AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
AMENDING THE CODE OF ORDINANCES TO PROVIDE AN ALTERNATIVE
TO A FILING FEE FOR CITY ELECTIVE OFFICE AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, section 9.02 of the city Charter of the City of
Schertz provides that a filing fee of $5.00, or such other amount
as may be set by the city Council, must be paid to the City
secretary by each candidate upon presentation of an application to
be placed on the ballot;
WHEREAS, the Texas Election Code provides that, if a city
charter requires candidates to pay a filing fee, the amount of the
fee and an alternative procedure to payment of the fee must be
prescribed by the charter or by ordinance under charter
authorization; and
WHEREAS, the City Council desires to establish an alternative
to the filing fee required by section 9.02 of the City Charter;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
SECTION I
THAT the Code of Ordinances of the City of Schertz is hereby
amended by the addition of the following section 2-13:
"Sec. 2-13. Alternative to Candidate Filing Fee.
(a) As an alternative to payment of the filing fee for
elective office required by section 9.02 of the City
Charter, a candidate may file an Affidavit in Lieu of
Filing Fee (the "Affidavit") in the following form under
the circumstances described in the Affidavit:

(b) The City Secretary shall notarize any such Affidavit
without charge to the applicant.
(c) The City Secretary shall include a copy of the
Affidavit in the package of materials provided to
applicants for City elective office with an explanation
that the Affidavit is an alternative to the payment of
the filing fee under the circumstances described in the
Affidavit."
SECTION II
THAT this Ordinance shall be in force and effect from and after the
date of its adoption.
