TAKE NOTICE that an election will be held in the City of Schertz, Texas on
November {, 2012, in obedience to an ordinance duly entered by the City Council of the City on
7uly 24, 2012, which ordinance reads substantially as follows:

AN ORDINANCE CALLING A SPECIAL ELECTION TO BE HELD IN
THE CITY OF SCHERTZ ON NOVEMBER 6, 2012 FOR THE PURPOSE
OF ELECTING A MAYOR TO FILL A VACANCY IN SUCH OFFICE
AND CALLING A HOME RULE CHARTER AMENDMENT ELECTION
TO BE HELD IN THE CITY ON SUCH DATE; MAKING PROVISION
FOR THE CONDUCT OF THE ELECTION; AND RESOLVING OTHER
MATTERS INCIDENT AND RELATED TO SUCH ELECTION AND
DECLARING AN EFFECTIVE DATE
WHEREAS, there is a vacancy in the position of Mayor, and, pursuant to Section 4.06{c)
of the Home Rule Charter {the "Charter") of the City of Schertz, Texas (the "City"), the City
Council hereby finds and determines that a special election should be held in the City an
November 6, 2012, which is the next uniform election date prescribed under the Texas Election
Code, for the purpose of electing a Mayor to fill the vacancy in the Mayor's position; and
WHEREAS, pursuant to Section 12.04 of the Charter of the City, the City Council of the
City, by majority vote of the full membership of the City Council reflected in this Ordinance, has
recommended amendments to the Charter; and
WHEREAS, the City Council of the City hereby detei7nines to submit to the qualified
voters of the City for their adoption or rejection cei•kain proposed amendments to the Charter
pursuant to the provisions of Sections 12A4 of the Charter and Section 9.004, as amended, Local
Government Code; and
WHEREAS, the Council hereby finds and determines that the Charter amendment
election shall be held on Noverr>.ber 6, 2012 which is the next uniform election date prescribed
under the Texas Election Code, as amended; and
WHEREAS, the Council hereby finds and determines that holding the proposed Charter
amendment election on the next unifoi7n election date is in the best interests of the citizens of the
City; and
WHEREAS, the City will contract with the Guadalupe County Elections Administrator
(the "Elections Administrator") to conduct this election; and
WHEREAS, the City Secretary shall publish and post notice of this election as required
by applicable law; and
WHEREAS, the Council hereby finds and dete>~nines that it is in the best interests of the
citizens of the City to fill the vacancy in the position of Mayor and to submit, for adoption or
rejection, the proposed amendments to the Charter, at the earliest possible date, in order for this
Council to be advised of the wishes of the citizens of the City; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
THAT;

SECTION 1. A special election to f 11 the vacancy in the position of Mayor shall be held
on November 6, 2012, a uniform election date in the City of Schertz, Texas, which date is not
less than thirty (30) days fiom the final adoption of this Ordinance. At such election, the
candidate receiving the most votes for Mayor shall be declared elected for a term to expire in
May 2011. Any candidate desiring to have his or her name on the Official Ballot for said
election shall, no sooner than July 21, 2012 and no later than August 20, 2012, file with the City
Secretary an application in writing in the form prescribed by the Texas Election Code requesting
that his or her name be placed on the Official Ballot and declaring as a candidate for Mayor.
Any person failing to file said written application for candidacy by the time aforesaid shall not be
entitled to have his or her name printed on the Official Ballot. The name of all eligible
candidates whose applications have been duly and timely filed shall be placed on the Official
Ballot pursuant to a drawing as provided by law.
SECTION 2. An election to present proposed amendments to the City Charter shall also
be held on November b, 2012, a unifoi-~n election date in the City of Schertz, Texas, which date
is not less than thirty (30) days from the date of the final adoption of this ordinance (this
"Ordinance"). The official ballots for the election shall be prepared in accordance with the
Texas Election Code, as amended, and the Charter so as to permit the qualified voters of the City
to vote "Yes" ox "No" for each of the proposed Charter amendments which shall appear on the
ballot substantially as provided below. On the date of the election the fallowing amendments to
the Charter shall be submitted to the qualified voters of the City:
Charter Amendment No. 1
"Shall the second paragraph of Section 4.05 of the existing City Charter relating to the Mayor
Pra-Tem 6e amended to read as follows?"
"The Mayor Pro-Tem shall be a Councilmember appointed by the City Council
for a term and pursuant to procedures established by the City Council from time
to time. The Mayor Pro-Tem shall act as Mayor during the absence or disability
of the Mayor and in this capacity shall have the rights conferred upon the Mayor.
While acting as Mayor, the Mayor Pro~Tem may vote on any matter before the
City Council."

