ccreg 07-20-04 COUNCIL - REGULAR SESSION TUESDAY, JULY 20, 2004 The Schertz City Council convened in regular session on Tuesday, July 20, 2004 at 7:00 pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Councilmembers Carl Douglas, Steve Simonson, Reginna Agee, Tony Wilenchik and Ken Greenwald. Staff members present City Manager Mark Marquez and Deputy City Secretary Mary Ybarra. Mayor Baldwin welcomed everyone and called the meeting to order at 7:00 pm, and asked everyone to rise and join him in the Pledge of Allegiance to the Flag. Mayor Baldwin thanked Police Chief Starr for a very nice presentation on plaque dedication for former Police Chief Agee. The plaque is displayed at entrance of Police Department. The presentation took place prior the City Council meeting. #1 HEARING OF RESIDENTS Robert Brockman. 4505 Grand Forest had the following comments: . The need for bike route signage back to back. Currently signage indicates one- way. #2 APPROVAL OF MINUTES: Special Workshop Session Special Workshop Session Regular Session 5-12-04 5-26-04 6-01-04 There being no corrections to minutes, Councilmember Agee moved to approve the minutes of Special Workshop Session, May 12, 2004, Special Workshop Session, May 26, 2004 and Regular Session, June 1, 2004. Councilmember Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald. NAY: None. #3 PUBLIC HEARING: To receive citizen comments regarding the rezoning of 655.5+ acres from Pre-development (PD) to Residential/Agricultural (RA) in Guadalupe and Comal Counties. Applicant: City of Schertz Mayor Baldwin explained the procedures to be followed in a public hearing and asked for staff input at this time. City Manager Marquez pointed to map, showing the property along IH-35. Mentioned that annexation had taken place and rezoning for development is the issue and driver to rezone the area from Pre-Development (PD) to Residential! Agricultural (RA). The initial zoning is not set in stone, property owner may choose or request a change. The Planning and Zoning Commission met and voted, recommending approval to rezone 655.5+ acres. Currently the frontage is General Business (GB) and will stay in its current zoning. The public hearing was open for citizen input. There was none. Mayor Baldwin closed the public hearing. #4 ORDINANCE: Consider and take action on first reading of Ordinance rezoning 655.5+ acres from Pre-development (PD) to Residential/Agricultural (RA) in Guadalupe and Comal Counties There was no further discussion and Councilmember Greenwald moved to approve the first reading of Ordinance rezoning 655.5+ acres from Pre-Development (PD) to Residential! Agricultural (RA). Councilmember Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald. NAY: None. #5 PUBLIC HEARING: To receive citizen comments regarding consideration of Corridor Hotel Ltd. Reinvestment Zone. Mayor Baldwin explained the procedure to be followed in a public hearing and asked for staff input at this time. City Manager Marquez commented it's a straightforward procedure and mentioned that the reinvestment zone area is larger to accommodate other development not only development of hotel. He recommends approval. Amy Madison, Community Development Director added that the development consists of a restaurant pad/hotel. No word on what type of restaurant as of yet. The hotel is a (4) four-story structure with 98 units. The item was opened for citizen input. There was no none and Mayor Baldwin closed the public hearing. #6 ORDINANCE: Consider and take action on first reading of Ordinance approving Corridor Hotel Ltd. Reinvestment Zone. Councilmember Douglas moved to approve the first reading of Ordinance approving Corridor Hotel Ltd., Reinvestment Zone. Councilmember Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald. NAY: None. #7 ORDINANCE: Consider and take action on first reading of Ordinance regarding Tax Abatement Agreement for and with Corridor Hotel Ltd. City Manager Marquez commented the abatement is based on 4.2 million dollar property improvements. Plans are to construct a 56,000 square foot hotel, consisting of 32 suites, 98 units. The annual abatement is 79% for a period of ten (10) years. The total net revenue to the City over the 10-year term is approximately $444,000+. He believes a second hotel is a good thing for the City. Councilmember Simonson moved to approve the first reading of Ordinance regarding Tax Abatement Agreement for and with Corridor Hotel Ltd. Councilmember Douglas seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald. NAY: None. #8 Consider and take action calling for a public hearing on August 17,2004 for a Specific Use Permit request from RFW, Inc. for an office/warehouse facility in the Nell Deane Subdivision, Block 3, Lot 7, located in the AICUZ. Property is zoned GB. City Manager Marquez explained the reason for a public hearing. The issue is based on a requirement due to the facility being in the AICUZ. Councilmember Agee moved to set public hearing date of August 17, 2004 for Specific Use Permit request from RFW, Inc. for office/warehouse facility in the Nell Deane Subdivision, Block 3, Lot 7, located in the AICUZ. Councilmember Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald. NAY: None. #9 Consider and take action calling for a public hearing on August 17,2004 on a request from Hardy & Company, Inc. to rezone 11.867+ acres from General Business (GB) to Residential-5 (R-5). Property is located in the northwest quadrant of Schertz Parkway and Live Oak Road. City Manager Marquez explained the tract is the Bindseil property across from Schertz Parkway. Frontage of property is currently general business, and back of property is zoned R-5. The property must go through the process to rezone the entire tract. Flood plain is a side issue; LOMAR is to get done in the next 6-9 months finalizing the outcome of flood plain issue. Councilmember Greenwald moved to set public hearing date of August 17, 2004 on a request from Hardy & Company, Inc. to rezone 11.867+acres from General Business (GB) to Residential-5 (R-5). Councilmember Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald. NAY: None. #10 Items by City Manager General Announcement . Mentioned a correction to (FYI) letter sent to Dr. Pustka relative to billing of dispatch services amount. Correction of $1,200 instead of $2,500 was corrected. The amount has been paid. . Part of Council FYI is copy of letter relative to the City of Cibolo invoicing dispatch services 2004/2005. . Also, part of Council FYI is a copy of letter sent to residents Mendoza, Chavez, Paurzad and Gordon notifying them of scheduled workshop session of July 28, 2004, discussing the basketball court at the Park of Woodland Oaks. #11 Items by Council General Announcements Councilmember Douglas Liaison EDC Liaison-Schertz Library Board . Reported on an incident that happened behind his house (FM3009) at 6:45 am. Observed that PolicelEMS were fast to response. Traffic was handled quickly, in a highly professional manner. Well #1, casing is leaking, cost is approximately $50,000 for replacement. Might be able to re-coup a portion, is looking into the matter. #12 Items by Mayor General Announcements . Commented plaque dedication for former Police Chief Agee was a very nice presentation. Council moved across the hall, Conference Room for Executive Session. A short break was taken. #13 EXECUTIVE SESSION: Called under Chapter 551 Texas Government Code, Sub-Section 551.074 Personnel Matters: Evaluation of Municipal Court Judge and Evaluation of City Secretary. . An Executive Session was held from 7:30 pm to 10:33 pm. #14 ACTION, if any, on above Executive Session.
