07-20-10MINUTES REGULAR MEETING July 20, 2010 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on July 20, 2010 at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to-wit: Mayor Hal Baldwin Councilmember Jim Fowler Mayor Pro-Tem Cedric Edwards Councilmember David Scagliola Councilmember Michael Carpenter absent Staff Present: City Manager Don Taylor Assistant City Manager David Harris Assistant City Manager John Bierschwale City Secretary Brenda Dennis CALL TO ORDER REGULAR MEETING Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Councilmember Fowler gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. NEW EMPLOYEE INTRODUCTIONS/PROMOTIONS • Animal Services (G. Douglas) Mayor Baldwin recognized Parks & Recreation Director George Logan who introduced the following: Zack Douglas who recently was promoted to Animal Services Manager and Matt Burdick new Animal Services Officer. Mayor Baldwin recognized Finance Director Juan Santoya who introduced new employee Financial Budget Analyst, James Walters. Mayor Baldwin recognized Library Director Gail Douglas who introduced her new employees: Julio Machado and Jennifer Fisher new Library Clerks. Mayor Baldwin and Councilmembers welcomed the new employees and congratulated Zack on his promotion. HEARING OF RESIDENTS Mayor Baldwin recognized the following: 07-20-2010 Minutes • Mr. Steve White, 805 Main Street, who spoke regarding his concerns on proposing the bond election before the economy has had the opportunity to come back. Discussion and/or Action Items 1. Blue Ribbon Committee Report -Presentation and discussion regarding the Blue Ribbon Committee Report and consideration and/or action calling a November 2, 2010 Special Joint Bond Election. (J. Bierschwale/B. Bailey} Mayor Baldwin recognized Assistant City Manager John Bierschwale and Public Affairs Director Brad Bailey who introduced this item stating Schertz City Council approved the establishment of a Blue Ribbon Committee, whose purpose was to discuss the possibility of having a bond election on the November 2010 ballot. The first meeting was held on January 13, 2010 and the Committee has had four regular and two subcommittee meetings since the original meeting. The Committee decided upon four bond propositions to be put on a community input bond questionnaire, which took place from June 1St -June 30th, 2010. Based on the results of that questionnaire, it was determined in a subcommittee meeting that the bonds be regrouped and submitted to the Schertz City Council as six bond propositions: • Proposition I ~ $6.625 million for an 8-Lane Competition Pool /Aquatic Facility and relocation of and improvements to Schertz Playscape. Increase in taxes if your home is valued at $100,000 is: $22.31 annually and $1.86 monthly. Your property taxes will be based.on the value of your home. • Proposition 2 ~ $6 million for Athletic /Recreational Sports Fields, Parking and restrooms at the Schertz Ballpark and Maske Road Soccer Complex. Increase in taxes if your home is valued at $100,000 is: $20.21 annually and $1.68 monthly. Your property taxes will be based on the value of your home. • Proposition 3 ~ $2.25 million for the renovation of the 5,400 sq. ft. Schertz Animal Services Facility and the construction of a modern 12,000 sq. ft. adoption space, vaccination facility, acid dog park. Increase ire taxes if your home is valued at $100,000 is: $7.58 annually and $0.63 monthly. Your property taxes will be based on the value of your home. • Proposition 4 ~ $1 million for improvements to jumpstart downtown revitalization on or near FM 78 and Main Street. Increase in taxes if your home is valued at $100,000 is: $3.37 annually and $0.28 monthly. Your property taxes will be based on the value of your home. • Proposition 5 ~ $1.45 million for development of a Fine Arts and History Center to serve as an educational and instructional facility for artists and residents of all ages and arepository/museum of historical items from Schertz's past. Increase in taxes if your home is valued at $100,000 is: $4.88 annually and $0.41 monthly. Your property taxes will be based on the value of your home. 07-20-2010 Minutes Page - 2 - • Proposition 6 ~ $5.1 million for the purchase of land and construction of a 58,000 ... sq. ft. state-of--the-art Open Air Event Facility that can accommodate 5,000 people and be the new home of SchertzFest, 4t'' of July Jubilee, .and other large-scale events. Increase in taxes if your home is valued at $100,000 is: $17.18 annually and $1.43 monthly. Your property taxes will be based on the value of your home. Mr. Bierschwale stated at the July 14, 2010 general meeting, the Committee agreed with the subcommittee recommendations and to send to Council. Staff recommends Council approval of the six propositions brought forth by the Blue Ribbon Committee and call for a bond election on the November 2010 ballot. The par amount of the six propositions totals $22,425 million and assuming all are approved, there would be a $75.53 increase in taxes if your home were valued at $100,000. Mayor Baldwin recognized Mr. Ryan Cunningham with Southwest Securities who came forward explaining the impact of the bond election answering questions from Council. He stated that depending upon the taxable values at the time of the bond sales would dictate how many projects could be done at a time, as well as explaining that most bond packages are spread out over a couple of years. Mayor Baldwin and Council voiced their views on the proposed bond election answering questions, and as it was the consensus, the Council decided to take these items to the voters in November. Mayor Baldwin recognized Mayor Pro-Tem Edwards who moved, seconded by Councilmember Fowler to take the bond issue to the voters and bring an Ordinance to Council for consideration. Vote was unanimous. Motion Carried. 