04-26-2011 MinutesNIINUTES REGULAR MEETING Apri126, 2011 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on April 26, 2011, at 5:00 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to-wit: Mayor Hal Baldwin Councilmember Jim Fowler Councilmember Cedric Edwards Mayor Pro -Tern Michael Carpenter Councilmember David Scagliola Councilmember George Antuna Staff Present: City Manager Don Taylor Assistant City Manager David Harris City Secretary Brenda Dennis CALL TO ORDER REGULAR MEETING Assistant City Manager John Bierschwale City Attorney Michael Spain Mayor Baldwin called the meeting to order at 5:00 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Cauncilmember Fowler gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. Mayor Baldwin adjourned into executive session at 5:02 p.m. EXECUTIVE SESSION Called under Section 551.074 the appointment, employment, evaluation, reassignment, duties, discipline, ar dismissal of the City Manager. RECONVENE TO REGULAR SESSION Mayor Baldwin reconvened into regular session at 6:11 p.m. PRESENTATIONS • Hal Baldwin Scholarship Golf Tournament Update and Check Presentation (G. Logan) Mayor Baldwin recognized Parks & Recreation Director George Logan and City Manager Don Taylor. Mx. Logan presented a check in the amount of $14,000 on the proceeds received for the first Hal Baldwin Scholarship Golf Tournament. Mayor Baldwin and City Manager Don Taylor introduced the following members of the golf tournament committee who were present: Amy Sellers, Allison Gorzell, Erin Matlock, Patty Horan, Sherry Davis, Mary Spence, Sandy Bryant, and Brenda Dennis. 04-26-20].1 Minutes Others on the committee not present were: 3ames Walters, Suzanne Cummings, Earnest Spradling, John Correu, and Sarah Gonzalez. Mayor Baldwin and City Manager Don Taylor thanked the committee far their hard work in planning the golf tournament. • Media Relations Department Update and introduction of new employees (B. Bailey) Mayor Baldwin recognized Media Rela#ions Department Director Brad Bailey who introduccd the new employees: Event Facilities ~ Account Manager, Celina Blair; Schertz Tales Account Manager, Chris Matzenbacher; and Event Facilities Admin, Linda Ervin. Utilizing a PowerPaint presentation, each staff member provided information on their respective activities. Hearing of Residents Mayor Baldwin recognized Mr. Robert Westbrook, 12214 Lost Meadows, who came forward stating that he 15 running for the SCUCISD School Board and would appreciate everyone's support. Workshop -(Discussion b_v Couuncil to_provide uidance to staff) A. Air Quality Control -- Stricter Emissions Standards. (D. Taylor/M. Spain) Mayor Baldwin recognized City Manager Dan Taylor who stated that a few months ago the City was involved in annexing an area in Comal County. At that time the Gity was made aware of a proposed rock crushing facility. The citizens expressed concerns, such as property values decreasing, air quality, eta, Mr. Taylor stated that Council at that time expressed interest and wanted the City to look into possibly passing a resolution or an ordinance regulating and tightening up the air quality control in the Gity. He stated at that time there was a state agency (TCEQ) that takes care of this; we have to be careful. Anything the City does may not hinder an industry coming in and would require technical advice. He stated that the City does not have staff available with the technical experience. Mr. Taylor stated that anything the City came up with would require the guidance of someone with technical experience in air quality control. Mayor Baldwin stated that on this subject, he attended a recent TCEQ hearing regarding the quarry that is coming in, which would put a rock crushing facility within our City limits. He stated that he was very disappointed in the hearing, but that was the final hearing of TCEQ, and final decision. There was not an opportunity at that time to be heard because TCEQ was not taking any input other than the two attorneys of the two sides, but that they did thank him for coming. Mayor Baldwin stated that he did learn that the City needed to be involved in all the public hearings regarding these issues. He further stated that the first hearings were about a year and a half ago and that it was too late for the City to get involved and the City needs to be involved in these in the future. Lastly, Mayor Baldwin stated that the City does need to monitor the air quality in this area especially since this area is our planned growth area. Mayor Baldwin recognized City Attorney Michael Spain who sta#ed that we did get involved late in the rock crushing facility, but the only reason we got involved at all was the City started annexation proceedings up in that area and the citizens in the area made us aware of it and were concerned. He stated that even though we were not able to influence 44-26-2011 Minutes Page - 2 - TCEQ, the citizens were very grateful for the City's interest and sensitivity to their concerns. Mayor Baldwin recognized Councilmember Antuna who concurred with the statements above and would like the City to be better stewards of the area in concerns of air quality. Consent Agenda Action Items 1. Ordinance No. 11-M-10 -Consideration and/or action approving an ordinance setting dates for the end of terms of members of certain City boards, commissions, and committees; repealing all ordinances or resolutions or parts of ordinances ar resolutions in conflict with this ordinance; and providing an effective date. Final Reading (B. DennislM. Spain) 2. Minutes -Consideration and/or action regarding the approval of the minutes of the Regular Meeting of April 19, 2011. 3. Appointments/Reappointments/ Resignations to Boards and Commissions/Committees - Consideration and/or action regarding appointments) resignations to Boards and Commission/Committees. (B. Dennis/C. Raleigh) Mayor Baldwin recognized Cauncihnember Scagliola who moved, seconded by Councilmember Fowler to approve the consent agenda items 1 through 3. The vote was unanimous. Motion carried. Requests and Announcements 4. Requests by Mayor and Councihnembers that items be placed on a future City Council agenda. None were given. 5. Requests by Mayor and Councilmembers to City Manager and Staff for information. None were given. b. Announcements by Mayor and Councihxiembers Mayor Baldwin stated that the City had received 55 applications for the position of the City Manager and that the Council has narrowed it down to four and will probably be setting up interviews very soon. 7. Announcements by City Manager Mayor Baldwin recognized Assistant City Manager David Harris who reminded Council that on Thursday, May 5, 2011 at 5:30 p.m. at the Civic Center is the Schertz Sweetheart Pageant and invited all to attend. Mayor Baldwin adjourned back into executive session at 6:58 p.m. EXECUTIVE SESSION 026-2011 Minufes Page - 3 - Called under Section 551.071 Texas Government Code Litigation, pending litigation; Section 551.072 Texas Government Code -Deliberation regarding the purchase, exchange, sale, lease, or value of real property and Section 551.074 the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the City Manager. Mayor Baldwin reconvened back into regular session at 8:07 p.m. RECONVENE TO REGULAR SESSION 8. Take any action deemed necessary as a result of the Executive Session. Mayor Baldwin announced that the Council will be interviewing the following for the position of the City Managex: Mr. John Kessell, Mr. John Bierschwale; Mr. Frank Robinson, and Mr. Ronald Wilde.
