A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on May 22,
2012, at 6:00 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building

Mayor Pro-Tern Scagliola called the meeting to order at 6:00 p.m. and welcomed everyone in
attendance.

Mayor Pro -Tem Scagliola recognized Executive Assistant Sarah Gonzalez who stated
that action requested of Council approves the recipients of the Hal Baldwin Scholarship:
Caitlin Baumgarten $2,500 and Brandi Brinkman $1,250, as per the recommendation by
the Hal Baldwin Scholarship Advisory Committee. Staff recommends approval.

Mayor Pro -Tem Scagliola recognized Councilmember Fowler who moved, seconded by
Councilmember Carpenter to approve Resolution No. 12 -R -38. The vote was
unanimous. Motion carried.
Mayor Pro-Tern Scagliola introduced Barbara Baldwin who came forward and presented
the scholarships. Mayor Pro -Tem Scagliola introduced the members of the Hal Baldwin
Scholarship Committee. Members commented how proud they are of the young ladies
and thanked all the young men and women that participated in the process.

Mayor Pro-Tem. Scagliola recognized. EMS Director Dudley Wait who provided a
briefing regarding the EMS Department and their activities. Mr. Wait recognized
members of the EMS Team who were present. Mr. Wait also recognized and provided
success stories of two special patients: Mr. Ronald Pretorius and Mr. Kevin Kline. Mr.
Kline and his family were presented a Certificate of Life from the EMS Department.

Hearing of Residents
This time is set aside for any person who wishes to address the City Council. Each person should fall
out the speaker's register prior to the meeting. Presentations should be limited to no more than 3
minutes. Discussion by the Council of any item not on the agenda shall be limited to statements of
specific factual information given in response to any inquiry, a recitation of existing policy in
response to an inquiry, and/or a proposal to place the item on a future agenda. The presiding
officer, during the Hearing of Residents portion of the agenda, will call on those persons who have
signed up to speak in the order they have registered.

Worksession Items
• Presentation regarding Fairhaven home construction and development concerns (30 minutes)

Mayor Pro -Tern Seagliola provided opening comments and recognized Executive Director of
Development Brian James. Mr. James reviewed the procedures of how the worksession
procedures would follow this evening. Mr. James introduced Ms. Molly Casas who provided
brief comments. Ms. Casas introduced Attorney Bryan A. Woods, 8626 Tesoro Drive, Suite
500, San Antonio. Mr. Woods indicated that he is an attorney and has been practicing in San
Antonio for 30 years. Mr. Woods stated he was here to answer any questions Council may
have and that he does not represent anyone who is here and is only a resource.
Mr. Woods mentioned the goals of the City: quality of life, and the second goal is
sustainability of economic prosperity, and that is exactly what the proposed ordinances are
about. He stated that the quality of construction that he has seen in his practice is extremely
important to a community. What drives property values? What is the essence of property
values? Pride of ownership! When you have pride of ownership you maintain your property.
When you have extra money you improve your property. When you loose that pride of
ownership, you second guess those decisions and ask yourself am I going to get the money
back on the back end. Therefore, .maintenance suffers and people quit maintaining their
property. Communities as a whole suffer. He spoke about the area in Windcrest where some
areas have eroded considerably, in part he believed was due to poor construction. If this
continues the area diminishes in value. Owner occupancy suffers. This affects the City
because your tax base decreases, property values go down. Businesses are no longer
attracted to the area. Schertz is a hot area right now and what he is talking about is
something that could happen five years from now. The proposed ordinances are to protect
the integrity of the quality of life for the residents and citizens as a whole.
Mr. Woods also spoke about his experience being in the military and when transferred they
were concerned about selling their home. If they couldn't sell, they would have to rent it out.
He also spoke on what if the individual was shipped out overseas and the spouse was left to
contend with the problems that some of the residents are having. He stated that this is a
military issue. It's a military readiness issue. If you are overseas and your spouse is having
to deal with the problems some of the residents are having, how would you perform your
duty? Mr. Woods urged the Council to exercise their proprietary function and discretionary