2. Minutes -Consideration and/or action regarding the approval of the minutes of the Regular Meeting of July 13, 2010. Mayor Baldwin recognized Mayor Pro-Tem Edwards who moved, seconded by Councilmember Scagliola to approve the minutes of the Regular Meeting of July 13, 2010. Vote was unanimous. Motion Carried. 3. Ordinance No. 10-A-20 -Consideration and/or action approving an ordinance regarding annexation of approximately 183 +/- acres located immediately north of Interstate Highway 10 and between FM 1518 and Trainer Hale Road, all in Bexar County Texas. Final reading (M. Sanchez) Mayor Baldwin recognized Development Services Director Michelle Sanchez who introduced this item stating that nothing has changed since the first reading and recommends approval. Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Mayor Pro-Tem Edwards to approve Ordinance No. 10-A-20 final reading. Vote was unanimous. Motion Carried. 07-20-2010 Minutes Page - 3 - 4. Resolution No. 10-R-37 -Consideration and/or action approving a resolution authorizing a Public Library Interlocal Agreement with the City of Selma. (G. Douglas/M. Uhlhorn) Mayor Baldwin recognized Assistant City Manager David Harris and Library Director Gail Douglas who introduced this item stating that staff recommends the City enter into an Interlocal Agreement with the City of Selma to permit the citizens of Selma to utilize the City's library facilities for two fiscal years, from October 1, 2010 through September 30, 2012. The City will collect a fee based upon Selma's 5,800 population of $3.32 per capita or approximately $19,256 in FY 2010-11. Staff recommends approval. Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by Mayor Pro-Tem Edwards to approve Resolution No. 10-R-37. Vote was unanimous. Motion Carried. 5. Resolution No. 10-R-38 -Consideration and/or action approving a resolution approving creation of Comal County Water Improvement District No. 2 in a portion of the City's corporate boundaries and its extraterritorial jurisdiction, and other matters in connection therewith. (D. Taylor/J. Bierschwale) Mayor Baldwin recognized Assistant City Manager John Bierschwale who introduced this item stating that Comal County Water Improvement District No. 2 contains approximately 2,040 acres, approximately 16 acres of which are in the City's corporate boundaries (as a result of the Schwab Road/F.M. 482 Area annexation), and 71 acres of which are in the City's ETJ. The balance of the district is in New Braunfels' ETJ. He stated that action requested of Council approves the acres within the City's corporate boundaries and its ETJ to be included with the District. He stated that this is the quarry owned by the Word Company that the new Comal County Water Improvement District No. 2 wants to fill up in the future into a lake, which could be used as a possible water source. Mayor Baldwin stated his concerns on allowing other water districts into our community and us as a city not being able to do anything about it when we start annexing areas out there and someone else gets their water sales. Mayor Baldwin stated that the 16 acres in our city limits could possibly be developed in the future and he wants to make sure that the City of Schertz would have the CCN rights (or rights to sell water). Mr. Bierschwale stated that he would have our City Attorney explain our concerns to Comal County Water District and bring this item back to Council at a later date. 6. Bid Award - 10-PW-25-S-03 -Consideration and/or action awarding a bid to ACT Pipe & Supply for water line improvements for the Hillbrook waterline project in the amount of $54,364.86. (L. Dublin) Mayor Baldwin recognized City Engineer Larry Dublin who introduced this item stating that Bexar County is funding the installation of an eight-inch waterline with services and fire hydrants in the Hillbrook subdivision as per County-City inter- 07-20-2010 Minutes Page - 4 - local agreement. The City of Schertz is using water capital recovery funds to .._ upgrade the eight-inch waterline to a twelve-inch waterline in preparation of connecting a future twelve-inch waterline on Schaefer Road to an existing twelve- inch waterline on Ray Corbett Drive. He stated the City is paying the incremental cost to oversize the line. Fiscal impact will consist of Bexar County funding $34,634 and the City of Schertz Water Capital Recovery Fund $19,731 for a total project cost of $54,365. The Engineering/Public Works Departments received three bids for materials only for the Hillbrook Waterline Project. City engineer reviewed the bids and recommends ACT Pipe & Supply in the amount of $54,364.86. Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Councilmember Scagliola to award the bid for the Hillbrook waterline project to ACT Pipe & Supply in the amount of $54,364.86. Vote was unanimous. Motion Carried. 