September 20, 2005
The Schertz City Council convened in a Regular Session on Tuesday, September 20,
2005, at 7:00 p. m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway,
Schertz, Texas. The following members were present: Mayor Hal Baldwin, presiding
Council Members Carl Douglas, John Trayhan, Reginna Agee, Tony Wilenchik and
Michael Carpenter. Also present were City Manager Don E. Taylor, Assistant City
Manager John Bierschwale, Deputy City Secretary Mary Ybarra and City Secretary Judy
Tokar.
Mayor Baldwin called the meeting to order at 7:00 p.m.
#1 INTRODUCTION AND APPOINTMENT OF CITY SECRETARY
Mayor Baldwin introduced to the Council and the audience Judy Tokar. He gave a brief
history of Ms. Tokar's background in city government and welcomed her to Schertz.
Council member Douglas made a motion, seconded by Council member Trayhan, to
appoint Judy Tokar as City Secretary.

#2 Consider and take action on reappointment of Deputy City Secretary.
Council member Wilenchik made a motion, seconded by Mayor Pro Tem Agee, to
reappoint Mary Ybarra as Deputy City Secretary.

#3 HEARING OF RESIDENTS:
Robert Brockman: 1000 Elbel Road asked the status of the moratorium on Live
Oak Hills Subdivision and what could be done to regular the overflow items left outside
of the collection boxes located at the Smoke Pit and the Dollar Store.
#4 APPROVAL OF MINUTIES: Workshop Session-August 10, 2005
Regular Session-August 16, 2005
Council member Douglas made the following corrections to August 10~' work session
minutes, Council member Wilenchik was not in attendance at the meeting as reported,
agenda item #2,#3, #7 and #8 of the record vote, delete Wilenchik's name, and agenda
item #2 and #3 add Agee's name. Agenda Item #6, paragraph 4 replace ADD for PUD.
The August 16~` minute correction is the spelling of Mr. Brockman's name...

the workshop minutes of August 10, 2005 and Regular Session minutes of August 16,
2005 as corrected.

#5 ORDINANCE: Consider and take action on emergency reading of
Ordinance regarding the budget for FY 2005/2006.
Mayor Baldwin introduced an Ordinance and read the caption as follows:

AN ORDINANCE PROVIDING FUNDS FOR THE FISCAL YEAR
BEGINNING OCTOBER 1, 2005 AND ENDING SEPTEMBER 30,
2006, BY APPROVING THE BUDGET FOR SAID PERIOD AND
APPROPRIATING THE NECESSARY FUNDS OUT OF THE
GENERAL AND OTHER REVENUES OF THE CITY OF
SCHERTZ, TEXA5, FOR SAID YEAR FOR THE MAINTENANCE
AND OPERATION OF THE VARIOUS DEPARTMENTS AND
FOR VARIOUS ACTIVITIES AND IlVIPROVEMENTS OF THE
CITY; AND DECLARING AN EMERGENCY.
Council member Douglas made a motion, seconded by Council member John Trayhan, to
approve an ordinance to provide funds for the Fiscal Year beginning October 1, 2005 and
ending September 30, 2006, by approving the budget for said period in the amount of
$26,450.067.00 and appropriating necessary funds out of the General fund and other
revenues of the City of Schertz, Texas, for said year for the Maintenance and Operation
of the various departments and for various activities and improvements of the City; and
declaring an emergency.

#6 ORDINANCE: Consider and take action on emergency reading of
Ordinance regarding the tag rate for FY 2005/2006.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
ORDINANCE No. 05-T-43
AN ORDINANCE LEVYING AND ASSESSING ALL
TAXABLE PROPERTY WITHIN THE CORPORATE
LIMITS OF THE CITY OF SCHERTZ, TEXAS, FOR THE
YEAR 2006; PROVIDING THE BASIS OF ASSESSMENT OF
ONE HUNDRED PERCENT (100%) APPRAISED VALUE AND

PROVIDING FOR THE COLLECTION THEREOF AT THE
RATE OF 0.3977 ON THE ONE HUNDRED DOLLAR ($100.00)
ASSESSED VALUATION; AND DECLARING AN EMERGENCY.
Council member Wilenchik made a motion to set the increased property tax rate of
$0.3765 equivalent to last year's rate. There was nothing in the charter that he could find
prohibited the City from operating with a deficient budget. At the end of this fiscal year
there should be a return to the general balance of $150,000 to $500,000. Council member
Wilenchik did not recommend to increase the tax rate to the citizens up front and then
return money to the fund balance at the end of the year.
Motion failed for lack of second.
Council member Trayhan made a motion, seconded by Council member Douglas, to
adopt an ordinance levying and assessing all taxable property within the corporate
limits of the City of Schertz, Texas, for the Year 2006; providing the basis of
assessment of one hundred percent (100%) appraised value and providing for the
collection thereof at the rate of 0.3977, Maintenance and Operation $.03005 and Interest
and Sinking $0.0972, on one hundred dollar ($100.00) assessed valuation; and the
adopted tax rate will raise more taxes for maintenance and operations than last year's tax
rate. The tax rate will raise for maintenance and operations on a $100,000 home by
approximately $11.60. ,

