01-11-2011 MinutesMINUTES REGULAR MEETING January 11, 2011 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on January 11, 2011, at 6:00 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building ##4, Schertz, Texas. The following members present to-wit: Mayor Hal Baldwin Councilmember Jim Fowler Councilmember George Antuna Mayor Pro Tem Michael Carpenter Councihnember David Scagliola Councilnnember Cedric Edwards Staff Present: City Manager Don Taylor Assistant City Manager John Bierschwale Assistant City Manager David Harris City Attorney Michael Spain City Secretary Brenda Dennis CALL TO ORDER REGULAR MEETING Mayor Baldwin called the meeting to order at 6;00 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Councilmember Fowler gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. Hearing of Residents Mayor Baldwin stated that this evening he would like to make a special presentation to honor two (2) special individuals. Mayor Baldwin read an email from Mr. Richard Eldridge, 109 Corsica Drive, where "two of your forest citizens saved my live on December 20, 2010. There was a boating accident, my legs were tangled in nylon rope and the boat was sinking. I had my life vest, but that was not going to be of much use to me much longer, if it were not for William Shahan and his son Bradley Hunt. Mr. Shahan drove his boat as close as he could, while Bradley grabbed his dad's knife on his way to diving into the cold water of Calaveras Lake. My legs were freed and 1 was given another Christmas with my daughters and grand-children, due to your citizens. Mayor Baldwin called up Mr. Eldridge, Mr. William Shahan and his son Bradley Hunt and read and presented a proclamation regarding the heroic deed performed by these two men and commended these brave citizens of our City and extended sincere gratitude of Mr. Eldridge, his family, Schertz City Council, and all residence of this great community. Mr, Eldridge expressed his sincere gratitude. Mayor Baldwin recognized the following who signed up to speak: : Mr. Robert Wallace, 3301 Baldwin Park, who provided a briefing on the Schertz Youth Soccer Alliance. ©1-1~-201I Minutes Dr. Mark Flanagan with the Guadalupe County Youth Livestock and Homemakers Show and Ms. Tess Shelton, Senior at Samuel Clemens High School, who invited Gauncil to attend their upcoming event starting January 19a' through January 22"x, 2011, at the Seguin Coliseum. Mr. Robert Brockman, 1000 Elbel Road, who requested that the City remove Mr. Underwood's political sign, which is still on Schertz Parkway. Discussion and/or Aetion Ttems 1. Minutes -Consideration and/or action regarding the approval of the minutes of the Regular Meeting of January 4, 2011, Mayor Baldwin recognized Councilnnember Fowler who moved, seconded by Councihnember Scagliala to approve the January 4, 2011 minutes. The vote was unanimous. Motion Carried. 2. 2014 Baud Projects ~- Presentation and discussion regarding the upcoming 2010 Bond projects. (J. BierschwalefL. Dublin} Mayor Baldwin recognized City Engineer Larry Dublin who provided a briefing to Council on an update and proposed timeline on the upcoming 2010 Band Projects answering questions and concerns from Council. Mayor and Council requested staff to provide timeline information on the upcoming bond projects in the Schertz Tales Magazine. City Manager Don Taylor stated that the Administration is planning to have a kick off meeting at the Civic Center far those interested in the timeline on the bond projects, and that proper notice will also be given. No action taken. 3. Resolution No. 11-R-Ol. -Consideration and/or action approving a resolution relating to establishing the City's intention to reimburse itself for the prior lawful expenditure or fiends from the proceeds of Obligations to be issued by the City for authorized purposes; authorizing matters incident and related thereto; and providing an effective date. (M. McLineylR, Cunningham} Mayor Baldwin recognized Financial Analysis, Mark McLiney with Southwest Securities and his Partner, Ryan Cunningham, who introduced this item stating that action requested of Council authorizes a Reimbursement Agreement, allowing City Funds in the amount of $5,000,000 to be spent to begin the 2010 Bond Projects. The funds will be reimbursed to the City after the issuance of the bonds in spring of 2011. There will be no immediate fiscal impact. After the sale of the bonds, the City's I&S tax rate will increase by an estimated $0.05 in fiscal year 2011-12. Staff recommends approval of Resolution No. 11-R-01. Mayor Baldwin recognized Councilmember Edwards who moved, seconded by Councilmember Fowler to approve Resolution No. 11-R-O1. The vale was unanimous. Motion carried. 4. AppointmentslReappointments/ Resignations to Boards and Commissions/Committees -Consideration and/or action regarding appointments) resignations to Boards and Cotnmission/Comrnittees. O1-11-2011 Minutes Page - 2 - Councilmember Scagliola left the dais for a brief break. Mayor Baldwin recognized Councilmember Antuna who moved, seconded by Councilmember Edwards to ratify the resignations of Mary Spence, TSAC, Dean Midlick and Jeffrey Siebert, Parks & Recreation, and Simone Bailey, Library Board. The vote was d-0-0, with Councilmember Scagliola not voting due to being awQy from the dais. Motion carried. Councilmember Scagliola returned to the dais. Mayor Baldwin recognized Councilmember Edwards who moved, seconded by Mayor Pro-Tem Carpenter to reappoint Max Hernandez to TSAC, appoint William Rumfelt in Ms, Bowers place on TSAC. The vote unanimous. Motion carried. Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Councilmember Edwards to reappoint Sandy Keiser, Bobbie Boyce, Carol Cyr, Neota Brady, and Sonia Samora to the Library Board. The vote was unanimous. Motion carried. Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by Councilmember Antuna to appoint Pete Perez to the Historical Preservation Commission. The vote was unanimous. Motion carriers: 5. North SchertzlGateway Planning Project -Presentation, discussion and possible action regarding the North Schertz/Gateway Planning Project and upcoming activities. (D. Harris) Mayor Baldwin recognized Assistant City Manager, David Harris who provided Council with updated information an the North Schertz and the Gateway Planning Project activities as well as the upcoming activities, answering questions from Council. Mx. Harris invited the Mayor, Council, and the public to the Schertz Planning and Design Charrette on January 31 and February 2 at 6pm at the Schertz Civic Center. He also stated that on January 22 the 1St Annual Selma-Schertz Salute to Service Members SK Run/Walk would be taking place at the Blue Bonnet Palace. Mayor Baldwin is to shoot the frying gun along with Mayor Daily. In addition, Mr, Harris mentioned the possibility of a road trip to the DFW area to include some staff members from Planning & Zoning and the Board of Adjustments. He asked Council if any members were interested in attending next Wednesday and Thursday, January l9 and 20. Areas to visit include Kyle, Addison, McKinney, South Lake, and Plum Creek, No action taken. EXECUTIVE SESSIGN Called under Section 551.071 Texas Government Code Litigation, pending litigatio©; Section 551.072 Texas Government Cade -Deliberation regarding the purchase, exchange, sale, D1-11-2011 Minutes Page - 3 - lease, or value of real property, and Section 551.074 the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the City Manager and the Assistant City Secretary. Mayor Baldwin adjourned into executive session at 7:14 p.m. RECONVENE TO REGULAR SESSION Mayor Baldwin reconvened into regular session at S:IS p.m. 6. Take any action deemed necessary as a result of the Executive Session. Mayor Baldwin recognized Councilmember Fowler who moved, seconded by Councilmember Scagliala that Mary Ybarra be removed as Deputy City Secretary in order far her to be named Administrative Assistant to the two (2) Assistant City Managers, and that Cindy Raleigh be named Deputy City Secretary with a salary of $46,944, seconded by Councilmember Scagliala. Mayor Pro-Tem Carpenter called far a question, asking would Council consider rounding it up to $47,000 even. Councihxaember Fowler corrected his motion to set the salary at $47,000, seconded by Councilmember Scagliola. The vote was unanimous. Motion carried. Requests and Announcements 7. Requests by Mayor and Councihnembers that items be placed an a future City Council agenda. Mayor Baldwin recognized Mayor Pro-Tem Carpenter who stated that a couple of weeks ago the issue of renaming the Schertz Veteran's Plaza came up and asked if the group was ready to make a presentation to Council regarding the Schertz Veteran°s Memorial Plaza. City Attorney Michael Spain stated that this item is an for the January 18, 201.1 meeting. 8. Requests by Mayor and Cauncihnembers to City Manager and Staff far information. Mayor Baldwin recognized Councilmember Scagliola who asked for updated information regarding the parking problem on Borgfeld Road. City Manager Don Taylor stated that staff has been out to that area and found that there was not a problem. Councihnember Scagliola stated that he is still receiving citizen emails on the problem. Mayor Baldwin recognized Councilmember Antuna who stated that he believes the parking problem is occurring after 5:00 p.m. and on the weekends. City Manager Don Taylor stated that he would have the police department take a look during these times and report back to Council. Mayor Baldwin recognized Mayor-Pro~Tem Carpenter who asked staff to see what they could do about the recent tagging problems at the City parks. He asked if staff could see what is happening on this. Assistant City Manager David Harris stated that he is working with the Parks and Recreation Director, George Logan and the IT Director, Myles Clouser to come up with some type of surveillance. Mayor Baldwin stated that he was told by Mr. Logan that they are aware of the problem and trying to come up with solutions. 01-11-2011 Minutes Page - 4 - Mayor Baldwin recognized Councihnember Antony who stated that he received a copy of the Brownsville Herald, where there appeared an article; the City was going to implement no plastic bag usage within their community. Councihnember Antuna requested staff to contact the City of Brownsville on the methodology they used to implement this. City Manager Don Taylor and Assistant City Manager David Harris responded, stating that they would get with the City of Brownsville and bring back to Council the information. Mayor Baldwin stated that BVYA will be hosting their opening day ceremony in April with a carnival; their intent is to raise money and is utilizing the public/private idea of doing so. He also stated that BVYA is requesting permission to allow them to perform their opening day parade as they had in the past. Mayor and Council discussed possibly relocating the parade route for safety measures. City Manager Don Taylor stated that he was unaware they could not have their parade and that there were na restrictions. Assistant City Manager John Bierschwale reiterated the same. Mayor Baldwin stated that he would contact BVYA and let them know to press an with their plans far the parade. 9. Mayor Baldwin recognized Councilmember Scagliala who stated that he attended the FAA Ribbon cutting ceremony at the Toby Center last week. He stated that he was impressed with the maturity and responsibility the program of FAA instills in our youth. Mayor Baldwin recognized Councilmember Antuna who stated that he had the privilege of attending the swearing in ceremony in Austin far the new State Legislation. Mayor Baldwin stated that the Texas House of Representatives John Kuempel will be visiting City Hall on Friday, January 1 d, 2011 at 10:00 a.m. and invited Council to come and meet with him to provide the Gity of Schertz's legislative needs. Mayor Baldwin read into the record a recent certificate award presented to the City of Schertz employees entitled the "Spirit of San Antonia Alamo Award", for the giving level of the 2010 United Way Campaign. 10.