7. Schertz Seguin Local Government Corporation (SSLGC) Fiscal Year 2010- 2011 Annual Budget -Consideration and/or action approving the SSLGC Fiscal Year 2010-2011 Annual Budget. (A. Cockerell) Mayor Baldwin recognized General Manager Alan Cockerell of the Schertz-Seguin Local Government Corporation who introduced this item stating a proposed annual budget for the period commencing October 1, 2010 and ending September 30, 2011 has been prepared by the Schertz-Seguin Local Government Corporation (SSLGC) General Manager and City of Seguin Director of Finance. Mr. Cockerell stated that Resolution #SSLGC R10-04 was approved on July 15, 2010. It is the desire of SSLGC to have this budget for FY 2010-2011 approved by the City of Schertz City Council. Action requested of Council approves the proposed SSLGC annual budget for the period commencing October 1, 2010 and ending September 20, 2011. Mr. Cockerell stated the SSLGC FY 2010-11 budget is set at $4,192,174. Mayor Baldwin recognized SSLGC's President Mr. Ken Greenwald who was in the audience. Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by Mayor Pro-tem Edwards to approve SSLGC's FY 2010-11 budget. Vote was unanimous. Motion Carried. 8. Schertz Seguin Local Government Corporation (SSLGC) Management Services Agreement -Consideration and/or action approving a Management Services Agreement with Schertz Seguin Local Government Corporation. (A. Cockerell) Mayor Baldwin recognized General Manager Alan Cockerell of the Schertz-Seguin Local Government Corporation who introduced this item stating Schertz-Seguin Local Government Corporation's (SSLGC) Management Services Agreement with the City of Schertz will be expiring. Mr. Cockerell stated that SSLGC's Resolution 07-20-2010 Minutes Page - 5 - #SSLGC R-10-07 was approved on July 15, 2010. Action requested of Council approves the renewal of SSLGC's Management Services Agreement with the City of Schertz for FY 2010-11. Mayor Baldwin recognized Mayor Pro-Tem Edwards who moved, seconded by Councilmember Fowler to approve the Management Services Agreement with SSLGC and the City of Schertz. Vote was unanimous: Motion Carried. 9. Schertz Seguin Local Government Corporation (SSLGC) Fiscal Year 2010- 2011 Water Rates -Consideration and/or action approving the Fiscal Year 2010- 2011 SSLGC proposed water rates. (A. Cockerell) Mayor Baldwin recognized General Manager Alan Cockerell of the Schertz-Seguin Local Government Corporation who introduced this item stating the proposed water rates for the period commencing October 1, 2010 and ending September 30, 2011 have been prepared by the Schertz-Seguin Local Government Corporation (SSLGC). SSLGC has adopted a revenue requirement system using the AWWA cash basis of ratemaking and adopted a minimum debt coverage ratio requirement of 1.25 or greater. Action requested of Council .approves the SSLGC proposed water rates for the period commencing October 1, 2010 and ending September 31, 2011. It is the desire of SSLGC to have these water rates for FY 2010-2011 approved by the City of Schertz City Council. Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by Mayor Pro-Tem Edwards to approve SSLGC's Fiscal Year 2010-2011 Water Rates. Vote was unanimous. Motion Carried. Requests and Announcements 10. Requests by Mayor and Councilmembers that items be placed on a future City Council agenda. No Nequests given. 11. Requests by Mayor and Councilmembers to City Manager and Staff for information. Mayor Baldwin requested that the City Engineer provide an update on the construction of the drainage in Mesa Oaks Subdivision. Assistant City Manager John Bierschwale stated that the engineering is complete and the contractor is ready to go to work and waiting for the Gutierrez Family to sign the agreement. City Engineer Larry Dublin briefly explained how the drainage from that area would flow. Mayor Baldwin recognized Councilmember Fowler who asked about the speed hump on Morning Drive and why there was only one. City Engineer Larry Dublin stated that as the ordinance, stated based on the traffic count information, and the 07-20-2010 Minutes Page - 6 - petition received by the homeowners of the area that is where the speed hump or controlled speed device was placed. 12. Announcements by Mayor and Councilmembers • City and community events attended and to be attended • City Council Committee and Liaison Assignments (see assignments below) • Continuing education events attended and to be attended • Recognition of actions by City employees • Recognition of actions by community volunteers • Upcoming City Council agenda items Mayor Baldwin recognized Mayor Pro-Tem Edwards stated he attended the Civic Leaders Reunion Tour at Randolph Air Force Base with Colonel Murphy and the 12th Squadron. Mr. Edwards stated that Randolph has a new remotely piloted aircraft program that was amazing. He stated that it is imperative that we embrace the 5th generation fighter squadrons. Mayor Pro-Tem Edwards also publically thanked the Police Department for assisting Ms. Sandy Goodrich with her concerns of speeders in her subdivision. Mayor Pro-Tem Edwards publically recognized Mr. Joe Safoya who was in the audience and showed a photo of Mr. Safoya who had a problem and went into action to take care of it. Mayor and Council thanked Mr. Safoya. Mayor Baldwin recognized Councilmember Fowler who stated that he would be in Tyler Wednesday through Friday attending the Texas Economic Development Council meeting. He also stated he attended the Schertz Chamber of Commerce meeting today. Mayor Baldwin recognized Councilmember Scagliola who stated he attended the following: • Thursday, July 15th Ribbon Cutting at the Mathnasium • Thursday, July 15th Area Artz Council • Tuesday, July 20th Schertz Chamber of Commerce Councilmember Scagliola announced that Thursday, July 22"d at 10:30 a.m. in the Administrative Conference Room the Animal Services Committee would be meeting to discuss puppy mills. He also reminded everyone that Thursday July 29th the Civic Center is hosting the Culinary Carnival. 12.
