1996M9-LANDSCAPING REQUIREMENTS ORDINANCE NO. tjtr 1'1- q AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY ADDING SECTIONS 10-130, 10-131,10-132, 10-133 and 10-134, LANDSCAPING REQUIREMENTS; PROVIDING AN EFFECTIVE DATE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I THAT Chapter 10 of the Code of Ordinances, City of Schertz, Texas be amended to read as follows: "Sec. 10-130. New landscaping turf requirement. In order to provide low water requirement turf, all new landscaping turf installed or planted in connection with building permits issued after June 1, 1996 shall be either buffalo grass, blue grama, zoysia, or bermuda. Sec. 10-131. Consideration of other requirement turf. low water Other low water requirement turf products will be considered and may be approved by a designated City official or body on a case-by-case basis. Sec. 10-132. Necessity for low water requirement turf. This requirement for specific types of turf is adopted to encourage conservation practices under the Drought Management Plan of the City. Sec. 10-133. Certain property excluded. This requirement shall not prohibit the installation or planting of any turf not described in Sec. 10-130 (a "non-conforming turf") if at least 50% of the non-impervious cover area of the lot or parcel is already planted in a non-conforming turf and the same non-conforming turf is being installed or planted. Sec. 10-134. Effective Date. The effective date of this requirement shall be June 1, 1996." SECTION II Any person violating any prov1s1on of this Ordinance shall be guilty of a misdemeanor and upon conviction shall be fined an amount not exceeding two hundred dollars ($200.00) SECTION III Should any portion or part of this Ordinance be held for any reason invalid, unconstitutional, or unenforceable, the same shall not be construed to affect any other valid portion hereof, but all valid portions hereof shall remain in full force and effect. SECTION IV The Council hereby determines that an emergency exists requiring immediate action, and this Ordinance is hereby passed as an emergency measure to be effective immediately upon its passage, and the enactment of this Ordinance as an emergency measure in accordance with the provisions of Section 4.09(e) of the City's Home Rule Charter will contribute to the preservation of the public peace, health or safety.
