REGULAR MEETING
September 27, 2011
A Regular Meeting was held by the Schertz Ciiy Council of the City of Schertz, Texas, on
September 27, 2011, at 4:00 p.m., in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Building #4, Schertz, Texas. The following members present to-wit:

CALL TO ORDER THE NIMS TRAINING SESSION
Mayor Baldwin called the Special NIMS Training Session to order at 4:00 p.m.
Mayor and Council conducted their NIMS Training.
Mayor Baldwin adjourned the NIMS Training Session at 5:30 p.m.
CALL TO ORDER REGULAR MEETING
Councilmem6er George Antuna vas absent for the regular meeting.
Mayor Baldwin called the meeting to order at 6:00 p.m. and welcomed everyone in attendance.
INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED
STATES AND STATE OF TEXAS.
Councilmember Fowler gave the invocation followed by the Pledges of Allegiance to the Flags of
the United States and State of Texas.
PRESENTATIONS
~ Proclamation National Customer Service Week (Mayor/R. Duprat-Waldo}
Mayor Baldwin recognized Director of Purchasing and Asset Management Director Rita
Duprat-Waldo and members of 311 and presented them with a proclamation recognizing
National Customer Service Week.
Prociarnation Fire Prevention Week (Mayor/Chief Covington)
Mayor Baldwin recognized Fire Chief David Covington and members of the fzre department
who were in attendance and presented them with a proclamation recognizing Fire Prevention
Week.

Mayor Baldwin recognized Fire Chief David Covington and Fire Marshal Glen Outlaw who
provided a briefing regarding the current activities of the Fire Department,
CITY EVENTS
Announcements of upcoming City Events (D. Harris/J. Bierschwale)
No announcements were provided at this time.
Hearin of Residents
Mayor Baldwin recognized the following who spoke:
Mr. Steve Larrison, 17305 Bell North Drive, who requested a speed limit change from 20
mph to 30 mph on Bell North Drive. City Management stated that this was an item for the
Traffic Safety Advisory Commission to place on their upcoming agenda for discussion and
consideration. City Engineer Larry Dublin stated that he would get with Mr. Larrison and
get his information.
Mr. Steve White, who provided updated information on the progress of the Veterans
Memorial Plaza venture.
Mr. Robert Brockman, 1000 Elbel, who came forward reporting overgrown vegetation at
the City Hall entrance. He also requested that the doors to the Bob Andrews conference
room be opened prior to the meetings being held there.
Discussion and/or Action Items
Mayor Baldwin recognized Councilrnember Edwards who asked the Mayox if items 1, 5, 6, and 8
could be put on as consent agenda items. Mayor and Council did not have any issues with including
these on consent.
Mayor Baldwin recognized City Attorney Michael Spain who stated that he provided this evening
the #'inal vexsions of the agreements for items 5 and 6.

5. Resolution No. 11-R-45 -Consideration and/or action approving a resolution authorizing a
Professional Services Agreement with Larry Dublin and other matters in connection

6. Resolution No. 11-R-d6 -Consideration and/or action approving a resolution authorizing an
amendment to a professional services agreement with Ford Engineering Inc., and other
matters in connection therewith. (J. Kessel/M. Spain)
8. Cancellation of the October 4, 2011 and October 11, 2011 Regular Council Meetings
- Consideration and/or action cancelling the Regular Meetings of October 4, 2011 and l
October 11, 2011 due to National Night Out and the Texas Municipal League Conference in

Mayor Baldwin recognized Councilmember Edwards who moved, seconded by
Councilmember Carpenter to approve items 1, 5, 6, and 8 on consent. The vote was
unanimous. Motion carriers:
2A. Resolution No. 1X-R-44 -Employee Insurance Benefits- Consideration and/or action
approving a resolution authorizing certain employee health benefit premiums and authorizing
payments of premiums on City insurance benefits to the City of Schertz Employee Benefits

