AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING SECTION lOb, CITY OF SCHERTZ
ORDINANCE 90-F-34: PROVIDING FOR RENEWAL OF
A FRANCHISE AWARD FOR A PERIOD OF 2 TO 4
YEARS; AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT.
Whereas, it is found to be in the public interest to
maintain flexibility in the provision of services to the public,
and;
Whereas, the provider of such service is obliged to
make investment decisions on the strength of contracts for
service, and;
Whereas, finding that the service providers are fully
complying with this franchise award:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:

THAT Section lOb, City of Schertz ordinance 90-F-34 is hereby
amended to read as follows:
Section 10. DURATION OF THE FRANCHISE AND RENEWAL OPTIONS.
b. This franchise may be renewed for a period of from 2 to
4 years unless either the FRANCHISER or the FRANCHISEE gives
written notification of the termination of this franchise to the
other ninety (90) days prior to the expiration of the existing
franchise for just cause. The determination of the length of the
renewal period is solely at the discretion of the City Council of
the City of Schertz.
II
THAT all ordinances or parts of ordinances in conflict with this
ordinance are hereby repealed.