#7 ORDINANCE: Consider and take action on final reading of Ordinance
creating the Schertz Youth Commission.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
ORDINANCE NO.OS-M-44
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS CREATING THE SCHERTZ YOUTH COMMISSION
AND RESOLVING OTHER MATTERS IN CONNECTION
THEREWITH.
Ashley Mayle, senior at Incarnate Word High School explained that this was a
commission that works with city government to help the youth and to provide the youth a
voice in matters that affect them in the community. She thought the City of Schertz
would be a good place to bring this concept.
Mayor Haldwin said commission consists of 13 members, two representatives appointed
by each City Councilmember and three by the Mayor. The Commission meets once a
month or as required to discuss issues and concerns that affect the City's youth.

approve the creation of the Schertz Youth Commission.

#8 ORDINANCE: Consider and take action on final reading of Ordinance
authorizing Ealing of an affidavit of City Manager concerning Randolph Air
Force Base Air Installation Compatible Use.

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AUTHORIZING FILING OF AN AFFIDAVIT OF
CITY MANAGER CONCERING RANDOLPH AIR FORCE BASE AIR
INSTALLATION COMPATIBLE USE ZONE
Mayor Pro Tem Agee made a motion, seconded by Council member Douglas, to approve
an ordinance on final reading authorizing filing of an affidavit of City Manager
concerning Randolph Air Force Base Air Installation Compatible Use.

#9 ORDINANCE: Consider and take action on first reading of Ordinance
revising Chapter 18, Section 18-32, Stop Intersections.
City Manager Don Taylor stated that ordinance was pulled by the City Attorney to be
placed on the next agenda.
#10 ORDINANCE: Consider and take action on emergency reading of
Ordinance adopting the National Incident Management System (NIMS).
Mayor Baldwin introduced the ordinance and read the following caption:

AN ORDINANCE ADOPTING THE NATIONAL INCIDENT
MANAGEMENT SYSTEM (l~tIMS) AS THE STANDARD FOR
INCIDENT MANAGEMENT BY THE CITY OF SCHERTZ; AND
DECLARING AN EMERGENCY.
Mayor Pro Tem Agee made a motion, seconded by Council member Trayhan, to adopt
the National Incident Management System (NIMS) as the standard for incident
management of the City of Schertz, and declaring an emergency.

#11 Consider and take action honoring Steve Simonson by naming a city facility.

Council member Wilenchik made a motion, seconded by Council member Douglas, to
dedicate the City Hall Building in honor of Steve Simonson for his service as an long
time employee and member of City Council.

A bronze plaque with his picture and inscription will be placed at the entrance to the
building. There will be special ceremony to commemorate the dedication of the building
to Mr. Simonson as soon as possible because of his failing health.
#Z2 Discussion and possible action regarding filtering, plant piping for the
expansion of the Schertz/Seguin Local Government Corporation.
Assistant City Manager Bierschwale said at the meeting last Thursday with the
Schertz/Seguin Corporation he was told there was a deadline to order immediately the
high-pressure filters that treat the water or it will cost the project an additional
$39,595.00. The City of Schertz is guaranteeing the purchase of the filters for the
Corporation. The City has collected through the water and wastewater impact fees a total
of $3.8 million since 1986 and there is a reserve of $1.6 million in the water fund. There
is plenty of water but the problem is treating the water. Mr. Bierschwale is requesting the
Council allocate up to $800,000.00 to purchase the filters and expansion of the plant.
Mr. Camp explained to the Council that the present filters are at capacity to treat the
water and there is no reserve in case of failure or repair and the plant may be unable to
meet the demand next summer when new units are added. It takes 16 to 22 weeks
delivery if ordered now and the filters will be ready to be on line by July 20, 2006.
Council member Wilenchik made a motion, seconded by Council member Trayhan, to
release impact fees and other necessary funds to support the purchase of material needed
for the expansion of the Schertz/Seguin Local Government Corporation plant piping in
time to meet the September 25, 2005 deadline and be reimbursed either by the City of
Seguin or the Schertz/Seguin Water Corporation.

• Mr. Taylor thanked the city employees for volunteering their time on the
"Party in the Park" for Steve Simonson ALS Foundation. He was very
proud of everyone for their hard good toward this cause.

September 23 - 28, 2005.
