AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
REQUIRING THEATERS TO DISPLAY THE RATING OF FILMS,
FIXING A PUNISHMENT FOR VIOLATION OF THIS ORDINANCE;
PROVIDING FOR PUBLICATION OF THIS ORDINANCE; AND
CONTAINING OTHER MATTERS RELEVANT TO THE SUBJECT
AND PURPOSES HEREOF.
WHEREAS, there have been instances wherein residents of the
City of Schertz have attended motion pictures in the City without being able
to first determine the type and subject matter of such films; and
WHEREAS, young persons in the City of Schertz have on
occasions been unable to determine whether films they wished to see were
suitable for viewing by young people; and
WHEREAS, parents of younger residents of the City of Schertz,
Texas have encountered difficulty in determining whether films being shown
in the theaters in the City are acceptable for their children; and
WHEREAS, THE City Council of the City of Schertz desires to
provide a means whereby residents of the City can assure themselves of the
nature of the viewing content of films being shown within the Cit~, NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
I
That all theaters within the city limits of the City of
Schertz, Texas showing motion pictures shall be required to display on the
marquee of such theaters (or to otherwise prominently display on the premises
at a location that can be readily observed prior to entry) the rating of films
being shown in such theaters as such ratings have been determined by the
Motion Picture Association of America, which ratings come within the following
categories:
(a.) "G" - general audience
(b.) "PG" - parental guidance suggested;
(c.) "R" = restricted (only those 17 or older unless
accompanied by parent or guardian).
(d.) "X" - no one under 17 permitted.

A violation of this ordinance shall be punished by a fine
not exceeding $200.00. Each violation shall constitute a separate offense.
III
The City Secretary shall cause this ordinance to be pub=
lished in its entirety in the official newspaper of the City in the form
and manner required by law for penal ordinances. The official newspaper
of said City being a weekly newspaper, publication shall be made in one
(1) issue thereof. Proof of such publication shall be made by the
publisher or other employee of the newspaper by affidavit filed with the
City Secretary and shall be prima facie evidence of such publication
and the promulgation of this ordinance in all courts of the state. This
ordinance shall take effect and be enforced from and after the publication
hereof as hereinabove provided.