requirement of publishing an entire franchise ordinance in a newspaper as a requirement for such
ordinance to be effective but requiring that the entire franchise ordinance be placed on the City's
website for at least one week prior to final adoption of the franchise ordinance?"

"Shall Section 6.07(a) of the existing City Charter relating to the Office of Taxation be amended
to read as follows?"
"(a) Assessor-Collector. The City Manager shall appoint, and may remove, the
Ciry's Assessor-Collector of taxes. The City Council may, in the interest of
economy and efficiency and on the recommendation of the City Manager,
authorize the City Manager to contract with an individual or another political
subdivision as Assessor-Collector to handle the assessment and/or collection of
taxes, and no separate Assessor-Collector need be appointed in such case. The
Assessor-Collector shall give a surety bond for the faithful perfai~nance of his or
her duties including compliance with all controlling provisions of the State law
bearing upon the functions of his or her office in a sum which shall be fixed by
the City Council, but in no event shall the amount be less than twenty thousand
dollars, the cost to be borne by the City; provided, if the Assessor-Collector is an
officer of another political subdivision providing services to the City by conhact
and if the City Council determines that the Assessor-Collector's existing surety
bond sufficiently protects the City, no further surety bond shall be required."

forgive current or delinquent penalties and interest be amended to read as follows?"
"{e) Tax Remissions, Discounts and Compromises. Neither the City Manager
nor the City Council shall have the right to forgive any current or delinquent taxes
or penalty and interest related to taxation except in cases of error or otherwise as
permitted by State law."

"{a} Regular Elections. The regular City election shall be held on the uniform
election date in November in each calendar year commencing in 2013 or as
otherwise required by applicable State laws. If this provision is approved by the
voters in the election of November 6, 2012, the tez7ns of all members of the City
Council serving following such approval shall end, and their successors' two-year
tei7ns shall commence, on the following dates: for Councilmembers Place 3,
Place 4, and Place 5 - on the regular election date in 2014 and as to their
successors commencing on each even-numbered year thereafter; and for Mayor
and Councilmembers Place 1 and Place 2 - on the regular election date in 2015
and as to their successors comrrzencing on each odd-numbered year thereafter."

