AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, MAKING IT UNLAWFUL FOR ANY PERSON TO
,FIRE ANY GUN THAT DISCHARGES A BULLET, PELLET
OR "BB" BY ANY MEANS; UNLAWFUL FOR ANY PERSON
OR CORPORATION TO SELL TO PERSONS UNDER AGE
SEVENTEEN ANY LEADED CARTRIDGE OR ANY
EXPLOSIVE OR ANY GUN CAPABLE OF EXPLODING OR
DISCHARGING A BULLET, PELLET, OR "BB";
UNLAWFUL FOR ANY PERSON UNDER THE AGE OF
SEVENTEEN YEARS TO HAVE IN THEIR POSSESSION
ANY GUN, BOW AND ARROW, OR SLING SHOT OUTSIDE
THE CONFINES OF THEIR HOME UNLESS ACCOMPANIED
BY A PARENT, LEGAL GUARDIAN OR RESPONS IBLE
ADULT; AND PROVIDING A PENALTY FOR SUCH
VIOLATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
I
It shall be unlawful for any person within the corporate
limits of the City of Schertz, Texas, to fire any gun which
discharges a bullet, pellet, or "BB" by any means. It shall be
unlawful also to throw stones or other missiles; or to shoot or
discharge any stones or other missiles with or from a sling shot
of any kind.
Owners of agricultural land, or uninhabited land of ten (10)
acres or more, not adjacent to a densely populated area, are
excluded from this provision, provided the bullet or other
missile does not leave the boundaries of his land when
discharged.
II
It shall be unlawful for any person, firm or corporation
within the corporate limits of the City of Schertz, Texas, to
sell to any person under the age of seventeen (17) years any
leaded cartridge or any explosive of any kind, or any gun capable
of exploding or discharging a bullet, pellet, or "BB".
III
It shall be unlawful for any person under the age of
seventeen (17) years to have in their possession any gun, bow and
arrow, or sling shot of any kind outside the confines of his
immediate home unless accompanied by a parent, legal guardian, or
responsible adult.
A. Any such minor found in possession of above
mentioned item will be picked up by the police;
weapons confiscated and a summons will be issued
to the parents, legal guardian, or responsible
adult for appearance in Municipal Court.
B. The parent, legal guardian, or responsible adult
shall be held responsible for any damages caused
by their children or wards as a result of the
violation of this ordinance.
IV
Any person, firm or corporation who violates any portion of,
or any provlsion of, this ordinance shall be guilty of a
misdemeanor, and upon conviction thereof, shall be fined in a sum
not less than $25.00 nor more than $200.00, and a separate
offense shall be deemed committed for each day in which a
violation occurs or continues.
V
Severability: If any provision, section, sub-section,
sentence, clause or phrase of this ordinance is for any reason
held to be unconstitutional, void or invalid, or for any reason
unenforceable, the validity of the remaining portions of this
ordinance shall not be affected thereby.
