HEARING OF RESIDENTS Steve Layton, 12311 Lost Meadows Drive, gave a brief presentation to explain his evaluation of tlae flood study area of Laura Height, Ivy Estates and Hunter Estates. CONSENT AGENDA: A. Minutes for March 28, 2012. After the reading of the Consent Agenda, IVIr. Jacobs moved to approve the item. Mr. Crawford seconded the motion. Vote unanimous. Motion carried. PC2012-OI6 Hold a public hearing, consider and act upon a request 6y Laura Heights Estates, L.P.IHariy Hausman far approval of a preliminary residential replat fog' a portion of Laura }-(eights Estates, Unit 4 subdivision and a preliminary plat for Ivy Estates Subdivision, The property consists of approximately 0.310E acre tract out of Laura Heights, Unit 4, recorded in Volume 9625, Pages 122- Minutes Planning and Zoning Commission Apri] 25, 2012 Page 1 0['4 123 deed & plat records, Bexar County, City of Schertz, Texas and a 35.$I90f acre tract of land out of the remaining portion of an originally called 153.65 acre tract as recorded in volume 2627, page 140 deed records, Bexar County, Texas and is generally located approximately 764 feet south of Leslie Heights intersecting with Hallie Heights. The property is zoned Residential Agricultural (~)- Public Hearing opened at 6:04 pm. Ms. Sanchez explained that this item considers a request a preliminary residential replat for Laura Heights Estates and a preliminary plat for Ivy Estates Subdivision, property consisting of approximately 0.310 acre tract out of Laura Heights, Unit 4 and 35.8190 acre tract of land, creating 30 residential lots with a minimum lot size of 21,780 square feet. The Future Land Use Plan designates this property as Air Installation Compatible Use Zone {AICUZ}. The site is zoned Single Family ResidentiallAgriculture (RA) and is generally located east of Graytown Road. City Council approved a development agreement { 12-R-27) between the City of Schertz and the Developer of Hold'Em Investments, LLC and The Reserve at Schertz, LLC on April 17, 2012 for the purpose of establishing two points of access and a temporary construction roadway for the development of Hunter Estates and Ivy Estates Subdivision. The local street Laura Bluff will be constructed within the Hunter Estates Subdivision and connect to Ivy Flower in the Ivy Estates Subdivision and will ultimately feed to the Laura Heights Estates Subdivision. This connection will provide unproved traffic flows for both the residents and emergency services. The agreement includes a temporary construction connector access roadway over the 30' construction entrance easement through the adjacent property to ensure that all constructiona•elated vehicles da not access the Laura Heights Subdivision. She commented on the public services, public improvements, parks, tree mitigation and the master thoroughfare plan. Mr. Richmond recognized the following to speak: • David Earl, Earl and Associates, explained the agreement, two points of access and compliance with the Unified Development Code (UDC). He commented on the maintenance to the streets in Laura Heights and the temporary construction roadway. Public Hearing closed at b:25 pm. Mr. Richmond expressed concerns on the time table of 270 days for tlae road construction and. the ability to obtain a building pennit and certificate of occupancy. He commented that the agreement does not address homes being completed before the road construction is complete. Mr. Earl responded by explaining the bonding requirements far streets to ensure that the streets are built. Mr. Evans commented on the UDC requirements of two points of access for all subdivision. Ms. Sanchez explained the recording of the final plat and that building permits would be issued but would not be executed until the second access is completed. Mr. James explained that there may be occupancy of homes in Hunter Estates before the construction of the ~•aad. Mr. Evans expressed his concera~s with the consolidation of tl~e Laura 1-Ieights replat and Ivy Estates preliminary plat. Discussion followed between the applicant, staff and Commission on the drainage. Mr. Braud moved to approve this item. Mr. Greenwald seconded the motion. Vote was 611 with Mr, Evans voting nay. "for Cypress Point Subdivision Unit 1, consisting of 31.576 acre tract of land out of the C.M. Gahagan Jr. Suevey No. 258, Abstract No l42 Guadalupe Cotmty Texas and Abstract 182, Comal Couirty Texas. This property is generally located near the intersection of IH 35 and Eckhardt Road Minutes Planning and toning Commission April 25, 2012 Pagc 2 of ~ (Formerly known as Tanglewood Park) and is zoned GB and R-7. Ms. Sanchez explained that this item considers a final plat approved in 2001 on this site for the subdivision known as Tanglewood Park. Construction began on the infrastructure but was not completed and worked stopped for about 7 years, The project was rezoned to General Business, R-7 for Units 1 and 2 and R-6 for Units 3 and 4 of what is currently Cypress Point Subdivision on July 6, 2010. The final plat was approved on October 27, 2010 and construction began again with a new street and lot layout. The infrastructure for the subdivision is mostly complete except for Eckhardt Road and the waterline that runs along the perimeter of the property. The applicant is requesting a waiver to the subdivision ordinance is to allow the plat to be filed and building permits issued with the condition that they agree to complete within a set time period. Staff recommends approval for a waiver with the condition that die developer enter into a subdivision agreement providing surety and a set time frame such as two years for completion of the public improvements which would allow the plat to be filed and building permits to be issued. Mr. Evans asked why the request, what is the hardship and suggested time frame. Mr. Blanton explained some of the reasons being improvements to Eckhardt Road and waterline construction. Mr. James explained that the agreement is in the best interest of the City and the Developer. This would allow the City to work with the Developer to establish the required improvements. Discussion followed between the applicant, City staff and the Commission on the construction of the street and time frame far the waiver. Mr. Crawford moved to approve this item with a waive~• for a two year time frame. Mr. Greenwald seconded the motion. Vote was unanimous. Motion carried. B. PC2012-022 Consider and act upon a request of a final plat of Hunter Estates Subdivision, consisting of 24.269+ acres of land containing 30 buildable residential lots located east of Graytown Road. This property is currently zoned Residential Agriculture (RA}. Ms. Sanchez explained that this item considers the request for a final plat for Hunter Estates Subdivision, consisting of 24.269 acres of land awned by The Reserve at Schertz, LLC, creating 30 residential Lots with a minimum lot size of 21,7$0 square feet. She explained the background in the project from the Plam7ing and Zoning preliminary plat disapproval, appeal of the Planning and Zoning Commission decision to the City Council, to the City Counci] approved development agreement. The applicant is providing a dedication for the 86' Right-of--way as identified on the Master Thoroughfare Plan {MTP} and landscape buffers for the proposed Lazar Parkway; the alignment has been adjusted based on an agreement with the Interim City Engineer, Director of Development Services and City Management.
