REGULAR MEETING
May 4, 2010
A Regular Meeting was held by the Schertz Ci±y Council of the City of Schertz, Texas, on
May 4, 2010 at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Building #4, Schertz, Texas. The following members present to-wit:

CALL TO ORDER REGULAR MEETING
Mayor Baldwin called the meeting to order at 6:30 p.m.
INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE
UNITED STATES AND STATE OF TEXAS.
Councilmember Carpenter gave the invocation followed by the Pledges of Allegiance to
the Flags of the United States and State of Texas.
PRESENTATIONS
• Proclamation National Law Enforcement week.
Mayor Baldwin read and presented the proclamation to Police Chief Steve Starr.
HEARING OF RESIDENTS
Mayor Baldwin recognized the following:
• Robert Brockman, 1000 Elbel Road who addressed the Council regarding visibility
triangle at Aero and Oak. City Manager Don Taylor stated that staff is working to
resolve the problem.
Discussion and/or Action Items
1. Minutes -Consideration and/or action regarding the approval of the minutes of the
Regular Meeting of Apri127, 2010.

Mayor Baldwin recognized Mayor Pro-Tem Scagliola who moved, seconded by
Councilmember Trayhan to approve the minutes of the Regular Meeting of April 27,
2010. Vote was unanimous. Motion Carried.
Mayor Pro-Tem Scagliola asked that the Power Point Presentation on the City
Projects be placed on the website.
2. Construction Equipment Purchase (Public Works) -Consideration and/or action
authorizing the purchase of Public Works Construction Equipment. (L. Dublin/J.
Bierschwale)
Mayor Baldwin recognized City Engineer Larry Dublin who introduced this item
answering questions from Council. Mr. Dublin stated that action requested of
Council approves purchase of an Asphalt Zipper, Vibratory Sheep Foot Compactor
and Pneumatic Roller to enhance the ability of the Public Works Department to
perform roadway rehabilitation. Fiscal impact of $239,609 for all equipment to be
paid for from the 2009 bond sale.
Mayor Baldwin recognized Mayor Pro-Tem Scagliola who moved, seconded by
Councilmember Carpenter to approve the purchase of an Asphalt Zipper, Vibratory
Sheep Foot Compactor and Pneumatic Roller not to exceed $240,000 contingent upon
approval by the city attorney if bond money can be used. Vote was unanimous.
Motion Carried.
3. Resolution No. 10-R-22 -Consideration and/or action approving a Resolution by
the City Council of the City of Schertz, Texas accepting certain land from San.
Antonio into the Extraterritorial Jurisdiction of the City of Schertz, and related
matters. (M. Spain)
Mayor Baldwin recognized City Attorney Michael Spain who introduced this item
answering questions from Council. Mr. Spain stated the land north of IH-10 and
between FM 1518 and FM 2538 was recently released from San Antonio's
extraterritorial jurisdiction ("ETJ") by action of the San Antonio City Council. The
Schertz City Manager's office would like Council to take official action to accept
the released land into Schertz's ETJ. Michael Spain provided an updated map of
the area.
Mr. Spain stated that action from Council accepts the land north of IH-10 and
between FM 1518, Cibolo Creek and Lower Seguin Road that was recently released
from San Antonio's ETJ by action of the San Antonio City Council and places the
land into Schertz's ETJ.
Mayor Baldwin recognized Mayor Pro-Tem Scagliola who moved, seconded by
Councilmember Trayhan to approve Resolution No. 10-R-22. Vote was unanimous.
Motion Carried.
4. Resolution No. 10-R-23 -Consideration and/or action approving a Resolution
relating to the annexation of approximately 415 acres located immediately North

of Interstate Highway 10 and between FM 1518 and Trainer Hale Road all in Bexar
County Texas, as described and authorizing and directing the holding of public
hearings for the proposed annexation, the publication of notice of those public
hearings, preparation by the Planning Department of a service plan, giving of a
written notice of intent to annex, giving of written notice of the availability of a
Development Agreement, the submission of preclearance materials to the Department
of Justice, and related matters. (M. Spain)
Mayor Baldwin recognized City Attorney Michael Spain who introduced this item
stating that approval of the resolution begins the process to annex an area of land
north of IH-10 between FM 1518 and Trainer Hale Road from Schertz ETJ into
Schertz City Limits. Michael Spain provided an updated map of the area.
Mr. Spain further stated the City would collect city taxes on the property after
annexation is complete, and the City will be responsible for providing City services
to the property after annexation. Mr. Spain discussed the development agreement
process with the Council answering questions.
Mayor Baldwin recognized Councilmember Carpenter who moved, seconded by
Councilmember Trayhan to approve Resolution No. 10-R-23. Vote was unanimous.
Motion Carried.
Council did not meet in executive session.
EXECUTIVE SESSION
Called under Section 551.071 Texas Government Code Litigation, pending litigation;
Section 551.072 Texas Government Code - Deliberation regarding the purchase,
exchange, sale, lease, or value of real property.
5. Take any action deemed necessary as a result of the Executive Session.
No action taken as the Council did not meet.

6. Requests by Mayor and Councilmembers that items be placed on a future City

Mayor Baldwin recognized Mayor Pro-Tem Scagliola who asked that information
be placed on the electronic signs regarding the Hot Meals Program informing the
public that they serve lunch on Monday, Wednesday and Fridays.

Mayor Baldwin recognized Mayor Pro-Tem Scagliola who stated he attended the
following:
• Thursday, Apri129th attended a Yoga Class at the YMCA
• Friday, April 30~' attended the EDC Business Appreciation Banquet and Dinner and
gave kudos to those involved in making it a great success.
• Saturday, May ls` attended the Wine Festival in New Braunsfels
Mayor Baldwin recognized Ken Greenwald, .Chair of the Schertz Seguin Local
Government Corporation who came forward stating he just got back from the Seguin
Council meeting where they unanimously approved the SSLGC Bond Sale.
Mayor Baldwin recognized Harry Hewlett who stated that on June 5, 2010 from 3 to 10:00
p.m. a fundraiser is being held for two-year old cancer victim Reid Smith. It will be held at
Pickrell Park in the large Pavilion. Mr. Hewlett stated that they have received an
overwhelming response. The June 5, 2010 Schertz fundraiser includes food, fun,
entertainment and a silent auction and is sponsored by Schertz Professional Firefighters
Association local 4083, Schertz Christian Academy and friends and family of the Reids.
Mayor Baldwin recognized Councilmember Carpenter who gave kudos to all for running
an exemplary, clean campaign and stated that everyone has set the bar high in showing the
communities around us that when the City of Schertz runs an election, we run it like ladies
and gentlemen. Councilmember Carpenter wished everyone good luck in the upcoming
election and stated that regardless of the outcome he will be proud to serve. Mayor
Baldwin stated that he appreciated Councilmember Carpenters comments and also wished
him well.
Mayor Baldwin announced that today is George Antuna's birthday. Mayor and Council
wished Mr. Antuna a happy 42°d birthday.

Mayor Baldwin recognized Assistant City Manager David Harris who stated that today he
and Sam Willoughby attended Bexar County Commissioners Court and they approved an
agreement with us to provide water services to Hillbrook Lane off of Schaffer Road.

Mayor Baldwin recognized City Engineer Larry Dublin who stated that as of today the
YMCA has over 1400 members and in April over 10,000 visited the facility.
