12-R-42 Ford Engineering Waterline Relocation Woman Hollering CreekRESOLUTION NO. 12-R-42 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH FORD ENGINEERING, INC., RELATING TO ENGINEERING, DESIGN AND HYDRAULIC STUDY FOR WATERLINE RELOCATION ON FM 1518 AND WOMAN HOLLERING CREEK AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, the City staff of the City of Schertz (the "City") has determined that the City requires professional services relating to engineering, design and hydraulic study for the Waterline Relocation on FM 1518 and Woman Hollering Creek TX-Dot Bridge Improvements ; and WHEREAS, City staff has determined that Ford Engineering, Inc. is uniquely qualified to provide such services for the City; and WHEREAS, pursuant to Section 252.022(a)(4), the City is not required to seek bids or proposals with respect to a procurement for personal, professional, or planning purposes; and WHEREAS, funds for this project are to be appropriated in the budget and $150,000 will be transferred in from the Water & Sewer Fund Balance; and WHEREAS, the City Council has determined that it is in the best interest of the City to contract with Ford Engineering, Inc. pursuant to the Engineering Services Agreement attached hereto as Exhibit A (the "Agreement"). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby authorizes the City Manager to execute and deliver the Agreement with Ford Engineering, Inc. in substantially the form set forth on Exhibit A. Section 2. The recitals contained in the preamble hereof are hereby found to be hue, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be conshued and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or• the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required liy Chapter 551, Texas Government Code, as amended. Our understanding of the scope of work is generally as follows: Ford Engineering Inc will provide necessary civil engineering professional consulting services for tfie City to bid and wnstruct the relocation of the 12-inch water line on FM 1518 at Woman Hollering Creek to remove it from conflict with proposed TxDOT improvements, as well as drainage improvements immediately downstream of the creek crossing. Pro'eci t Scone In order to facilitate the delivery of said project, Ford Engineering Inc will provide the topographical survey of the existing site, adjacent eastern propertylexisting water line easement, and TXDOT right-of--way to determine locations of existing utilities and pertinent topographic features. It is understood that TXDOT has plans for the creek crossing reconstruction, and that any CAD files and hard copies of the plans available to the City will be provided to Ford Engineering Inc, within a reasonable time frame to aid in our design. The City will provide `potholing' services to locate the existing water lines. Ford Engineering will prepare a drainage analysis and design calculations for the downstream drainage improvements. The desigo will be incorporated to the construction plans and a report will be compiled for submittal and review. Ford Engineering will prepare a set of construction plans, specifications, and quantity estimate, for review, approval, and construction with associated details par the standards indicated in Statement of Work. Plans and specifications will be in conformance with City of Schertz standards of construction and materiels. Plans will include the pipe line layout' pipe profiles (as required), channel improvements, and details for construction. Ford Engineering will prepare the necessary exhibHs to facilitate the obtaining of a TxDOT utility and drainage permit, and a City of Schertz Flood Plain permit. Ford Engineering will have a representative available for pre-construction and periodic project meetings during construction. When the construction stakes have been set, the preservation of such stakes as to position, elevation and marking shall become the responsibility of the contractor. After construction has been completed and work approved by the Owner, Ford Engineering will incorporate any changes made during construction, as indicated by the contractor on a marked up set of plans, into a set of Project Record Drawings. Engineering Fee Compensation for these services will be in the amount of $22,000.00 which will cover all costs associated with the scope described above. The above engineering fee is based on a discussion with the City that a Jurisdictional Determination (JD) has been made on the creek at this point, and the original high water mark (OHWM) has been established, and there will be no disturbance within the limits of OHWM. It is also understood that the area to receive channel improvements has had an environmental site assessment (ESA) completed which indicates no endangered species or wetlands associated with the project. The City will supply Ford Engineering with these documents. If these documents are not available, it will i>a considered additional services for Ford Engineering Inc. to obtain the JD, ESA, and any additional permitting not stated above. Additional services and significant changes will be compensated for as provided by Attachment 1 to the Second Amendment to agreement for Engineering Services between the City of Schenc~ and Ford Engineering, Inc. dated April 1, 2012 (the "Second Amendment). Further, the services described in this letter shall be subject to the terms of the Agreement For Engineering Services between the City of Schertz and Ford Engineering, Inc. dated February 9, 2010, as amended by the First Amendment to Agreement for Engineering Services dated October 1, 2011 and the Second Amendment.
