1995M5- HEALTH COVERAGE AT RETIREMENT ORDINANCE NO. ~~~ AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AUTHORIZING CERTAIN CITY OF SCHERTZ EMPLOYEES, ALONG WITH CERTAIN OF THEIR DEPENDENTS, WHO ELECT TO RETIRE TO PURCHASE CONTINUED HEALTH COVERAGE AT RETIREMENT AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Schertz policy concerning the availability for retirees and their dependents; currently does not of health insurance NOW THEREFORE have a coverage BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SECTION I THAT employees of the City of Schertz who shall retire after the effective date of this ordinance shall be allowed to continue to be a member of the City's Group Health Insurance Plan under the following conditions: A. Such individual must be eligible for retirement under the Texas Municipal Retirement System. B. Such individual shall, retirement, be participating in health insurance benefits plan. immediately prior to the City's then existing C. Such individual shall not be eligible for health insurance through any subsequent employment or actually insured under any other health insurance plan or policy, except Medicare as set forth below or retired military benefits. D. Such individual must pay all of the premiums, plus two percent (2%) of premium amount administrative fee, or other cost required by the City of Schertz, Texas, whatever the amount of such may be currently or in the future, to continue as a member of the City's Group Health Insurance Plan, without allowing the payment of such premiums or costs and administrative fees to become delinquent. The failure to make such payments on a timely basis shall be deemed to be termination of such individual's participation in the City's Group Health Insurance plan. E. The continuance of an individual as a member of the Group Health Insurance Plan is subject to any provision which terminates or modifies a person's coverage under such program when he is or could be covered by Medicare. F. To receive continued coverage, the employee must inform the City, by notifying the City Manager or designated representative, not later than the day on which the person retires from the City that the person elects to continue coverage. G. If a person elects to continue coverage and on any subsequent date elects to discontinue such coverage (or is deemed to discontinue such coverage pursuant to paragraph D above), the person is no longer eligible to reestablish such coverage. H. The level or levels of coverage offered ordinance may not necessarily be the same level of coverage provided to current employees of the time to time. by this or levels City from I. This ordinance does not affect the right of the City to offer the coverage at an actual rate, plus administrative fee, established for retirees that may be greater than the rate offered to active employees. SECTION II THAT dependents of Schertz shall be allowed to Group Health Insurance Plan retired employees of the City of continue to be a member of the City's under the following conditions: A. Such dependent shall have been a member of the Group Health Insurance Plan for a period of at least (12) months prior to the employee's retirement. City's twelve B. This ordinance shall not be deemed to affect the definition of dependent or eligibility requirements for a dependent under a group health insurance plan, except as specifically provided herein. -3- SECTION II I This ordinance shall be in force and effect from and after the date of its adoption and shall apply only to employees who retire after the effective date of this ordinance and the dependents of such employees.
