AN ORDINANCE BY THE CITY COUNCIL OF THE
SCHERTZ, TEXAS AUTHORIZING AN AMENDMENT
MASTER THOROUGHFARE PLAN OF THE
COMPREHENSIVE LAND PLAN

WHEREAS, the City Council (the "City Council") of the City of Schertz, Texas (the
"City") seeks to promote the public health, safety, morals, and general welfare of the City and
the safe, orderly, and healthful development of the City; and
WHEREAS, by action on February 20, 2002, the City Council adopted a Comprehensive
Land Plan (the "Comprehensive Land Plan") for the City; and
WHEREAS, by action on September 21, 2004, the City Council approved an amendment
to Chapter 5 (Transportation) of the Comprehensive Land Plan, specifically amending Figme 5.2
thereof (the "Master Thoroughfare Plan"); and
WHEREAS, the policies and objectives contained in the Comprehensive Land Plan and
the Master Thoroughfare Plan are implemented by the City's Unified Development Code (the
"UDC") as expressed in Article I, Section 7 of the UDC; and
WHEREAS, the City Council has determined that there should be a further amendment to
the Master Thoroughfare Plan of the Comprehensive Land Plan; and
WHEREAS, the City Council fmds that it is necessary and proper for the good
govermnent, peace, or order of the City to adopt this ordinance amending the Master
Thoroughfare Plan of the Comprehensive Land Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SCHERTZ, TEXAS:
Section 1. The City Council hereby adopts the modified Master Thoroughfare Plan
attached hereto as Exhibit A.
Section 2. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a
part of the judgment and findings of the City Council.
Section 3. The Comprehensive Land Plan, as adopted and amended to the date
hereof, is hereby ratified except to the extent amended hereby. All ordinances, resolutions, or
other actions of the City Council, or parts thereof, which are in conflict or inconsistent with any
provision of this Ordinance are hereby repealed to the extent of such conflict, and the provisions
of this Ordinance shall be and remain controlling as to the matters ordained herein.
Section 4. This Ordinance shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.

Section 5. If any provision of this Ordinance or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Ordinance and the application
of such provision to other persons and circumstances shall nevertheless be valid, and the Council
hereby declares that this Ordinance would have been enacted without such invalid provision.
Section 6. It is officially found, determined, and declared that the meeting at which
this Ordinance is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Ordinance, was
given, all as required by Chapter 551, as amended, Texas Govermnent Code.
Section 7. This Ordinance shall be in force and effect from and after its final passage
and any publication requITed by the City Charter.
