A RESOLUTION SETTING A PUBLIC HEARING TO BE HELD ON THE
ESTABLISHMENT OF A PUBLIC IMPROVEMENT DISTRICT AND
THE ADVISABILITY OF CERTAIN PUBLIC IMPROVEMENTS;
APPROVING AND AUTHORIZING THE GIVING OF NOTICE OF SUCH
PUBLIC HEARING; AND RESOLVING OTHER MATTERS INCIDENT
AND RELATED THERETO
WHEREAS, in accordance with Texas Local Government Code, Chapter 372, as
amended (the "Act"), the City Council of the City of Schertz, Texas, has received a petition
signed by owners of taxable real property representing (a) more than 50% of the appraised value
of taxable real property within the boundaries of a proposed public improvement district and
(b) more than (i) 50% of all record owners of taxable property and (ii) 50% of the area of all
taxable real property within such boundaries requesting the establishment of a public
improvement district to provide funding for a portion of the costs of certain public
improvements; and
WHEREAS, Section 372.009 of the Act provides that a public improvement district may
be established only after the City holds a public hearing on the proposed establishment of the
district and the advisability of the proposed improvements; and
WHEREAS, the City Council hereby finds and determines that a public hearing should
be held on June 3, 2003 to determine whether such public improvement district should be
established and the advisability of the proposed public improvements; and
WHEREAS, notice of such public hearing should be given as required by the Act; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION 1: A public hearing is hereby ordered to be held on June 3, 2003, at 7:00 p.m.
in the City Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas,
on the petition for the establishment of a public improvement district to be known as the
"Schertz 1-35/3009 Public Improvement District" and the advisability of the proposed public
improvements.

SECTION 2: The City Secretary is hereby authorized and directed to cause a notice of
public hearing (i) (in substantially the form of Exhibit A) to be published in a newspaper of
general circulation in the City of Schertz, Texas and (ii) (in substantially the form of Exhibit B)
mailed to the current address of the owner or owners, as reflected on tax rolls, of the property
subject to assessment under the proposed public improvement district, the date of the final
publication of such notice and the date of mailing the same to occur prior to the 15th day before
the date of the hearing. The Notice mailed to property owners as described in (ii) above must be
addressed to "Property Owner".
SECTION 3: It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Texas Government Code, Chapter 551, as amended.
SECTION 4: This Resolution shall take effect and be in full force immediately upon its
adoption.
