1999R14- INTERLOCAL AGREEMENT FOR EMERGANCY SERVICES RESOLUTION NO. ff- /-/1 RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS APPROVING AN INTERLOCAL AGREEMENT FOR EMERGENCY SERVICES BETWEEN GUADALUPE COUNTY, TEXAS AND THE SCHERTZ AREA FACILITY FOR EMERGENCY SERVICES (S.A.F.E.S.) OF THE CITY OF SCHERTZ, TEXAS. WHEREAS, the City Council of the City of Schertz desires to enter into an Interlocal Agreement for emergency services between Guadalupe County and the Schertz Area Facility for Emergency Services (S.A.F.E.S.) of the City of Schertz; and WHEREAS, the Agreement attached hereto and incorporated herein, for all purposes represents the proposed Agreement between the parties; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Schertz, Texas as follows: 1. The I nterlocal Agreement for emergency services attached hereto is hereby approved. 2. The City Manager is authorized to execute said Agreement on behalf of the City of Schertz. PASSED, APPROVED AND ADOPTED thisjii' ATTEST: ~~~~ City Secretary, City of Schertz (SEAL OF CITY) i;.->r STATE OF TEXAS COUNTY OF GUADALUPE INTERLOCAL AGREEMENT FOR EMERGENCY MEDICAL SERVICES THIS AGREEMENT, made and entered into by and between GUADALUPE COUNTY, a body corporate and politic under the laws of the State of Texas, hereinafter sometimes called "County", acting herein by and through its County Judge duly authorized to so act by and Order of the Guadalupe County Commissioner's Court and the Schertz Area Facility for Emergency Service, duly authorized and existing under the laws of the State of Texas, hereinafter sometimes called "City", acting herein by and through its Mayor duly authorized to so act by direction of the City Council. WHEREAS, Guadalupe County desires to provide Emergency Medical Service to the unincorporated areas of Guadalupe County hereinafter designated to preserve the health and safety of the County and to preserve and protect the citizens of the County; and WHEREAS, the Schertz Area Facility for Emergency Service is willing to furnish equipment and trained medical technicians and services to said unincorporated areas of Guadalupe County for the consideration hereinafter provided; and NOW THEREFORE, in consideration of the mutual covenants, agreements, and benefits to both parties, it is AGREED as follows: I. During the term of this agreement, the Schertz Area Facility for Emergency Service agrees to furnish emergency medical service to that portion of the unincorporated area of Guadalupe County designated on the attached "Exlubit A". II. Guadalupe County agrees to pay the sum of$ 8,333 34 per month to the City for services rendered under this agreement. The County agrees that the sum is to be paid to the City monthly no later than the first day of the month for services in the preceding month. ill. The term of this agreement shall be twelve (12) months beginning October 1, 1999 and ending September 30, 2000. IV. It is hereby agreed and understood that the services to be furnished by the Schertz Area Facility for Emergency Service FIREIEMS under this agreement shall include, but not be limited to, the following: answering all calls for help and assistance in medical emergencies in the area designated in Paragraph I of this agreement; furnishing personnel and apparatus to protect persons and property within the said area which is in need of medical transportation. v. The Schertz Area Facility for Emergency Service FIREIEMS shall observe and comply with all Federal, State, County and City Laws, rules, ordinances, and regulations in any manner undertaken by this Agreement. VI. It is expressly understood that the County has the maximum sum of $ 100,000 00 for Twelve (12) months specifically allocated to fully discharge its obligations under this agreement and it is expressly understood that in no event shall the County be obligated to pay the Schertz Area Facility for Emergency Service more than that sum under the terms and provisions of the agreement. VIT. It is further understood that in the performance of all obligations undertaken by this agreement, the City is an independent contractor with the right to supervise, manage, control, and direct the performance of emergency medical services; the County shall look to SAFE for results only and the County shall have no right at any time to direct or supervise the Schertz Area Facility for Emergency Service FIRFJEMS or its agents or employees in the performance of such services or as to the manner, means, or method'in which the services are performed. vm. The City agrees to furnish the county no later than forty-five (45) days following the starting date of this contract, a monthly reply listing the total number of runs made into the unincorporated area of Guadalupe County designated in Paragraph I of this agreement during each month of the contract term. IX. The Schertz Area Facility for Emergency Service agrees to furnish Guadalupe County a copy of the annual financial audit within thirty days of publication.