The City Secretary shall past on the City's website a copy of the current City Charter, marked to
show the proposed changes described in this Ordinance and shall keep a copy of such document
in the City Secretary's office and make it available for viewing without charge to members of the
public for their review on their request.
SECTION 3. Pursuant to Section b 1.012, as amended, Texas Election Code, the City
shall provide at least one accessible voting system in each polling place used in the election.
Such voting system shall comply with Texas and federal laws establishing the requirement for
voting systems that permit voters with physical disabilities to cast a secret ballot. Touch screen
machines may be used for early voting and electian day voting by personal appearance. Certain
early voting may be conducted by mail. The Election Administratar shall also utilize a Central
Counting Station (the "Station") as provided by Section 127.001, et seq., as amended, Texas
Election Code. Sue Basham, the Elections Administrator, has been appointed as the Manager
and Presiding Judge of the Station, and she may appoint Station clerks and establish a written
plan for the orderly operation of the Station in accordance with the provisions of the Texas
Election Code. The Election Administrator will appoint the Tabulation Supervisor, who will
also serve as the Programmer for the Station. Lastly, the Election Administrator will publish
notice and conduct testing on the automatic tabulation equipment relating to the Station and
canduct instruction for the officials and clerks for the Station in accordance with the provisions
of the Texas Election Code.
SECTION 4. The City election precincts established for this election shall be the
precincts named on Exhibit A attached hereto. A list of the City election precincts and the
polling places designated for each such election precinct are identified on Exhibit A to this
Ordinance, and this Exhibit is incorporated by reference for all pu>poses. At least 63 days prior
to the scheduled election date, the Council, in coordination with the Elections Administrator, will
identify and fornally approve the appointment of the Presiding Judges, Alternate Presiding
Judges, Election Clerks, and all other election officials for this election.
Each Presiding Judge shall appoint not less than two (2) resident qualified voters of the
County to act as clerks to properly conduct the election. However, if the Presiding Judge
appointed actually serves, the Alternate Presiding Judge shall serve as one of the clerks. The
appointment of such clerks may include a person fluent in the Spanish Ianguage to serve as a
clerk to render oral aid in the Spanish language to any voter desiring such aid at the palls on the
day of the election. In the absence of the Presiding Judge named above, the AlteY~ate Presiding
Judge shall perform the duties of the Presiding Judge.
The election shall be held in the City at the precinct locations listed on Exhibit A as
prescribed by applicable law, and, on the day of the election, the polls shall be open from '1:00
a.m. to 7:00 p.m.
The Guadalupe County Elections Office, 1101 Elbel Road, Schertz, Texas 78154, is
hereby designated as the main early voting place at which early voting shall be conducted. Sue
Basham, the Elections Administrator (whose mailing address is Post Office Box 1346, Seguin,
Texas 78156), is hereby appointed as the Early Voting Clerk to canduct such early voting in the
election. The Early Voting Clerk shall appoint not less than two (2) Deputy Early Voting Clerks

in accordance with the provisions of the Texas Election Code. Early voting shall be conducted
on the dates and at the times, and at the locations, identified in Exhibit A.
An Early Voting Ballot Board is hereby established far the purpose of processing early
voting results. Sue Basham, the Elections Administrator, will appoint the Presiding Judge of the
Early Voting Ballot Board. The Presiding Judge shall appoint not less than two (2) nor more
than ten (10) resident qualified voters of the County to serve as members of the Early Voting
Ballot Board.
SECTION 5. All resident qualified voters of the City shall be permitted to vote at any
one of the early voting locations, and, on the day of the election, such voters shall vote at any one
of the designated polling places. The election shall be held and conducted in accordance with
the provisions of the Texas Election Code, as amended, and the provisions of Texas Revised
Civil Statutes, Chapter 1 of Title 22, as amended, and as may be required by any other law. All
election materials and proceedings shall be printed in both English and Spanish.
SECTION b. The anticipated fiscal impact of conducting the election and implementing
modifications, if any, to the Charter which may be approved by the voters in such election is
currently estimated to be $21,831.
SECTION 7. A substantial copy of this Ordinance shall serve as a proper notice of the
election. This notice, including a Spanish translation thereof, shall be posted at the City Hall not
less than twenty-one {21) days prior to the date the election is to be held, and be published in a
newspaper of general circulation in the City, (a) not more than thirty (30} days, and not less than
ten {10) days prior to the day of the election, and (b) on the same day in each of two successive
weeks with the first publication occurring not less than fourteen (1~1) full days prior to the day of
the election.
SECTION 8. The Council authorizes the City Manager or his designee to negotiate and
enter into a joint election agreement and a conhact to conduct the election with the Elections
Administrator in accordance with the provisions of the Texas Election Code.
SECTION 4. The recitals contained in the preamble hereof are hereby found to be tz-ue,
and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a
part of the judgment and findings of the Council.
SECTION 10. All ordinances and resolutions, or parts thereof, which are in conflict or
inconsistent with any provision of this Ordinance are hereby repealed to the extent of such
conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters
ordered herein.
SECTION 11. This Ordinance shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
SECTION 12. If any provision of this Ordinance or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Ordinance and the application
of such provision to other persons and circumstances shall nevertheless be valid, and this
Council hereby declares that this Ordinance would have been enacted without such invalid

provision. The Council hereby authorizes the Mayor and the City Manager of the City to make
such technical modifications to this Ordinance that are necessary for compliance with applicable
Texas or federal law or to carry out the intent of this Council, as evidenced herein,
SECTION 13. It is officially found, dete~7nined, and declared that the meeting at which
this Ordinance is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Ordinance, was
given, all as required by Chapter 551, Texas Govermnent Code, as amended.
SECTION 14. This Ordinance shall be in force and effect from and after its final passage
and any publication required by law.

