2006R05-PID RESOLUTION NO. 06-R-05 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS EVIDENCING PRELIMINARY INTEREST IN THE ESTABLISHMENT OF A PUBLIC IMPROVEMENT DISTRICT TO AID DEVELOPMENT OF AN EXPANDED BUSINESS PARK WHEREAS, the City Council (the "City Council") of the City of Schertz, Texas (the "City") supports industrial and commercial growth, development, and success in the City in many ways, including through its involvement in the Tri-County Business Park, which is the home to several vital industrial and commercial businesses in the City; WHEREAS, Tri-County Business Park is reaching capacity, and the City recognizes that it will aid business growth and development in the City if an additional or expanded business park can be developed; WHEREAS, the City's Department of Economic Development and several property owners adjacent to Tri-County Business Park have discussed the possibility of property owners petitioning the City to create a Public Improvement District which could, among other matters, assist in the development of drainage, roadway, and similar projects which could aid the development of such an expanded business park; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby desires to evidence its preliminary interest in the establishment of a Public Improvement District to aid the development of an expanded business park in the City in the area generally described on Exhibit A hereto. The creation of such a Public Improvement District must be in compliance with all requirements of applicable law, subject to review of and recommendation regarding the proposed project and financing plans by the City Manager and his staff, the City Attorney, the City's fmancial advisor, and the City's engineer, followed by City Council review and action based on their recommendations. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the Council hereby declares that this Resolution would have been enacted without such invalid provision. 20153997.1 Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, as amended, Texas Government Code. Section 7. This Resolution shall be in force and effect from and after its fmal passage, and it is so resolved. PASSED AND ADOPTED, this 7t!l. day of March, 2006.
