1996M3-LIMITING CARRYING WEAPONS ORDINANCE NO. Ph-/'!- 3 AN ORDINANCE LIMITING THE CARRYING OF WEAPONS ON THE PREMISES OF THE CITY OF SCHERTZ; PROVIDING FOR ENFORCEMENT; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY FOR VIOLATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, to protect the public health, safety, and welfare, the City Council of the City deems it necessary to institute certain regulations concerning the carrying of weapons on City premises. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: Section 1. Except as set forth in Section 2, no person may carry any club, firearm, or illegal knife (as such terms are defined in Section 46.01, Texas Penal Code, as amended) on any City property, including City owned, operated, or maintained buildings and easements and parking areas appurtenant thereto, or other properties of the City. Section 2. This Ordinance shall not regulate (a) the carrying of weapons by members of the Schertz Police Department or other local, state, or federal law enforcement personnel who are otherwise permitted by law to carry such weapons; (h) the carrying of concealed handguns in City parks by persons who hold valid licenses under Article 44l3(2gee), Texas Revised Civil Statutes Annotated (the "Act"), except to the extent that the rights of such persons to carry concealed handguns may be limited by other laws of the State of Texas, including but not limited to the Texas Alcoholic Beverage Code; or (c) the carrying of weapons on the public streets of the City, which shall be regulated by applicable laws of the State of Texas, Section 3, The City Manager is directed to place appropriate signs on City property in accordance with this Ordinance, the Act, and other applicable laws of the State of Texas. Section 4. Should any portion or part of this Ordinance be held for any reason invalid, unconstitutional, or unenforceable, the same shall not be construed to affect any other valid portion hereof, but all valid portions hereof shall remain in full force and effect. Section 5, Any person violating any provision of this Ordinance shall be guilty of a misdemeanor and upon conviction shall be fined an amount not exceeding two hundred dollars ($200), Section 6, This Ordinance shall be effective from and after its final passage and any publication required by the City Charter.