POR CUANTO, hay una vacante en el puesto de Alcalde y, confoi7ne a la Seccion
4.Ob(c} de la Carta Constitutional del Gobierno Local (la "Carta") de la Ciudad de Schertz,
Texas (la "Ciudad"), el Consejo de la Ciudad por la presence falla y determina que se debe Ilevar
a cabo una election especial en la Ciudad el 6 de noviembre de 2012, que es la proxima fecha
uniforme para Ia election dictada bajo el Codigo de Elecciones de Texas, con el fin de elegir un
Alcalde para llenar la plaza vacante de ese puesto; y POR CUANTO, conforme a la
Seccion 12.04 de la Carta de la Ciudad, el Consejo de la Ciudad, por un voto de mayoria de la
membrecia complcta del Consejo de la Ciudad reflejada en esta Orden, ha recomendado las
enmiendas a 1a Carta; y
POR CUANTO, el Consejo de la Ciudad por la presence determina someter a los votantes
calificados de la Ciudad, para su adoption o rechazo, ciertas enmiendas propuestas a la Carta
confoi7ne a las disposiciones de la Seccion 12.04 de la Carta y la Seccion 9.004, segun
enmendadas, del Codigo de Gobierno Local; y
POR CUANTO, el Consejo par la presente falla y determina que la election para
enmendar la Carta se ]levara a cabo el 6 de noviembre de 2012, que es la proxima fecha de
election uniforme prescrita bajo el Codigo de Elecciones de Texas, segun enmendado; y
POR CUANTO, el Consejo por la presente falla y determina que llevar a cabo la election
propuesta para enrnendar 1a Carta en Ia proxima fecha de election unifarme esta en el mejor de
los intereses de los ciudadanos de la Ciudad; y
POR CUANTO, la Ciudad entrara en un contrato con el Administrador de Elecciones del
Condado de Guadalupe (el Administrador de la Election) para llevar a cabo esta election; y
POR CUANTO, el Secretario de la Ciudad colocara y publicara el aviso de esta election
segun 1o requiere la ley pertinente; y
POR CUANTO, el Consejo por la presente falla y determina que esta en los mejores
intereses de los ciudadanos de la Ciudad para llenar la vacante del puesto de Alcalde y someter,
para adoption o rechazo, las enmiendas propuestas a la Carta, en la fecha mas pronto posible,
con ei fin de que este Consejo sea notificado de los deseos de los ciudadanos de la Ciudad;

