05-03-2011 MinutesMINUTES REGULAR MEETING May 3, 2011 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on May 3, 2011, at 6:00 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to -wit: Mayor Hal Baldwin Councilmember David Scagliola Councilmember Cedric Edwards Staff Present: City Manager Don Taylor City Attorney Michael Spain City Secretary Brenda Dennis Councilmember Jim Fowler was absent. CALL TO ORDER REGULAR MEETING Mayor Pro -Tern Carpenter Councilmember George Antuna Assistant City Manager John Bierschwale City Attorney Katherine Tapley Deputy City Secretary Cynthia Raleigh Mayor Baldwin called the meeting to order at 6:01 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Mayor Pro -Tern Carpenter gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. Mayor Baldwin recognized the following who were in the audience this evening: • Life Scout, Alex Akeroyd, Troop 51 • First Class Scout, Michael Griffith, Troop 512 • First Class Scout, Jacob Copley, Troop 512 • Cub Scout, Lance Paprocki, Pack 323 PROCLAMATION Proclamation Municipal Clerks Week Mayor Baldwin recognized City Secretary Brenda Dennis, Deputy City Secretary Cynthia Raleigh, and Records Coordinator Traci Paprocki and read the proclamation recognizing National Municipal Clerks Week. PRESENTATIONS • Award presentation regarding Schertz Sweetheart Court as 3rd Place Winner in the Fiesta Flambeau Parade (E. Matlock) 05 -03 -2011 Minutes Mayor Baldwin recognized Economic Development Specialist Erin Matlock who introduced Mr. William Untiedt with the Fiesta Flambeau Parade Association who stated that the young ambassadors, the Schertz Sweetheart Court participated in the 2011 Fiesta Flambeau Parade on April 16, 2011 and their City of Schertz float captured third place out of more than 20 entries in the Community Organization category. Mr. Untiedt presented the 3rd place plaque to Mayor Hal Baldwin. • City Secretary and Records Management department update /presentations (B. Dennis, C. Raleigh, T. Paprocki) Mayor Baldwin recognized City Secretary Brenda Dennis, Deputy City Secretary Cynthia Raleigh, and Records Coordinator Traci Paprocki who provided information regarding the duties, responsibilities and activities of the City Secretary's office and Records Management. • Presentation/discussion and possible action regarding Landmark Property designations (D. Weirtz) Mayor Baldwin recognized Historical Preservation Committee Chair Dean Weirtz who provided Council information of the following applications for Landmark Property Designations answering questions from Council: • Historic Landmark Designation St. Joseph's Chapel, 386 N. Castell • Heritage Neighborhood Designation Armando Z. Perez, 216 Lee Street • Heritage Neighborhood Designation Pedro Perez, Sr., 212 Lee Street • Heritage Neighborhood Designation Daniel J. and Dianne Gembarowski, 401 First Street Mayor Baldwin recognized Councilmember Edwards who moved, seconded by Councilmember Scagliola to approve all four designations. The vote was unanimous. Motion Carried. Mayor and Council thanked Mr. Weirtz for the hard work he does with the Committee. Hearing of Residents No one spoke. Discussion and /or Action Items 1. Minutes - Consideration and/or action regarding the approval of the minutes of the Regular Meeting of April 26, 2011. Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by Councilmember Antuna to approve the minutes of April 26, 2011. The vote was unanimous. Motion carried. 05 -03 -2011 Minutes Page - 2 - 2. Resolution No. 11-R-23 -- Consideration and/or action approving a Resolution regarding an Amended and Restated Agreement with the Schertz Chamber of Commerce. (J. BierschwalelM. Spain) Mayor Baldwin recognized City Attorney Michael Spain who stated that action requested of Council approves amending an agreement with the Schertz Chamber of Commerce. The amendment clarifies the obligations of both parties to best utilize resources to promote the City and the interests of the Chamber. The annual impact of $59,128 from the Hotel/Motel Occupancy Tax is a budgeted amount. Staff recommends approval. Mayor Baldwin recognized Councilmember Antuna who moved, seconded by Mayor Pro - Tem Carpenter to postpone this item until the new City Manager had been hired. The vote 3 -1 with Councilmember Scagliola voting no. Motion Carried 3. Resolution No. 11 -R -25 — Consideration and/or action approving a Resolution authorizing an Amendment to the Regional Water Supply Contract between SSLGC and the City of Converse. (J. BierschwalelA. Cockerell/M. Spain) Mayor Baldwin recognized Assistant City Manager John Bierschwale, and City Attorney Michael Spain who stated that action requested of Council approves an amendment to the Schertz Seguin Local Government Corporation regional water supply contract. The cities of Schertz and Seguin consent to provide the City of Converse additional time to acquire land and easements required for the delivery point by negotiation rather than condemnation. The amendment also deletes a reference to an elevated storage tank, since delivery will be into a ground storage tank. Staff recommends approval. Mayor Baldwin recognized Mayor Pro -Tern Carpenter who moved, seconded by Councilmember Edwards to approve Resolution No. 11 -R -25. The vote was unanimous. Motion Carried. 4. Resolution No: 11 -R -26 — Consideration and/or action approving a Resolution authorizing approval of Regional Mutual Aid Agreements. (D. Covington/D. Wait) . Mayor Baldwin recognized Fire Chief David Covington and EMS Director Dudley Wait who stated that action requested of Council authorizes the City Manager to enter into standard Fire or EMS Mutual Aid Agreements without specific City Council approval. Staff recommends approval. Mayor Baldwin recognized Mayor Pro -Tem Carpenter who moved, seconded by Councilmember Edwards to approve Resolution No. 11 -R -26. The vote was unanimous. Motion Carried Mayor Baldwin adjourned into executive session at 7:00 p.m. EXECUTIVE SESSION Called under Section 551.071 Texas Government Code Consultation with City Attorney regarding Litigation, pending litigation; Section 551.072 Texas Government Code — 05 -03 -2011 Minutes Page - 3 - Deliberation regarding the purchase, exchange, sale, lease, or value of real property and Section 551.074 the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the City Manager. Mayor Baldwin reconvened into regular session at 9:10 p.m. RECONVENE TO REGULAR SESSION 5. Take any action deemed necessary as a result of the Executive Session. No action taken. Requests and Announcements 6. Requests by Mayor and Councilmembers that items be placed on a future City Council agenda. No items requested. 7. Requests by Mayor and Councilmembers to City Manager and Staff for information. No request given. 8. Announcements by Mayor and Councilmembers Mayor Baldwin recognized Councilmember Antuna who announced the most recent recognition of Clemens High School being named one of the top ten High Schools in the greater San Antonio area by a non profit organization called "Children at Risk" as well as made the top ten list of the "Most improved Schools "; and also that Steel High School was ranked 18a' out of the 64 schools. Councilmember Antuna stated that he will not be able to attend the Sweetheart ceremony Thursday; his company is celebrating being in business for 100 years. Mayor Baldwin stated that he wanted to remind everyone of the Merritt Lakeside Senior Village groundbreaking ceremonies on Thursday, May 5, 2011 at 4:00 p.m., and the Sweetheart Pageant, which starts at 6:00 p.m. at the Civic Center. Mayor Baldwin stated he wanted to relay to Chuck McCollough and the others with the Media Relations Department what a great tribute this month in the Schertz Tales to honor the girls at the different high schools in the athletic activities. He mentioned that his grandson's photo was also in the issue where he was on the 17'' hole of the recent Hal Baldwin Scholarship Golf Tournament. 9. Announcements by City Manager None given.