function to ensure quality of construction. The ordinances proposed are about if you build
quality they will come.
Ms. Casas introduced Licensed Professional Inspector Mr. Mark Eberwine with Five Star
Home Inspections Inc. Mr. Eberwine stated that he has been a property inspector for the past
twenty -five years. Mr. Eberwine spoke to the Council regarding perspective. Mr. Eberwine
addressed the Council about the soils in Texas and how builders are building homes on soils
with no problems and then those that do have problems. He stated that builders get it right a
lot. Why are builders getting it wrong in so many subdivisions? Mr. Eberwine spoke about
the different types of foundations and the type of foundations that are needed in the types of
soils in Texas. He talked about did you need to water around your foundation to keep it from
shifting or would this prevent it from shifting? His answer was No! He talked about the
builders and their profits. Building the foundations properly will not drive their profits down,
if you divide them by the number of homes they build. Mr. Eberwine stated that
undeveloped land is an asset to the City and once the land is developed it continues to be an
asset or a liability. Mr. Eberwine gave an example of the foundations in Kirby. Mr.
Eberwine requested that the Council beef up their inspection divisions and have an
independent engineer to challenge some of the engineering drawings that are coming into the
City. He concluded stating that 20% of structural failures that occur in the United ,States
occur in the State of Texas, not because the soils are different, it's because we have different
practices.
Mayor Pro -Tem Scagliola recognized Mr. Ryan Mahoney who provided the following
proposed ordinances and questions to Council:
Ordinance: $25,000 Surety Bond:
• The City shall provide a homeowner's complaint process to report construction
defects during the first 2 -years and any major construction defects for a 10 -year period.
During the first two years the City shall provide homeowners with the necessary
information and procedures to file a claim against the builders' Surety Bond if the builder
fails to make repairs.
• The City of Schertz shall create a resident complaint process and builder complaint
form.
• Builder and seller shall inform the homebuyer of the City's complaint process at the
time the purchase contract is signed and before money changes hands and again at
closing.
At the request of homeowner, the City Inspection Service Department shall record
construction defects including any health, safety, and welfare issues brought to its
attention by the owners or occupants.
Ordinance: Disclosure - Homebuilder Full Disclosure with informed Consent
Requirement:

• Before any legally binding contract is executed, and before any money. is exchanged:
(1) the buyer must receive from the homebuilder/ seller a full disclosure of the
benefits, warranties, building standards, risks, and hazards of the particular home to
be purchased; (2) the buyer must receive from the homebuilder /seller full disclosure
of any mandatory alternative dispute resolution provisions; and (3) the buyer must
then consent in writing to accept the terms of the homebuilder's disclosures and
provisions for new home construction by placing the buyer's signature and date to the
document.
• Full Disclosure of All Building Plans: The builder and seller shall provide full
disclosure by providing the blueprints, floor plans, drawings, and building plans of
the property to the potential buyer. These plans shall include any engineer plans with
an official seal. All plans shall be provided before closing in hard copy or electronic
format to the homebuyer, including phase I and/ or phase II, as well as any other
environmental reports throughout the developmenticonstruction phase, through the
final construction of the property. The builder and seller shall provide the potential
buyer a Builder's Certification of Plans, Specifications, and Site; HUD Form 92541
or its equivalent, certifying compliance with the Code of Federal Regulations,
24CFR200.926(d).
• Contractor and Subcontractors Disclosure: Builder shall provide a complete list of all
contractors and subcontractors who worked on the home — by address and legal
description — to the homebuyer and the City of Schertz.
• The City of Schertz shall adopt the Code of Federal Regulations HUD CFR24
200.926(d) as a standard of development and a Builder Certifications equivalent to
HUD Form 92541.
• The City shall incorporate the services of the Texas Commission on Environmental
Quality (TCEQ), to specify and/or approve mitigation procedures and proposals to
mitigate environmental hazards which exist on or offsite of the property during the
development and construction phase of the property as specified in HUD CFR24
200.926(d).
Ordinance: Engineered Foundations:
• Requirement to obtain a permit to build a house: Homebuilder/Developer shall
provide an engineered design set of foundation plans — by address and legal
description — containing the seal of the engineer and certifying that the home's
foundation has been engineered to withstand any and all the hazards, including water
hazards and/or soil conditions on which the home is built; that contributes to damage
of walls, windows, flooring, plumbing, electrical, and other related components of the
house.