EL CONSEJO DE LA CIUDAD DE SCHERTZ, TEXAS, ORDENA QUE:
SECCION 1: Se Ileve a cabo una eleccion especial para llenar la vacante en el puesto de
Alcalde el 6 de noviembre de 2412, una fecha de eleccion uniforme, en la Ciudad de Schertz,
Texas, cuya fecha no es mends de treinta (30) Bias a partir de la adopcion final de esta
Ordenanza. En dicha eleccion el candidato que reciba la mayoria de los votos pars
desempenalse como Alcalde sera declarado comp el elegido pox un termino que vence en mayo
de 2014. Cualquier candidato o candidata que desee que su Hombre se incluya en la Boleta
Official pars dicha eleccion debera, no antes del 21 de Julio de 2012, y no mas tarde del 20 de
agosto de 2012, presentar ante el Secretario de la Cuidad una solicited por escrito en la forma
prescrita por el Codigo de Elecciones Texas solicitando que su Hombre sea incluido en la Boleta
Oficial y se le declare como candidato o candidata para Alcalde. Cualquier persona que no
presente dicha solicited por escrito para la candidatura durance el tiempo mencionado
anteriormente no tendra derecho a que su Hombre se imprima en la Boleta Official. Los Hombres
de todos los candidatos elegibles cuyas solicitudes han sido debida y oportunamente presentados
se colocaran en la Boleta Official conforrne a un sorted segun to dispone la ley.
SECCION 2: Ademas, una eleccion para presentar las enmiendas propuestas a la Carta
de la Ciudad se llevara a cabo el b de noviembre de 2012, una fecha de eleccion uniforme en la
Ciudad de Schertz, Texas, que es no mends de treinta (30) Bias a partir de la fecha de la adopcion
final de esta Orden (esta "Ordenanza"}. Las boletas oficiales para la eleccion se prepararan
conforme al Codigo de Elecciones de Texas, segun enmendado, y a la Carta para permitir que los
votantes calificados de la Ciudad voten "Si" o "No" para cada una de las enmiendas propuestas a
la Carta que apareceran en la Boleta substancialmente como se indica a continuation. En la
fecha de la eleccion, las siguientes enmiendas a la Carta seran sometidas a los votantes
calificados de la Ciudad:

"LSe debe enmendar el Segundo pai~•afo de la Section 4.05 de la Carta eYistente de la Ciudad con
relation al Alcalde Suplente a que lea como sigue?"
"El Alcalde Suplemente sera un Concejal designado por el Consejo de la Ciudad
por un tei7nino confoi~ne a los procedimientos establecidos por el Consejo de 1a
Ciudad ocasionalmente. El Alcalde Suplente se desempenara como Alcalde
durante la ausencia o incapacidad del Alcalde y en esta capacidad tendra los

Ciudad a entz•ar en contrato con un individuo u otra subdivision politica en calidad
de Asesor-Recaudador Para manejar la evaluation o recaudacion de impuestos, y

Asesor-Recaudador entregara un seguro de caucion para el rendimiento feel del
rendimiento de sus deberes, inclusive el cumplimiento con today las disposiciones

que sera establecida por el Consejo de la Ciudad, Pero en ningun momento la
cantidad sera menos de veinte mil dolares, el costo sera asumido por is Ciudad;
no obstante, si el Asesor-Recaudador es un funcionario de otra subdivision
politico que Ie presto 5e1'ViC10S a la Ciudad por contrato y si el Consejo de la
Ciudad determina que eI seguro de caucion existence del Asesor-Recaudador
protege to suf ciente a Ia Ciudad, no se requerira un seguro de caucion adicional.

"(a} Elecciones Regulares. La election regular de la Ciudad se llevara a caba en
la fecha de la election uniforme en noviembre de cada ano natural comenzando
en e12013 o de to contrario como to requieren las leyes pertinentes del estado. Si
esta disposition es aprobada par los votantes en la election del 6 de noviembre de
2012, los terminos de Codas los miembros del Consejo de la Ciudad que estan
sirviendo despues de dicha aprobacion finalizanan, y los terminos de dos anon de
todos sus sucesores comenzaran en las siguientes fechas: para los Concejales
Puerto 3, Puerto 4 y Puerto 5 - en la fecha de eIeccion regular en el 2014 y en
cuanto a sus sucesores comenzando en cada ano par de ahi en adelante; y para
Alcalde y Concejales Puesto 1 y Puerto 2 _ en la fecha de election regular en el
2015 y en tuanto a sus sucesores comenzando en cada alto impar de ahi en
adelante".

