On this, the 17th day of June, 1975, at 7:00 o'clock
P.M. the City Council of the City of Schertz, Texas, convened
at a regular meeting at the regular meeting place in the Muni-
cipal Building of said City in the City of Schertz, Texas,
which meeting was at all times open to the public, and at
which meeting the following members were present, to-wit:

WALTER F. SCHNEIDER

ALDERWOMAN

CITY MANAGER
There being a quorum present, the meeting was called
to order by the Mayor; and, among other proceedings had were
the following:
The Mayor introduced the following captioned ordinance
which was read in full by the City Manager. Councilmember
FUNK moved that said ordinance be considered
by the Council as an emergency measure, which motion was
seconded by Councilmember SEEBA . Whereupon
said motion was fully discussed and considered. The Mayor
put the motion to consider said ordinance as an emergency
measure to the members of the City Council and said motion was
approved and adopted by the following vote:
AYES; Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None

The Mayor then introduced the hereinafter set forth
ordinance as an emergency measure. Thereupon it was moved
by Councilmember

that said ordinance
be finally passed and adopted. The Mayor put the motion to
a vote of the members of the City Council and the ordinance
was finally passed and adopted by the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.

ORDINANCE NO. 76---;::: - /..!:;-
AN ORDINANCE
EXTENDING THE PROVISIONS OF THE EXISTING
GARBAGE COLLECTION SERVICE FRANCHISE AT
THE SAME RATES UNTIL THE END OF THE PRE-
SENT FISCAL YEAR; AND DECLARING AN
EMERGENCY
WHEREAS, the present franchise for garbage collec-
tion will expire on June 30, 1975, and
WHEREAS, no new contract has been awarded, and
WHEREAS, it would be advantageous to start the new
contract at the beginning of the next fiscal year, and
WHEREAS, the present contractor is willing to ex-
tend the existing contract at the same rates until Octo-
ber 1, 1975, the beginning of the next fiscal year, NOW
THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
SECTION 1. The terms of City Ordinance #259 granting
Gutierrez Disposal and Materials, Inc., a Franchise to
operate a garbage collection service in the City, be ex-
tended from July 1, 1975 through September 30, 1975.
SECTION 2. Any new agreement on garbage collection will
become effective on October 1, 1975.
SECTION 3. The need to preserve and protect the public
health by furnishing adequate garbage disposal service
creates an imperative public necessity that this Ordinance
become effective on July 1st, 1975, and therefore all rules
and ordinances governing the effective date of any ordinance
are suspended so that this Ordinance may go into effect on
July 1, 1975, and it is so ordained.
