AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, ADOPTING A UNIFIED DEVELOPMENT CODE (UDC), IN ACCORDANCE WITH ALL REQUIREMENTS PRESCRIBED BY LAW, TO TREAT IN ONE UNIFIED TEXT THE RULES AND REGULATIONS OF THE ZONING ORDINANCE, SUBDIVISION ORDINANCE, SIGN ORDINANCE, MOBILE HOME ORDINANCE AND FLOOD PLAIN ORDINANCE; PROVIDING VIOLATIONS AND PENALTIES; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND, PROVIDING AN EFFECTIVE DATE. SECTION I WHEREAS, the City Council of the City of wishes to protect, promote, improve and provide public health, safety and general welfare of the of the City of Schertz; and, Schertz for the citizens WHEREAS, the City Council of the City of Schertz deems it necessary to ensure the safe, orderly and efficient development and expansion of the City of Schertz in accordance with and pursuant to its Comprehensive Plan; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT, the Exhibit included shall hereinafter be known as the City of Schertz, Texas Unified Development Code (UDC). SECTION II OTHER PROVISIONS Violations and Penalties. Any person, firm or corporation who shall violate any of the provisions of this Ordinance or fail to comply therewith or shall violate or fail to comply with any order or regulations made thereunder, or who shall build in violation of any detailed statement of specification of plans submitted and approved thereunder, or any certificate or permit issued thereunder, shall, for each and every violation and noncompliance respectively, be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined a sum not to exceed the legal maximum. Each and every day that such violation and/or noncompliance shall exist shall be deemed a separate offence. In case any person, firm or corporation violates any of the provisions of this Ordinance or fails to comply therewith, the City of Schertz, in addition to imposing the penalties above provided, may institute any appropriate action or proceedings in court to prevent, restrain, correct, or abate any illegal act, conduct, business or use in or about any land, and the definition of any violation of the terms of this Ordinance as a misdemeanor. It shall not preclude the City of Schertz from invoking the civil remedies given it by law in such cases, but same shall be cumulative of and in addition to the penalties prescribed for such violation. Repeal of Conflictinq Ordinances. All ordinances or parts of ordinances in conflict with this Ordinance, through its effective date, specifically Sign Ordinance No. 86-S-28 and all its amendments, Zoning Ordinance No. 87-S-l and all its amendments, Mobile Home Ordinance No. 87-S-8 and all its amendments, Subdivision Ordinance No. 87-S-ll and all its amendments, and Flood Plain Ordinance No. 95-M-19 and all its amendments, are hereby repealed to the extent necessary to give this Ordinance full force and effect. Severability Clause. All sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable. If any such section, paragraph, sentence, clause or phrase is declared unconstitutional or otherwise invalid in any court of competent jurisdiction in a valid judgment or decree, such unconstitutionality or invalidity shall not cause any remaining section, paragraph, sentence, clause or phrase of this Ordinance to fail or become inoperative. Effective Date. This Ordinance shall become effective from and after adoption by the City Council and signature by the Mayor and adoption as provided by law.