la Ciudad, para mostrar los cambios propuestos descritos en esta Ordenanza y mantendra una
copia de dicho documento en la oflcina del Secretario de la Ciudad y estara disponible para que
ei publico to pueda ver y revisar, sin costo alguno, si asi to solicita.
SECCION 3 : Conforlne a la Section 61 A 12, Begun enmendada, del Codigo de
Elecciones de Texas, la Ciudad proveera al menos un sistema de votacion accesible en cada
Centro de votacion utilizado en la Election. Dicho sistema de votacion cumplira con las leyes
federales y del Estado de Texas que establecen el requerimiento de sistemas de votacion para
permitirles a los votantes con discapacidades fisicas que emitan una boleta secreta. Maquinas
con pantalla tactil se padran usar para la votacion anticipada y para la votacion el dia de la
election compareciendo en persona. Cierta votacion anticipada se pods llevar a Cabo por
correo. El Administrador de la Election tambien utilizara una Estacion de Conteo Central (la
"Estacion") Begun se dispone en la Section 127.001, et seq., Begun enmendada, del Codigo de
Eleccianes de Texas. Sue Barham, Administradora de Elecciones, ha lido designada como
Gerente y Juez Presidenta de la Estacion y puede designar secretarios de la Estacion y establecen
un plan escrito para el funcionamiento ordenado de la Estacion segue se dispone en el Codigo de
Elecciones de Texas. El Administrador de la Election designana al Supervisor de Tabulation
quien tambien se desempenara en calidad de Programador de la Estacion. Por ultimo, el

Administrador de la Election publicara este aviso y llevara a cabo una Prueba del equipo de
tabulation automatics relacionado con la Estacion y llevara a cabo instruction para los
funcionarios y los secretarios de la Estacion segun se dispone en el Codigo de Elecciones de
Texas.
SECCION 4: Los precintos de election de la Ciudad establecidos pars esta election
reran los precintos mencionados en el Documento de Prueba A que se adjunta al presence
documento. Una lists de los precintos de election de la Ciudad y los Iugares de votacion
designados para cads uno de dichos precintos de eieccion se identifican en el Documento de
Prueba A de esta Ordenanza y este Documento de Prueba se incorpora por referencia para todos
los fines. Al menos b3 dias antes de la fecha de la election programada, el Consejo, en
coordination con el Administrador de Elecciones, identificara y oficialmente aprobara el
nombramiento de los Jueces Presidentes, los Jueces Presidentes Alternos, los secretarios de la
Election y todos los demas funcionarios de la election.
Cads Juez Presidente nombrara no menos de dos (2} votantes calificados residences del
Condado para que se desempel~en como secretarios para llevar a cabo conectamente la election.
No obstante, si el Juez Presidente nombrado sirve como tal, el Juez Presidente Alterrlo se
desempenara como uno de los secretarios. En el nambramiento de dichos secretarios se puede
incluir una persona que dornine el idioms espanol para servir en calidad de secretario y ofiecer
ayuda oral, en espanol, a toda votante que desee dicha ayuda en los centras de votacion e1 dia de
la election. En ausencia del Juez Presidente mencionado anteriormente, el Juez Presidente
Alterno desempenara las funciones de Juez Presidente.
La election se llevara a cabo en la Ciudad en las direcciones de los precintos electorales
que aparecen en el Documento de Prueba A segun to dispone 1a ley pertinence, y en el dia de la
election las urnas estaran abiertas desde las 7:00 a.m, a las 7:00 p.m.
La Oficina de Elecciones del Condado de Guadalupe, 1101 Elbel Road, Schertz, Texas
78154, es por la presence designada como el lugar principal para la votacion anticipada donde se
llevara a cabo dicha votacion anticipada. Sue Barham, Administradora de Elecciones (cuya
direction es Post Office Box 1346, Seguin, Texas 78156) es por la presence nombrada como
Secretaria de la Votacion Anticipada para llevar a cabo dicha votacion anticipada en la election.
La Secretaria de Votacion Anticipada designara a no menos de dos (2} secretarios Adjuntos para
la Votacion Anticipada segun se dispone en el Codigo de Elecciones de Texas. La votacion
anticipada se llevara a cabo en 1as fechas y a las horas, y en los lugares identificados en el
Documento de Prueba A.
Por la presente, se establece una Junta de Boletas para la Votacion Anticipada para fines
de procesar los resultados de la votacion anticipada. Sue Barham, Administradora de la
Election, nombrara al Juez Presidente de la Junta de Boletas para ia. Votacion Anticipada. El
Juez Presidente nombrara no menos de dos {2) y no mss de diez (10) votantes calificados,
residentes del Condado para desempenarse en calidad de miembros de la Junta de Boletas para la
Votacion Anticipada.
SECCION 5: A todos Ios votantes calificados, residentes de la Ciudad se les pei7nitira
votar en la Election y, en el dia de la misma, esos votantes votaran en cualquiera de los centros

