12-R-02A Designating the City's Official NewspaperRESOLUTION NO. 12-R-02A A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS DESIGNATING THE CITY'S OFFICIAL NEWSPAPER AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, Ordinance No. 78-M-22 requires the City Council, by Resolution, to designate a public newspaper of general circulation in the City of Schertz as the City's official newspaper; and WHEREAS, by Resolution No. 10-R-02, the City Council (i) designated the Daily Commercial Recorder for the publication of legal notices and other City notices and advertisements through September 30, 2010 and thereafter for the 2010-2011 fiscal year if the City Council takes no contrary action; and (ii) designated the Northeast Herald as the secondary newspaper for City publication; and WHEREAS, the Daily Commercial Recorder and the Northeast Herald have agreed to maintain the rates that they charge the City for publication of notices tluough December 31, 2013; and WHEREAS, the City Council has determined that it is in the best interest of the City (i) to continue the designation of the Daily Commercial Recorder as the City's official newspaper for the publication of legal notices and other City notices and advertisements through December 31, 2013; and (ii) to continue the designation of theNortheast Herald as the secondary City publication. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council of the City of Schertz, Texas, hereby (i) continues the designation of the Daily Commercial Recorder as the City's official newspaper for the publication of all official legal notices and other City notices and advertisements through December 31, 2013; and (ii) continues the designation of the Northeast Herald as the secondary newspaper for City publications through December 31, 2013, pursuant to the terms approved by Resolution No. 10-R-02. Section 2. The City Secretary is directed to provide a copy of this Resolution to the Daily Commercial Recorder and the Northeast Herald to evidence the City's continued designation of the Daily Commercial Recorder as the City's official newspaper and the Northeast Herald as the City's secondary newspaper. Section. 3. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 4. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. 50295795.1 A-1 Section 5. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 6. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the Ciry Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 7. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 8. This Resolution shall be in force and effect from and after its final passage, and it is so resolved. PASSED, APPROVED, AND ADOPTED, this 10th day of January, 2012. The Daily Commercial Recorder and the Northeast Herald agreed to the following pricing: Service Standard Prices Discounted Prices Offered to the City Savings Per line $2.81 $2.34 $0.47 Per inch $29.30 $21.80 $7.50 Y4 page $433.80 $327 $106.80 The pricing agreement is up for renewal. The publications have agreed to maintain the above pricing tluough December 2013. Resolution No. 12-R-02 continues the designation of the Daily Commercial Recorder as the City's official newspaper and the Northeast Herald as the City's secondary newspaper through December 31, 2013, pwsuant to the above pricing. FISCAL IMPACT The pricing for City publications will remain the same tluough December 31, 2012.
