A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AUTHORIZING INCREASING RTM
CONSTRUCTION CO., LTD`S CONTRACT FOR THE AVIATION HTS.
WATERLINE UPGRADE PHASE IV PROJECT FROM $279,896.00 TO
$349,042.05.
WHEREAS, the City staff of the City of Schertz (the "City") has recommended that the
City recommends that Council approve the revised constriction amount; and
WHEREAS, the City Council has determined that it is in the best interest of the City to
contract
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
THAT:
Section 1. This project was included in the FY2010-11 budget as a line item in the
Water Operating account as Aviation Heights waterline Upgrades, Phase IV improvements in the
amount of $400,000.
Section 2. On March 29, 2011, Council awarded the waterline improvements on
Windburn and Brooks avenue to RTM Construction Co., with a base bid of $279, 896.00.
Section 3. On May 3, 2011 change order number 1 was approved by the City
Manager to add 655 feet of additional waterline and service work in the amount of $61,057.35.
Section 4. Change order number 2 is a reconciliation to account far the over/under
runs on the unit resulting in a net increase of $8,088.70, and is pending approval.
Section 5. The City Council hereby authorizes the City Manager to approve change
order number 2 increasing the contract amount to RTM Construction Co., LTD's from
$279,896.00 to $349,042.05.
Section 6. All resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Rcsolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved herein.
Section 7. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
Section 8. If any provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Resolution and the application
of such provision to other persons and circumstances shall nevertheless be valid, and the City
Council hereby declares that this Resolution would have been enacted without such invalid
provision.
Section 9. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, alI as required by Chaptex 551, Texas Government Code, as amended.
Section 10. This Resalution shall be in force and effect from and after its final
passage, and it is so resolved,