Mayor Baldwin recognized Assistant City Manager John Bierschwale, Human Resource
Director Donna Dykes, and Consultant with Barnard-Donegan, Scott Barnard who
introduced this item stating that action requested of Council approves the City's group
insurance plan to include Brokerage Services, Employee Assistance Program and
Supplemental Insurance in the amount of $1,713,391 far the plan year of January 1, 2012
through December 31, 2012. The amount reflects an 8.12% increase on Medical costs and
a 1.75% decrease for Benefits Trust. The estimated annual increase is $18,2 1. The City
budgeted for an 11 % increase in costs for the upcoming fiscal year. Recommend approval.
Mayor Baldwin recognized Councilmember Scagliola who stated that he was happy that the
estimates came in under the budget projections.
Mayor Baldwin recognized Councilmember Carpenter who stated that he would like staff to
look in to providing information and cast on the possibility of subsidizing the health
insurance and come back to Council in sixty days with the information.
Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by
Councilmember Edwards to approve Resolution No. 11-R-44. The vote was
unanimous. Motion carried
CONVENE MEETING OF CITY OF SCHERTZ EMPLOYEE BENEFITS TRUST
Mayor Baldwin convened the meeting of the City of Schertz Employee Benefits Trust at 7: Q6 p.m.
2B. Resolution of City of Schertz Employee Benefits Trust -Consideration and/or action
approving a resolution regarding renewal of Group Medical, Dental, Vision, Life,
Supplemental and Employee AssistanceProgram. {D. Dykes/J. KessellM. Spain)
Mayor Baldwin recognized City Attorney Michael Spain who introduced this item stating
that action requested of Council directs any preriums that the City deposits to the
Employee Benefits Trust for employee benefits to be paid to the appropriate insurance
carriers for the plan year January 1, 2012 through December 31, 2012. The trust enables
the City to save state fees on these benefts. Recommend approval.
Mayor Baldwin recognized Councilmember Carpenter who moved, seconded by Mayor
Pro-Tem Fowler to approve a resolution which directs any premiums that the City deposits
to the Employee Benefits Trtast for employee benefits to be paid to the appropriate
insurance carriers for the plan year January 1, 2012 through December 31, 2012. The vote

Mayor Baldwin adjourned the meeting of the City of Schertz Employee Benefits Trust at 7: 09 p.m.
and reconvened back into the regular meeting.
3. Utility Billing Revenue Adjustments -Consideration and/or action approving the Utility
Billing Revenue Adjustments. (J. BierschwalelC. Spence) ,
Mayor Baldwin recognized Utility Billing Manager Carol Spence who introduced this item
stating that action requested of Council approves write-off of $7,603 of uncoIiectable
Water, Sewer, Garbage, and Drainage accounts for the period of July 1, 2010, through
September 30, 2010. Recommend approval.
Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by Mayor Pro-
Tem Fowler to approve the -write-off amount of $7,603. Vote was unanimous. Motion
carried.
4. EMS Revenue Adjustments -Consideration and/or action approving the EMS Revenue
Adjustments. (J. Bierschwale/D. Wait)
Mayor Baldwin recognzed EMS Director Dudley Wait and EMS Billing Manager Allison
Gorzell who introduced this item stating that action requested of Council approves the
revenue adjustment of $784,446 of uncollectable EMS private pay accounts and internal
billing procedures for the period of July 1, 2010, through September 30, 2010. Recommend
approval.
Mayor and Council discussed the need to bring the EMS revenue adjustments quarterly to
Council.
Mayor Baldwin recognized Councilxnember Edwards who moved, seconded by
Councilmember Scagliola to approve the revenue adjustment amount of $784,446. Vote was
unanimous. Motion carried.
Mayor Pro-Tem Fowler left the dais.
7. Ordinance No. 11-D-29 -Consideration and/or action approving Ordinance 11-D-29
amending the City of Schertz Code of Ordinances Section 56-149, parking prohibited,
providing a repealing clause, and declaring an emergency. First and Final Reading (M.
Spain)
Mayor Baldwin recognized City Attorney Michael Spain who introduced this item stating
that action requested of Council authorizes curbs to be painted red with "No Parking" painted
in white letters thereon when "No Parking" signs are erected and/or, when recommend by the
City Engineer or the Chief of Police. This will allow enforcerr~ent of the "No Parking"
Ordinance in the event that a sign be removed. Fiscal impact is undetet7nined at the time of
this writing. Recommend approval.
Mayor Baldwin recognized Councilmember Carpenter who moved, seconded by
Councilmember Scagliola to approve Ordinance No. 11-D-29 declaring an emergency and
approving first and final reading. The vote was unanimous. Motion Carried.
Mayor Pro-Tem Fowler returned to the dais. ~,
Mayor Baldwin announced there was no need to meet in executive session this evening.