de votacion designados. La election se lIevara a cabo y se conducira de acuerdo a como se
dispone en el Codigo de Elecciones de Texas, segun enmendado, y en Las disposicianes de Los
Estatutos Civiles Revisados de Texas, Capitulo 1 del Tltulo 22, segun enmendada y segun to
requiere cualquier otra ley. Todos Los materiales y procedimientos se irnprimiran en ingles y
espanol.
SECCION 6: EI impacto fiscal anticipado de ]levar a cabo la election e implementar Las
modificaciones, de haberlas, a 1a Carta Constitutional que podria ser aprobada por Los votantes
en dicha election actualmente se calcula que sea $21,831.
SECCION 7: Una copia sustancial de esta Orden seivira como aviso conespondiente de
la EIeccion. Este aviso, inclusive una tl-aduccion al espanol del mismo, se publicara en la Casa
de Ayuntamiento no menos de veintiun (21) dias antes de la fecha que se lleve a cabo la
election, y se publicara en un periodico de circulation general en la Ciudad, (a) no mas de treinta
(30) dias y no menos de diet (10) dias antes del dia de la election, y (b} el mismo dia en cada
una de dos semanas consecutivas con la primera publication tenienda Lugar no menos de catorce
(14) dias antes del dia de la election.
SECCION 8: El Consejo autoriza al Administrador de la Ciudad o su designado a
negociar y entrar en un acuerdo de election canjunta y un contrato paca llevar a cabo la election
con el Administrador de Elecciones segun se dispone en~el Codigo de Elecciones de Texas.
SECCION 9: Las narraciones contenidas en este preambulo son fieles y exactas y por la
presente Las mismas pasan a formar paste de esta Ordenanza paca todas Los fines y son adoptadas
como parte del fallo y determinaciones del Consejo.
SECCION 10: Todas Las ordenes y resoluciones, o panes de Las mismas, que esten en
conflicto o lean inconsistentes con cualquiera de Las disposiciones de esta Ordenanza por la
presente se revocan en cuanto a dicho conflicto, y Las disposiciones de esta Ordenanza seran y
pei~rlaneceran vigentes con respecto a Los asuntos ordenados en este documento.
SECCION 11: Esta Ordenanza sera inteipretada y se hara vales conforme a como se
dispone en Ias leyes del Estado de Texas y de Ios Estados Unidos de Norteamerica.
SECCION 12: Si cualquier disposition a esta Ordenanza o la aplicacion de la misrna se
cansiderase invalida paca cualquier persona o bajo alguna circunstancia, el resto de esta
Ordenanza y la aplicacion de dicha disposition a otras personas o circunstancias, no obstante,
seran validas y el Consejo por la presente declala que esta Ordenanza hubiese sido aprobada sin
dicha disposition invalida. El Consejo por la presente le autoriza al Alcalde y al Adlxlinistrador
de la Ciudad a que efectuen dichas modification tecnicas a esta Ordenanza que sean necesarias
paca cumplir con Las leyes pertinentes de Texas o federales o para llevar a cabo la intention de
este Consejo, tal como se prueba en este documento,
SECCI4N 13: Se falla, dete~mina y declara oficialrnente que la reunion en la cual se
adopto esta Ordenanza estuvo abierta al publico y se dio aviso publico en cuanto a la Nora, Lugar
y terra de asunto publico a considerarse en dicha reunion, inclusive esta Ordenanza, satisfizo
todos Los requerimientos del Capitulo 551, segun enmendado, del Codigo de Gobierno de Texas.