• All engineered foundations shall be designed based on a separate and unique core
boring sample for each lot.
Ordinance: Discontinue engineering entire house and engineered trusses
Stick building shall be the standard of construction instead of engineered components
for all new home construction.
• The City of Schertz shall amend International Building Code (IBC) to prohibit
engineered components, with the exception of the foundation.
Ordinance: Maintain Public Records
• The City of Schertz shall maintain for historical purposes all public records of all
inspection approvals, all plans including phase I and/or phase Il environments
assessment through final construction of all homes within the City of Schertz. This
requirement shall survive the issuance of all Certificates Of Occupancy's issued to the
property.
• The City shall maintain all plat approval, including phase I and/or phase II
environmental assessment for subdivision development approvals within the Extra
Territorial Jurisdiction (ETJ).
Mx. Mahoney provided Council with the following questions:
1. Do you think the pictures displayed are "normal" for new homes?
2. Does the Council support the idea of requiring builders to have a surety bond in
conjunction with the licensing requirements?
3. Does the Council agree that builders should have to provide full disclosure, similar to
those required of realtors and homeowners, when they sell an existing home?
4. Does the Council support engineered foundation plans specific to each new house in
Schertz?
5. Does the Council support requiring builders to build stick houses vs. using engineered
components that have not been engineered to necessarily work together?
6. Does the Council support maintaining plan and plat approvals, along with environmental
assessments for the period the Certificate of Occupancy is issued?
7. Does the Council support efforts to create a home lemon law in the City of Schertz?
$, Can the City pull Pulte's license for homebuilding in Schertz? If no, why not?
9. Why have ordinances if they are not enforced?
Recommendation: The City should engage the Attorney General to investigate the issues concerning
Fairhaven. Will you formally invite Pulte to be placed on a future City Council agenda to answer
any questions you have remaining? How soon can these ordinances be drafted up for Council
consideration, and done in a matter than can avoid citizens from having to resort to litigation?
Knowing what you know and if you were put in this position, what would you do in our situation?

Mayor Pro -Tom Scagliola recognized Ms. Molly Casas who stated the reason the citizens are here
tonight is that they do not want this to happen again. That is the reason they presented the
ordinances. If there are concerns regarding the ordinances presented, she would like to know and it
can be addressed. Ms. Casas stated that City Manager John Kessel has a list of items to address
regarding foundation issues in terms of possible ordinance changes. She stated she mentioned last
week that she would like the City to eliminate the issue of the water requirement for the foundations.
She also stated you can't let builders build foundations that need watering and wants this issue
addressed with builders and do not allow them to build minimum standard foundations. She stated
she knows the City wants to help and reiterated this is not a City issue; this is a State and Federal
issue and we need their help. She requested the Council and City Manager also write letters and
make phone calls to the Federal and State Agencies regarding the problems the residents are having.
HUD says that builders are required to ensure that foreseeable hazards such as springs and expansive
soils do not affect the foundation. However, when the citizens receive their warranty under the
disclosure, it says any problems caused by springs or expansive soils and other foreseeable hazards
listed on the HUD form is not covered under a warranty. This is unacceptable. She stated that Pulte
did this because they were allowed to do this. There is nothing in place in the City, State, or the
Federal Government to hold them accountable. Ms. Casas asked the Council to look at other states
that require bonds and believes this is a good idea.
Mayor Pro -Tem Scagliola recognized Ms. Janet Ahmad who stated that these suggestions have been
taken to Commissioner Wolverton who will be providing these to the State. She expanded on the
Lemon Law and that it has a long history of keeping individuals out of court. The citizens tonight do
not have access to the courts and that is why they are here. They signed binding arbitration
documents and even if you get to court, the building industry has skewed the consumer rights. If the
City passed a home lemon, law, this City would stand out. People and businesses would flock to the
City because they would know that the City is protecting the consumer when they buy the most
expensive purchase of a Iifetime. There is not a state agency that the residents can go to regarding
substandard building. It was abolished many years ago, and it needs to start at the city level. The
ordinances presented are a simple solution to a very serious problem. The bond is essential and if a
person can not afford the bonds, then they shouldn't be building in the City.
Mayor Pro -Tem Scagliola thanked everyone who spoke this evening and ended with a closing
statement. He stated that there are those that have accused the City and the City Council of all
manner of impropriety, of not caring for the residents, and doing absolutely nothing to help.
Unfortunately for some, the definition of caring and doing something rests with the City forcing the
developer to buy back their homes. That's their only definition of caring and doing something. In
his view, that is too narrow of a definition. There are other ways to show caring, to share concern.
In his opinion this Council and the City got engaged in the process and he believes they are moving
in the right direction. The message he sent a while back was loud and clear. Honor the warranties,
and fix the problems and not the symptoms to the problems. Let these people feel pride in their
homes. If you can't fix it, own up to it, and buy the home back. That's the message he sent. Legally,
he can not make that happen.
Mayor Pro -Tem Scagliola stated that we have a lot more information now than we did months ago.
He did not have all the pieces of the puzzle put together, but he does now. He understands the
problem a lot better now. The City Council better understands the problem now. Next week it is his

