CITY COUNCIL MINUTES
SPECIAL MEETING
AUGUST 15, 2004
The Schertz City Council convened in Special Session on Sunday, August
15, 2004 at 2:00 p.m. in the Municipal Complex Council Chambers, 1400
Schertz Parkway, Schertz, Texas. Those present were Mayor Pro-Tern Carl
Douglas, presiding: Councilmembers Steve Simonson, Reginna Agee, Tony
Wilenchik and Ken Greenwald. Absent: Mayor Hal Baldwin. Staff
members present were City Manager Mark Marquez and City Secretary
Norma Althouse.
Mayor Pro-Tern Douglas called the meeting to order.

#1 ORDINANCE: Consideration and approval of an Ordinance calling a
Special Election to be held in the City of Schertz, Texas for the purpose of
voting on a proposition concerning establishing an ad valorem tax ceiling on
resident homesteads of the disabled and of persons sixty-five (65) years or
older and their spouses; making provisions for the conduct of such Special
Election; resolving other matters related to the conduct of such Special
Election; and declaring an emergency.
Mr. Marquez stated, that per instructions, he and the City Attorney, Michael
Spain, have been doing legwork to complete the process.
Mr. Spain informed Council they looked at what would be necessary and
had very little time to get it done. Preclearance for the election has to be
filed tomorrow in Washington D.C. with the Justice Department. City
Council hopes for the largest possible voter turnout. They have before them
an Ordinance which will be Federal Expressed today if they decide to go
with the election.

Mr. Spain went on to say the negative side is that the City of Schertz has
either nine or ten presidential precincts. They will not be able to get all the
judges themselves. lR. Perez, Elections Administrator, can only conduct
elections in Guadalupe County. Schertz, in it's General City Election,
normally has only one precinct. Some of the voterS would have to vote in
two places. The question is do you want to hold this Special Election in
conjunction with the Presidential election, or later.

. Mr. Wilenchik commented that as much as he would like to see It In
November. He doesn't want the precincts to be split up. Some voters who
are unable to get to two places to vote may feel disenfranchised.
Mr. Simonson emphasized they need to get as many voters out as possible.
If that takes waiting until February for the election, then so be it.
After further discussion, Council decided not to take action on the Ordinance
calling for a Special Election.

There being no further business to discuss, Mayor Pro-Tern Douglas
adjourned the meeting at 2:15 p.m.
