AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS PROVIDING THAT THE UNIFIED DEVELOPMENT
CODE, ORDINANCE NO. 96-S-28, CITY OF SCHERTZ,
TEXAS BE AMENDED BY REVISING ARTICLE VI,
DENSITY AND DIMENSIONAL REQUIREMENTS,
SECTION 5, BUILDING SEPARATION (RESIDENTIAL);
ARTICLE XI, PLATTING, SECTION 31, SIDEWALKS;
ARTICLE XVI, ADMINISTRATIVE PROCEDURES,
SECTION 5, PROCEDURES FOR ZONING CHANGES,
SECTION 6, PUBLIC HEARING-PLANNING AND ZONING
COMMISSION AND SECTION 7, PUBLIC HEARING-CITY
COUNCIL; AND PROVIDING A REPEALING CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION I
THAT ARTICLE VI, Density and Development Requirements, SECTION 5,
Building Separation, Paragraph 5.2 be amended as follows:
"Article VI, Section 5, Paragraph 5.2:
The 3rd line down and before the word gazebo add...or...and following gazebo
delete...or other accessory structure.... Also in the 5th line delete...accessory
building.,..and add...structure... The remainder of the section would remain
the same. "
SECTION II
THAT ARTICLE XI, PLATTING, SECTION 31, Sidewalks, Paragraph 31.1 be
amended as follows:
"Article XI, Sec, 31, Paragraph 31.1:
Add to the end of the sentence; except in MI and M2 zoning districts,"
SECTION III
THAT ARTICLE XVI, ADMINISTRATIVE PROCEDURES, SECTION 5,
Procedures for Zoning Change, Section 6, Public Hearing-Planning and Zoning
and Section 7, Public Hearing-City Council be amended as follows:
Article XVI, Section 5, Paragraph 5,4:
"The 3rd sentence to be deleted and the following sentence inserted...Following
a review of the application, the Planning and Zoning Commission will set a
date for public hearing of the requested zoning change. The applicant shall
be notified in writing by an appropriate City Staff member of the time, date
and location of the public hearing...,
Move paragraphs A,B,C and D from Section 5.4 to Section 6.8."
Article XVI, Section 6, Paragraph 6,8:
"Change the following: Delete CommiSsion Recommendation and replace with
Commission Review Criteria, Delete the second sentence and replace
with....Recommendations to the City Council will be based upon the
following criteria... and add the A,B,C and 0 from Sec. 5,4. The remainder of
Section 6.8, with the exception of paragraph C will become Section 6.9"
Article XVI, Section 6, Paragraph 6.9:
New Section 6.9: Commission Recommendations will read as follows:
"A. The Planning and Zoning Commission may recommend that the request or
amendment be approved or disapproved; or
B. That the request or amendment be approved or enacted as modified to a
more restrictive classification or subject to appropriate conditions as permitted by
law; or
C. The Planning Department shall forward the report and the Commission's
recommendations on all proposed applications and amendments to the City
Council unless otherwise provided in this code."
Article XVI, Section 7, Paragraphs 7.3A, 7.4C and 7.4D:
"Section 7.3 A; Change Planning Coordinator to City Manaaer.
Section 7.4 C; Change 3rd line..,be resubmitted within six months if there...
See Section 5.3.
Section 7.4 0; In lines 6 and 10 change time periods to 6 months See Sec. 5.3."
SECTION IV
That all ordinances or parts or ordinances in conflict with this ordinance are hereby
repealed.