intension to have the answers to all the questions. You may not like all the answers; but he will do
the absolute best to get all those answers, because he has no desire to give up this gavel without this
issue being put to rest. He stated that he will relay the consensus of this Council, and let you know
what is the City's strategy. Above all, he wants to find closure to this issue because we all have
better things to do. He again thanked everyone for being there.
Mayor Pro -Tem Scagliola recognized Councilmember Antuna who thanked the Mayor Pro -Tem for
articulating the message. He stated that he has heard that the resident's want the City to force the
hand of HUD to comply. It is hard to force the hand of the Federal Government. We can not
enforce a Federal Law, only the Federal Government can. The things you are asking us to do, only
the State can implement. We do want to help. Maybe we should pass a resolution stating we support
a Lemon Law, and send it up to our State Senator, Jeff Wentworth, and to our State Representative,
John Kuempel. Councilmember Antuna thanked everyone for attending and for their comments this
evening.
Mayor. Pro-Tem. Scagliola recognized Councilmember Edwards who stated that when he purchased
his home a few months ago, he had received a list of all subcontractors and their subs. That was
given to him from his builder. He also has a copy of his plans and other information that was given
to him in a packet. He was wondering if the residents had received this type of information when
they purchased their homes. He stated that he had received these a year ago, as well as 10 years ago
when he purchased his other home. He stated that his home was not engineered, it was stick built.
He was out every other day checking, following up, and asking questions regarding the building of
his home. He does not understand why those documents were not given to the homeowners by the
builder. That's unusual.
Mayor Pro -Tem Scagliola recognized City Manager John Kessel who stated that they will come
back next week with staffs' recommendation on the items presented this evening point- by- point.
We will re- review the recording to make sure that they have covered everything.

Mayor Pro -Tem Scagliola recognized Councilmember Fowler who asked if the City has been
having problems with the Blackberries or was it just the signal. Executive Director David
Harris stated that the problem is both. He asked Councilmember Fowler to bring in his
Blackberry and they would switch it out.
Mayor Pro -Tem Scagliola recognized Councilmember Antuna who stated that the Executive
Commission will have to go back to the drawing board regarding their nominations, as the
Precinct Chairs that made the nominations were not the current Chairs. New Precinct Chairs
will be selected in July and the Executive Commission will have their nominees after they
are elected.

Mayor Pro-Tern Scagliola stated he attended the Doggie Dash this weekend and it was a
great event.

Mayor Pro-Tem. Scagliola recognized City Manager John Kessel who stated he also attended
the Doggie Dash and ran the 5K in 25.32. Mr. Kessel also mentioned he and his team mates
who played in the EMS Golf Tournament Sunday came in first place.
