12-R-114 Aviation Heights Phase 5 Waterline ImprovementsRESOLUTION NO. 12-R-114 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH FORD ENGINEERING, INC., RELATING TO ENGINEERING, DESIGN AND HYDRAULIC STUDY. FOR THE AVIATION HEIGHTS PHASE 5 WATERLINE IMPROVEMENTS, AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, the City staff of the City of Schertz (the "City") has determined that the City requires professional services relating to engineering, design and hydraulic study for Aviation Heights Phase 5 Waterline Improvements ;and WHEREAS, City staff has determined that Ford Engineering, Inc. is uniquely qualified to provide such services for the City; and WHEREAS, pursuant to Section 252.022(a)(4), the City is not required to seek bids or proposals with respect to a procurement for personal, professional, or planning purposes; and WHEREAS, funds for the professional services for this project, in the amount of $36,615 to which staff has added a 10% contingency for a total of $40,277 are to be transferred in from the FY 12-13 Water Reserves Fund Balance; and WHEREAS, the City Council has determined that it is in the best interest of the City to conh~act with Ford Engineering, Inc. pursuant to the Engineering Services Agreement attached hereto as Exhibit A (the "Agreement"). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby authorizes the City Manager to execute and deliver the Agreement with Ford Engineering, Inc. in substantially the form-set forth on Exlribit A. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. The work is to encompass the following streets and water meters associated with the bones fronting those streets: Brooks Avenue (Lindbergh Avenue to 606 Brooks Ave); Aero Avenue (Oak Street to 710 Aero Ave); Winburn Avenue (Randolph Ave to Scheriz Cleuteulary). Proiecl Scone In order to facilitate the delivery of said project, Ford Engineering Inc will provide the topographical survey of the existing streets to determine locations of existing utilities and pertinent topographic features. 'fhe City will provide recorded video of the existing sanitary sewer for the limits of Aero Avenue and Brooks Avenue described above, for location of sewer laterals. Also, the City will assist by `potholing' cxistiug water lines for location by Pord >;ngineering Inc. survey crews. Pord Engineering will rrcpare a set of conshucti0n plans, spettificalions, and quantity es)intaty, for review, approval, and consnuction WJIh associated details per the standards indicated in Statement of Work. Plans and specifications will he iu conformance with Cily of Schertz standards of construction and ntalerials. Plans will include the pipe line layout, limits of abandonutent of existing water in the alleys, limits of street restoration, and details for conslnrcliou. 'fhe project limits resides within a Zone AG Nood hazard area; cord L'ngineering will assist the City in the preparation of a flood plaiq permit. Pord L~nglnccring will have a repflseutalive available for pre-constructian turd periodic project meetings during conslnrclion. Pord Engineering will provide construction slaking to consist of a single line of slakes with guard slakes showing the slaliaung, and offset of horizontal Pt, PC and PT of the pipe alignment, locations of tees and bends, points of tic-in to cxistiug system, and major appurtcnanccs. Atier construction has been completed and work approved by the Owner, Ford Engineering will inco~poratc any changes Made during construction, as indicated by the contractor on a marked up set of plans, into a set of Projccl Record Drawings. Engineering Fee Compeusalioo for these scrvices will be in the amount of $36,615.00 which will cover all costs associated with the scope described above. Additional services and significant changes will be compensated for as provided by Attachment I to the Second Amendment to agreement for Engineering Services between the City of Schertz and Ford Engineering, Inc. dated April 1, 2012 (the "Second Amendment). Further, the scrvices described in this letter shall be subject to the terms of the Agreement Fm' Engineering Services between the City of Schertz and Ford Engineering, Inc. dated February 9, 2010, as amended by the First Amendment to Agreement for Eugitreeriug Services dated October 1, 2011 and the Second Amendment.
