11-S-04 Moratorium ETCORDINANCE NO. 11-5-04 A ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PLACING AONE-YEAR MORATORIUM ON THE FILING AND/OR ACCEPTANCE OF ANY NEW SUBDIVISION MASTER PLANS AND/OR SUBDIVISION PLATS FOR PROPERTY LOCATED IN THE CITY'S EXTRATERRITORIAL JURISDICTION, AND DECLARING AN EMERGENCY WHEREAS, the City of Schertz, Texas (the "City") has established standards and regulations for the subdivision of land within the City's extraterritorial jurisdiction (the "ETJ") in Article 12 of the City of Schertz Amended and Restated Unified Development Code (the "UDC"); WHEREAS, the City Council of the City is reviewing the City's existing ETJ subdivision policies and anticipates overall modifications to the subdivision provisions in the UDC, the Comprehensive Land Plan, and the City's Strategic Plan; WHEREAS, the City Council has determined that limitations should be placed on the filing of subdivision master plans andlar subdivision plats for property located within the City's ETJ pending such revisions; and WHEREAS, the City Council has determined that it should place an immediate moratorium on the filing of subdivision master plans and/or subdivision plats for property located within the City's ETJ for aone-year period. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: Section 1. Effective immediately, no subdivision master plans and/or subdivision plats for property located in the City's ETJ shall be accepted, considered, or approved by the City for a period of one year from the effective date of this Ordinance. The Planning and Zoning Commission is hereby directed not to accept, consider, ar act upon any such master plans and/or subdivision plats for a period of one year from the effective date of this Ordinance. Section 2. The City Secretary, on the advice of the City Manager and the City Attainey, is hereby directed to enter appropriate notations in the UDC to reflect the substance of this Ordinance. Section 3. AlI ordinances, resolutions, or parts of ordinances or resolutions in conflict with this Ordinance are hereby repealed. Section 4. Pursuant to Section 4.09(e} of the City Charter, by vote of not less than two-thirds of the members of the City Council present at the meeting at which this Ordinance was first considered, the City Council has determined that an emergency exists which requires immediate action, and this Ordinance is hereby adopted on a single reading, and this Ordinance shall be effective upon the date hereof and any publication required by law. 500295 i, i PASSED AND FINALLY APPROVED on first a final ading the 15'h day of February, 2011.