Called under Section 551.071 Texas Government Code Litigation, pending or contemplated

No action as Council did not meet.
Re nests and Announcements
10. Requests by Mayor and Councilmembers that items be placed on a future City Council
agenda.
Mayor Baldwin recognized Councilmember Carpenter who stated as earlier requested he
would like to have a presentation by management and human resources staff regarding the
option to subsidize the cost for employee health care in future years at a time of the staff `s
choosing in the next sixty days.
11. Requests by Mayor and Councilmembers to City Manager and Staff for information.
Mayor Baldwin recognized Mayor Pro-Tem Fowler who stated that this item was discussed
at the Parks and Recreation meeting last night for a need of a family event or something
specifically for families other than Schertz Fest ar 4t~' of July event. He suggested things
like a father son three legged race, an event more geared to where the families could
participate. Assistant City Manager John Bierschwale stated that he would discuss this with
the Parks and Recreation Foundation to gather ideas and bring back information. He
reminded Council that this year at the 4`h of July event they brought back kids zone, the
music and of course the carnival as well as the barbecue.

Mayor Baldwin recognized Mayor Pro-Tem Fowler who stated he participated in the
celebrity waiters event at Chili's this past Monday, where the proceeds and donations went
to St. Jude's Children's Hospital. He stated that the time he picked from 2 pm to 4 pm the
place was dead, but that he was able to meet with Steve Latxison and speak with him
regarding his street and told him he could come to Council as he did this evening.
Mayor Baldwin recognized Cauncilmember Scagliola who stated that he was able to take
Miss Schertz and her mom to the Corral County Parade this past Friday. He also stated
that the SchertzFest event this year was wonderful and he thanked all those involved in
making it such a great success.

Mayor Baldwin recognized Councilmennber Carpenter who also stated the attended the
SchertzFest event and commented"on how the barbecue event continues to grow and
congratulated the staff for its success.
Mayor Baldwin also stated that he attended the SchertzFest event and wanted to say thanks
to Mrs. Scagliola who worked out at SchertzFest on both days.
Mayor Baldwin stated that he and Assistant City Manager David Harris attended Bexar
County Commissioners Court today and is pleased to announce that the monies set aside
for the completion of Loop1604 were left in tact.
13. Announcements by City Manager
Mayor Baldwin recognized City Manager John Kessel who provided the following
infozmation:
• Recognized the great business community partnership Schertz has and thanked the
businesses that sent numerous volunteers to serve and help out at the SchertzFest,
• Recognized the Library and read a letter fiom a resident thanking the Library staff in
hosting the recent computer classes which are held there,
• Reminded Council that he would be taking the next two days as vacation.
Mayor Baldwin recognized City Engineer Larry Dublin who stated that this is his last official
Council meeting attendance; he thanked the Mayor, Council, and Staff for the opportunity of
working with the City,
Mayor Baldwin recognized Assistant City Manager David Harris who reminded the Mayor
and Council that this Thursday evening, September 29, 2011, from 4:00 p.m. to 6:00 p.m.,
they will be hosting a small retirement parry for Larry Dublin at the Civic Center.
