1975D35 THE STATE OF TEXAS ~ COUNTY OF GUADALUPE ~ CITY OF SCHERTZ ~ On this, the 4th day of November, 1975, at 7:00 olclock P.M., the City Council of the City of Schertz, Texas, convened at a regular meeting at the regular meeting place in the Municipal Building in the City of Schertz, Texas, pursuant to due call and notice to all of the members of said City Council, which meeting was at all times open to the public, and at which meet- ing the following members were present, to-wit: ROBERT C. ARNOLD CITY SECRETARY CITY MANAGER There being a quorum present, the meeting was called to order by the Mayor, and, among other proceedings had were the following: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 21st day of October, 1975. It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Councilm;mber ~Y~/ff.R--- and seconded by Councilmember jZ..A.f J _____ that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. NAYS: None ORDINANCE NO. 7S- f) -l 36- AN ORDINANCE AMENDING ORDINANCE NO. 74-D-12 HERI'OFORE PASSED AND AOOPrED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, 'IEXAS, ON THE 2ND DAY OF APRIL, 1974, REGULATING TRAFFIC WITHIN THE CORPORATE LIMITS OF THE CITY OF SCHERTZ, TEXAS, AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, 'IEXAS: I That Section 14 - Schedule B - Full Stop Locations of Ordinance No. 74-D-12, heretofore passed, adopted and approved by the City Council of the City of Schertz, Texas, on the 2nd day of-April, 1974, is hereby arrended in the following respects: Through Streets Cross (stop) Streets LIVE OAK ROAD Maske Road (added) MITCHELL AVENUE (added) Colony Drive (added) THOMAS EDISON DRIVE (rerroved) Ful ton Drive (rerroved) IH 35 ACCESS ROAD PM 3009 (added) II That Section 15 - Schedule C - Yield Right of Way of Ordinance No. 74-D-12, is hereby arrended in the following respect: Right of Way Street Yield Street THOMAS EDISON DRIVE (added) FULTON DRIVE (added) III That Section 16 - Schedule D - No Parking of Ordinance No. 74-D-12 is hereby arrended in the following respect: (1) On Exchange Avenue there shall be no parking from the north side of Live Oak Road to Pfeil Street. (2) Commercial vehicles in excess of 3/4 ton, recreational vehicles, trailer houses, carrping trailers , live stock trailers, boats and boat trailers, or other trailers shall not be parked, left standing or stored on any city street, right-Of-way, alleyway or easement. This shall not restrict the parking of cormercial vehicles for the purpose of loading or nnloading. (3) No vehicle so equipped so that the rrotor is required to be left running in order to operate auxiliary systems nor any such vehicle so equipped wi th auxiliary systems shall be parked on any residential street between the hours of 8:00 o'clock P.M. and 8:00 o'clock A.M. IV That Section 17 - Schedule E - Speed Limits of Ordinance No. 74-D-12 is hereby amended in the following respects: (1) On Fann-to-Market 78 from the westerly city limits to a p::>int lying .282 miles east of the westerly city limits the speed limit shall be 30 miles per hour. (2) On Fann-to-Market 78 from a p::>int lying .282 miles east of the westerly city limits to a p::>int lying .934 miles east of the westerly city limits the speed limit shall be 40 miles per hour. (3) On Fann-to-Market 78 from a p::>int .934 miles east of the westerly city limits to a p::>int 1.334 miles east of the westerly city limits the speed limit shall be 45 miles per hour. (4) On Fann-to-Market 1518 from its intersection with Farrn-to-Market 78 to a p::>int .235 miles north of said intersection the speed limit shall be 30 miles per hour. (5) On Fann-to-Market 1518 from a p::>int .235 miles north of the inter- section of Fann-to-Market 1518 with Fann-to-Market 78 to a p::>int .635 miles north of said intersection the speed limit shall be 35 miles per hour. (6) On Fann-to-Market 1518 from a p::>int .635 miles north of the inter- section of Fann-to-Market 1518 and Fann-to-Market 78 to a p::>int 1. 049 miles north of said intersection the speed limit shall be 45 miles per hour. V That Ordinance No. 74-D-12 is hereby amended to add Section 18 - Schedule F - Operation of Bicycles and Play Vehicles which shall read as follows: This section shall be applicable whenever a bicycle is operated up::>n any highway or up::>n any path set aside for the exclusive use of bicycles, subject to exceptions herein stated. The parent or guardian of any child or ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this section. " Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject ot all of the duties applicable to drivers of rrotor vehicles except as provided herein and except as to those provisions which by their nature can have no application. A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached thereto; and no bicycle shall be used to carry rrore persons at one ti.rre than the number for which it is designed and equipped. Every person operating a bicycle upon a roadway shall ride as near to the right side of the road as practicable exercising due care when passing a standing vehicle or one proceeding in the same direction and shall not ride rrore than two abreast on paths or parts of roadways set aside for the exclusive use of bicycles. Whenever a usable path for bicycle riders shall use such path and shall not use such roadway. No person operating a bicycle shall carry any package, bundle or article which prevents the driver from keeping at least one hand upon the handlebars. Every bicycle when in use at nightirre shall be equipped with a larrp on the front which shall emit a white light visible from a distance of at least 500 feet from the front; and shall also be equipped with a red reflector on the rear of a type approved by the Texas Deparbrent of Public Safety which shall be visible from 50 to 300 feet from the rear when directly in front of lawful upper beams of head larrps of a rrotor vehicle. A larrp emitting a red light visible from a distance of 500 feet from the rear may be used in addition to the red reflector. Every bicycle shall also be equipped with a brake which will enable the operator to make the braked wheels skid on dry, level, clean paVem2I1t. No person shall drive any vehicle in any race, speed competition or contest, drag race or acceleration contest, test of physical endurance, exhibi tion of speed or acceleration or for the purpose of making a speed record; and no person shall in any m:mner participate in any such race, competion, contest, test or exhibition. .' VI That Ordinance No. 74-D-12 is hereby arrended to add Section 19 - Schedule G - Pedestrian Rights and Duties which shall read as follCMs: No pedestrian shall walk upon the traveled portion of the road- way when said roadway is paralleled by a sidewalk or pathway designated for pedestrian traffic. When pedestrians must walk in the roadway, they are required to walk no rrore than two (2) abreast on the side of the roadway facing oncoming traffic. VII That Ordinance No. 74-D-12 is hereby arrended to add section 20 - Schedule H - Traffic Safety Hazards which shall read as follows: The avner or person in control of any property adjacent to any intersection where a traffic control device is erected shall not permit any vegetation, fences or other structures to obstruct any such intersection or traffic control device. 'Any vegetation, fence or other structure in excess of 36" above roadway surface is hereby declared to be a public nuisance and traffic safety hazard. If the owner or person in control of such property fails to eliminate same within ten (10) days after notification by city officials, such obstruction shall be renoved by the city without any further notice. VIII I t shall be rmlawful for any person to do any act forbidden or fail to perfonn any act required in this ordinance. Penalty for violation shall be a fine not exceeding two hundred dollars ($200.00). Each violation shall consti- tute a separate offense. IX The City Secretary of the City of Schertz, Texas, is hereby directed to give notice of the passage of this ordinance by causing said ordinance to be published in one (1) issue of the official newspaper of the City.
