A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AUTHORIZING THE PURCHASE AND
INSTALLATION OF NEW PLAYSCAPE EQUIPMENT AND OTHER
MATTERS IN CONNECTION THEREWITH
WHEREAS, the City staff of the City of Schertz (the "City") has recommended that the
City enter into an agreement with GameTime by Total Recreation Products, Inc, relating to the
purchase and installation of playscape equipment and playscape pad; and
WHEREAS, the City Council has determined that it is in the best interest of the City to
contract with GameTime pursuant to the Buy Board Contract #370-11 and the Proposal attached
hereto as Exhibit A (the "Agreement").
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
THAT:
Section 1. The City Council hereby authorizes the City Manager to execute and
deliver the Agreement with GameTime in substantially the form set forth on Exhibit A. The total
amount payable under this Agreement shall not exceed $292,250.00 plus $50,000.00 for a total
amount of $342.250.00.
Section 2. The recitals contained in the preamble hereof are hereby found to be hue,
and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a
part of the judgment and findings of the City Council.
Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved herein.
Section 4. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
Section 5. If any provision of this Resolution or the application thereof to any person
or• circumstance shall be held to be invalid, the remainder of this Resolution and the application
of such provision to other persons and circumstances shall nevertheless be valid, and the City
Council hereby declares that this Resolution would have been enacted without such invalid
provision.
Section 6. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Chapter 551, Texas Government Code, as amended.
Section 7. This Resolution shall be in force and effect from and after its final
passage, and it is so resolved.

timbers are notwarranted. The Customer is responsible for locating anti clearly marking all underground utilities in the installation
area before any insta0atian work can begin. The installer is not responsible for damages, repairs, or discontinuance of business due to
damaged utilities.
If applicable, sprinkler system locates, re-working and repairs are eacluded from installation charges. Installation of all products,
(equipment, borders, fall surfacing and amenities) are as quoted and approved by acceptance of quotes and drawings. As a
precautionary measure, work in progress areas will be taped off at the end of the workday. Pier spoils from installation shall be spread
at site, site will be left rough grade. Trash disposal is the responsibility of the Customer. The Instafier is not responsible Tar any damages
or re-work resulting from after hours evehts or activities during the work in progress period. Temporary fencing is only provsded b}'
speciftc request, and additional charges will apply. Collectively and/or indmdualty, not the manufacturer, TRP, they representatives,

approved and accepted placement of all items, along with addltiooel work, over and above quoted items, will he chargeable to the
customer. Once work is completed the customer will be notified if present at the job s[[e, and all responsibility of any new work wIH be
