A RESOLUTION
OPPOSING HOUSE BILL 64 AND SENATE BILL 339
WHEREAS, the requirement of these proposed Bills that elected city
officials disclose the personal details of their finances, and those of their families,
will have a chilling effect on the willingness of many people to run for office, or
stay in office, particularly in smaller cities; and,
WHEREAS, most elected officials are essentially volunteering their service,
and will no longer volunteer if they must make public some of their most personal
and private information; and,
WHEREAS, mayors and council members, unlike state lawmakers, are
already covered by a conflict-of-interest statute (Chapter 171 if the Local
Government Code) and are subject to a criminal penalty for violating that statute;
and,
WHEREAS, most small cities have a contracted city attorney, it is unlikely
that those attorneys will continue to accept small retainers from small cities if
they must file financial disclosure statements. As a result, many small cities
could be without a city attorney; and,
WHEREAS, the requirements of these bills may make it more difficult for
cities to recruit city managers,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, to oppose House Bill 64 and Senate Bill 339.
