invited anyone interested in attending Northeast Partnership, Thursday at 11:30 am. Joe Strauss is speaker at the meeting. 9. Announcements by City Manager • Recognition of City employee actions • New Departmental initiatives Mayor Baldwin recognized City Manager Don Taylor who announced that effective immediately, Mr. George Antuna has been appointed Director of a new department, Intergovernmental Relations, and that Mr. Jeff Jewell has been promoted to Director of Economic Development. Mayor Baldwin recognized Assistant City Manager David Harris who stated that Thursday, April 15, TML Region 8 has a legal Q&A session starting at 4 pm, reception 6 pm, and dinner at 7 pm, Henry R. Munoz is the speaker for the evening. Mayor Baldwin recognized City Attorney Michael Spain who congratulated both Mr. George Antuna and Jeff Jewell.
