1999R11- INTERLOCAL AGREEMENT BETWEEN GUADALUPE COUNTY, TEXAS RESOLUTION NO. ff-,e-// RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS APPROVING AN INTERLOCAL AGREEMENT BETWEEN GUADALUPE COUNTY, TEXAS, THE CITY OF SEGUIN, TEXAS AND THE CITY OF SCHERTZ, TEXAS. WHEREAS, the City Council of the City of Schertz desires to enter into an Interlocal Agreement with Guadalupe County and the City of Seguin for animal control services; and WHEREAS, the Agreement attached hereto as Exhibit "A" and incorporated herein for all purposes represents the proposed Agreement between the parties; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Schertz, Texas as follows: 1. The Interlocal Agreement for animal control services attached hereto as Exhibit "A" is hereby approved. 2. The City Manager is authorized to execute said Agreement on behalf of the City of Schertz. Mayor, City of Schertz, Texas ATTEST: c~c~ (SEAL OF CITY) EXHIBIT IIAII INTERLOCAL AGREEMENT FOR ANIMAL CONTROL SERVICES This Interlocal Agreement is made by and between the County of Guadalupe, Texas ("County!I), the City of Schertz, Texas ("Schertz"), and the City of Seguin, Texas ("Seguinll). WHEREAS, this Agreement is made under the authority granted by and pursuant to Chapter 791 of the Texas Government Code; and WHEREAS, County, Schertz, and Seguin in of governmental functions described in payments only from current revenues parties; and paying for the performance this Agreement shall make available to the paying WHEREAS, the governing bodies of each party have determined that the proj ect described in this Agreement is necessary for the benefit of the public, that each party has the legal authority to provide and/or perform the functions and services contemplated by this Agreement, and that the provision and/or performance of such functions and services is in the common interest of the parties hereto; and WHEREAS, the parties agree that the division of costs called for by this Agreement constitutes fair compensation to the performing party for the services provided under this Agreement. NOW, THEREFORE, for and in consideration of the mutual promises set forth herein, including the recitations set forth above, the parties agree as follows: 1. The purpose of this Agreement is to provide for animal control services to the unincorporated areas of Guadalupe County, Texas. 2. Schertz and Seguin will provide animal control services to County consistent with services provided within their municipal boundaries. In addition to its current staffing, each city agrees to employ one full time animal control officer and one half-time position for an animal shelter operator to be assigned the responsibilities related to the services and increased operations necessary to comply with this Agreement. Schertz and Seguin further agree that the animal control officer will be available to respond to calls related to dogs in the designated unincorporated areas for forty hours per week. 1 The schedule will be from 8 o'clock a.m. to 5 o'clock p.m. on Monday through Friday. The animals collected will be transported and housed at each city's animal shelter. Rabies quarantine, euthanization, and rabies testing will be conducted by each city in accordance with its policies and state law. 3. In the event that County chooses to renew this Agreement for County's 1999/2000 fiscal year, County agrees to pay to each city the sum of $5,075.00 per month payable on the first day of each month beginning October I, 1999, for reimbursement of operating costs and maintenance of equipment incurred pursuant to this Agreement. 4. Schertz and Seguin agree that when an animal is impounded at a city shelter, a registered animal will be held for five days and an unregistered animal will be held for three days. In addition to the monthly operating payment, it is recognized that certain other costs to the County will be incurred by the cities including without limitation the following: a. Rabies Quarantine $10.00 per day b. Impoundment $ 3.00 per day c. Euthanization Fee $ 2.00 d. Veterinary Services Undetermined County agrees to pay all such costs as provided herein. Each city will invoice the County monthly for such costs in accordance with the above fee schedules. County agrees to reimburse each city the actual costs for any veterinary services required. The costs for rabies quarantine, . impoundment, and all, other authorized fees established by the respective cities shall be charged to and paid by the owner of any dog. 5. In addition to the foregoing, the following costs for other services shall be invoiced by each city to County and reimbursed by County to each city monthly: a. Rabies head removal and shipping $ 30.00 per animal b. Response by animal control officer after regular hours and on weekends $ 35.00 per hour per officer 2 6. This Agreement shall not include the pickup and disposal of any dead animals. 7. The Guadalupe Sheriff Department is hereby designated as the authorized representative of Guadalupe County for dispatching requests for services in accordance with the terms of this Agreement. Animal Control personnel of the respective cities will respond to requests from the Sheriff Department as available. The cities may receive and respond to citizen requests directly during regular business hours, Monday - Friday, but will only respond to a request by the Guadalupe Sheriff Department during other hours. The respective cities and Sheriff Department will coordinate to implement an effective communication system and procedures necessary to carry out the responsibilities assigned in this Agreement. 8. The term of this Agreement shall be from October 1, 1999 to September 30, 2000. The parties agree to evaluate actual costs annually and consider adjustment to payments provided for in this Agreement. Each party hereto will inform the other parties In writing of its determination to terminate this Agreement by September 1 of each year before the end of the current term and each subsequent term.
